AN ORDINANCE AMENDING THE CITY CODE OF
THE CITY OF GRAPEVINE, TEXAS BY AMEND-
ING CHAPTER FOUR (4) RELATING TO ALCO-
HOLIC BEVERAGES BY AMENDING SECTION
43 AND SECTION 47 ; PROVIDING A SEVERA-
BILITY CLAUSE; PROVIDING A PENALTY AND
DECLARING AN EMERGENCY ,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS :
SECTION l. That Chapter Four (4) of the City Code
of the City of Grapevine relating to alcoholic beverages
is hereby amended by amending the following sections to
read as follows :
Section 4-3 :
"The storage, possession, sale or serving of
alcoholic beverages by anyone for consumption
by anyone either on or off the premises shall
be illegal unless on property zoned specific-
ally for that purpose as a ��SP" Specific Use
Permit District of the Comprehensive Zoning
Ordinance, Appendix A.
Section 4-7 :
"There is hereby levied pursuant to Article 11. 38
of the Alcoholic Beverage Code of the State of
Texas the following schedule of fees for each
person or entity holding a license or permit
under the Alcoholic Beverage Code which fees
shall equal at all times to one-half of the
fee assessed by the State of Texas for each
permit pursuant to the Alcoholic Beverage Code:
A. For each mixed beverage permit:
First through third years $ 0 . 00
Fourth and subsequent years 250 . 00
B. For each retail dealers off-pre-
mise license 5. 00
C. For each mixed beverage late
hour permit 50. 00
D. For each beverage cartage per-
mit for each holder of a mixed
beverage or private club regis-
tration permit 5. 00
E. For each holder of a private
club registration one-half
of fee set by Article 32 . 02
of Alcoholic Beverage Code in
accordance with the graduated
schedule incorporated into said
Article.
F. For each holder of a late hour
permit for a private club. 250 . 00
SECTION 2 . Any person violating or failing to comply
with any provisions of this ordinance shall be fined upon
conviction, not less than One Dollar ($1. 00) no more than
TWO HUNDRED DOLLARS ($200. 00) and each day any violation
of non-compliance continues shall constitute a separate
offense.
SECTION 3. It is hereby declared to be the intention
of the City Council of the City of Grapevine that the sections ,
paragraphs , sentences, clauses , and phrases of this ordinance
are severable and if any phrase, clause, sentence, paragraph
or section hereof should be declared unconstitutional, such
unconstitutionality or invalidity shall not affect any of
the remaining phrases , clauses , sentences , paragraphs or
sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation in
this ordinance of any such unconstitutional or invalid
phrases , clause, sentence, paragraph or section.
SECTION 4. The fact that the present ordinances and
regulations of the City of Grapevine are inadequate to
properly safeguard the health, safety, morals , peace and
general welfare of the inhabitants of the City of Grapevine,
creates an emergency for the immediate preservation of the
public business , property, health, safety, and general
welfare of the public which requires that this ordinance
shall become effective from and after the date of its passage
as provided by the Charter of the City of Grapevine and it
is accordingly so ordained.

GRAPEVINE, TEXAS on this the 3rd day of February ,
1981.
