ORDINANCE NO. 81-9
AN ORDINANCE AMENDING THE CITY CODE OF THE
CITY OF GRAPEVINE CHAPTER 14 SECTIONS 14-28 AND
14-38(a) RELATING TO BILLIARD HALLS; PROVIDING A
PENALTY; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the city code of the City of Grapevine Chapter
14 dealing with billiard halls is hereby amended by amending Sections
14-28 and 14-38(a) to read as hereinafter stated:
"Section 14-28 Gambling; Intoxication.
It shall be unlawful for any person while in a billiard hall to
gamble, make bets, consume or have in his possession any
alcoholic beverage, or to be under the influence of any
alcoholic beverage provided however that the terms of this
section relating to the possession and consumption of any
alcoholic beverage shall not be applicable to parties on
premises that are operating pursuant to a mixed beverage
permit issued by the Texas Alcoholic Beverage Commission
and zoned for such use by the City."
� "Section 14-38(a) Conditions of Issuance.
(a) No license to operate a billiard hall shall be granted
unless the premises sought to be used for such purposes are
in an area where such use is permitted under the zoning
ordinance."
Section 2. That a person violating a provision of this ordinance,
upon conviction, is punishable by a fine not to exceed $200.
Section 3. Severability Clause.
If any section, paragraph, subdivision, clause or phrase of this
ordinance shall be adjudged invalid or held unconstitutional; the same
shall not affect the validity of this ordinance as a whole or any part
of any provision thereof other than the part so decided to be invalid or
unconstitutional.
Section 4. Emergency.
The fact that the City of Grapevine, Texas, needs to amend its
code relating to billiard halls within the City creates an urgency and an

emergency and the preservation of public health, safety and welfare
requires that this ordinance shall take effect immediately from and
after its passage and the publication of the caption as the law in such
cases provides.
