WHERE;AS, the awners of property abutting a portion of Old Main Street in
the City of Grapevine, Texas have requested the right-of-way of a portion of
Old P•Tain .�treet, as hereina�ter described, be closed, abandoned, and vacated;
and
Wf�ZE;AS, the right-of-way of said street, as hereinafter described, is
not naw ne�eded for public use and will not be needed in the future for public
use; and
WHE'RE;AS, closing, abandoning, and vacating the rightrof-,way of said
street wi]_1 relieve the City of Grapevine, Texas fran the cost and expense of
maintainirig said property.
NUW, THE�'ORE, BE IT ORDAINID BY THE CITY COUNCIL OF THE CITY OF GRAPE- �
VINE� TEXP�S:
Secti.on 1. That the portion of right-of-�way of Old Main Street located
within the: property described in �hi.bit "A", attached and incorporated herein
for all purposes, is hereby closed, abandoned, and vacated for public �se, and _
the same i.s hereby closed, abandoned, and vacated insofar as all public right,
title, anci interest in and to said described portion of said right-of�way is
concerned, provided, however, that the entire tract shall be retained for
public ut:ility easement pur-�oses, and a public utility easement is hereby
retained. �
Secti.on 2. That the Mayor, be, and is hereby authorized to execute
Quitclaim Deeds to evidence release of the City's interest in the heretofore
described property to the owners of the property abutting said right-of way,
Mr. John Stevenson, Mr. James Green, and the State of Texas Depart�nt of
Highways ��nd Public Transportation, who officially declared by affidavit that
they are ihe rightful awners of the underlying fee title to the right-of-way
vacated ar.�d abandoned by this ordinance.
Secti.on 3. That the terms and provisions of this ordinance shall be
deerr�d to be severable, and that if the validity of any section, subsection,
word, sent:ence, or phrase shall be held to be invalid, it shall not affect the
remaining part of this ordinance.
Secti.on 4. That the effective date of this ordiriance shall be August 17,
1982.
Secti.on 5. The fact that the said portion of right-of�aay of Old Main
Street is no longer needed by the public for public usage or traveling and
wc>uld cre�te a hardship or burden upon the City of Grapevine to keep open and
maintain such street creates an urgency and an emergency for the i�r�ediate
preservati.on of the public health, safety, and general welfare which requires
that this ordinance shall take effect irr�ediately frc�n and after its passage,
and it is accordingly so ordained.
