ORDINANCE NO. 83-28
AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF
GRAPEVINE CIIAPTER 12 ARTICLE I RELATING TO HEALTH
AND SANITATION BY AA�ENDING SECTION 12-7(9) RELATING
TO R�STRICTING CONSTRUCTION IN A RESIDENTIAL DISTRICT
� TO CERTAIN TIMES; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A PENALTY IN A SUM NOT TO EXCEED $200 FOR
EACH SEPARATE OFFENSE AND A SEPARATE OFFENSE SHALL
BE DEEMED COMMITTED UPON EACH DAY DURING OR ON
[M1'HICH A VIOLATION OCCURS; AND DECLARING AN EMER-
GENCY AND EFFECTNE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE:
Section 1. That Chapter 12, Article I of the Grapevine City Code is
amended by amending Section 12-7(9) as follows:
A. Section 12-7(9) is hereby amended to read as follows
"The erection, including excavation, demolition, al-
teration or repair of any building in a residential
district, other than between the hours of 7:00 a.m.
and 6:00 p.m. on Monday through Saturday, except in
the case of urgent necessity in the interest of public
safety, for which a permit shall be obtained from the
building official."
Section 2. Severability. If any section, article, paragraph, sentence,
clause, phrase or word in this ordinance, or application thereto to any person or
circumstance is held invalid or uncoristitutional by a Court of competent
jurisdiction stich holding shall not affect the validity of the remaining portions
of the ordinance; and the City Council hereby declares it would have passed such
remaining portions of the ordinance despite such invalidity, which remaining
portions shall reamin in full force and effect.
Section 3. Penalty. Any person violating any of the provisions of this
ordinance shall be deemed guilty of a misdeameanor and upon conviction thereof
shall be fined in a sum not to exceed two hundred dollars ($200.00) and a
separate offense shall be deemed committed upon each day during or on which
a violation occurs or continues after the notice period provided herein has
expired. The Court shall order removal and abatement of the nuisance.
Section 4. Emergency. The fact that no present ordinances of the City
of Grapevine exists amending City of Grapevine Chapter 12, Article I relating
to Health and Sanitation, creates an urgency and an emergency in the
preservation of the public health, safety and welfare requires that this ordinance
shall take effect immediately from and after its passage and the publication of
the caption as the law and charter in such cases provides.
DULY PASSED by the City Council of the City of Grapevine, Texas, this
