ORDINANCE NO. 8;--54
. AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF
GRAPEVINE, TEXAS, BY AMENDING CHAPTER 22, ARTICLE N
" RELATING TO TAXICAB DRNERS BY AMENDING SECTION 22-
55; AND BY AMENDING CHAPTER 22, ARTICLE VI RELATING
TO TAXICAB BUSINESS REGULATIONS BY AMENDING SECTION
22-?0; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF
TWO HUNDRED DOLLARS ($200.00) AND A SEPARATE OFFENSE
SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR
ON WHICH A VIOLATION OCCURS: PROVIDING A SEVERABILITY "
CLAUSE; PROVIDING AN EFFECTNE DATE AND DECLARING
AN EMERGENCY
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1. That Chapter 22 of the City Code of the City of Grapevine,
Texas, is hereby amended only in the particulars stated in this ordinance and
that all other existing sections, subsections, paragraphs, sentences, definitions,
phrases and words of said City Code are not amended, but shall remain intact
and are hereby ratified, verified and affirmed.
Section 2. That Chapter 22, Article N of the City Code of the City of
Grapevine, Texas, is hereby amended by amending Section 22-55 to read as
follows:
"If the chief of police deems it advisable, he shall make such
additional investigations of the applicant as he deems necessary to
ascertain whether or not he is a fit and proper person to drive a
taxicab in the city. If, after examining such applicant and
obtaining such information as he deems advisable, the chief of
police is satisfied that the applicant is a fit and proper person to
drive a taxicab in the city, then upon the payment of a fee of five
dollars ($5.00) by the applicant, the chief of police shall cause to
be issued to such applicant a permit to drive taxicabs in the city. �
Each permit issued shall expire on the thirty-first day of December
following the date of issuance. The fee for a permit to drive a
taxicab is intended to defray a part of the costs of keeping the `
records in the police department pertaining to taxicab drivers."
Section 3. That Chapter 22, Article VI of the City Code of the City of
Grapevine, Texas, is hereby amended by arnending Section 22-70 to read as
follows:
"The rates to be charged by all taxicab operators in the city
shall be as follows:
One Dollar Thirty Cents for the first 1/8 mile or
($1.30) fraction thereof.
� Ten Cents ($0.10) for each additional 1/8
mile or fraction thereof.
Fifty Cents ($0.50) for each additional pas-
senger (excluding infants
in arms).
One Dollar ($1.00) extra passenger charge
. between the hours of 9:00
p.m. and 8:00 a.m.
Eight Dollars ($8.00) per hour traffic de-
lay/waiting time."
Section 4. Any person violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and upon conviction thereof shall be
fined in a sum not to exceed Two Hundred Dollars ($200.00) and a separate
offense shall be deemed committed upon each day during or on which a violation
occurs or continues.
Section 5. If any section, article, paragraph, sentence, clause, phrase or
word in this ordinance or application thereto any person or circumstance is held
invalid or unconstitutional by a Court of competent jurisdiction such holding
shall not affect the validity of the remaining portions of the ordinance; and the
City Council hereby declares it would have passed such remaining portions of the
ordinance despite such invalidity, which remaining portions shall remain in full
force and effect. . �
Section 6. The fact that the present ordinances and regulations of the
City of Grapevine, Texas, are inadequate to properly safeguard the health,
safety, morals, peace, and general welfare of the inhabitants of the City of
Grapevine, Texas, creates an emergency for the immediate preservation of
public business, property, health, safety, and general welfare of the public which
requires that this ordinance shall become effective from and after the date of
its passage and it is accordingly so ordained.
