ORDINANCE NO. 81-15
AN ORDINANCE CLOSING, ABANDONING AND
VACATING A PORTION OF KELSEY COURT &
ALL DRAINAGE AND UTILITY EASEMENTS IN
THE CITY OF GRAPEVINE, TEXAS , AS HEREIN-
AFTER DESCRIBED; PROVIDING A SEVERABILITY
CLAUSE; AND DECLARING AN EMERGENCY

WHEREAS , the owner of property abutting a portion of
Kelsey Court in the City of Grapevine, Texas has requested
the right-of-way of a portion of Kelsey Court and all drainage
and utility easements , as hereinafter described, be closed,
abandoned and vacated; and
WHEREAS , the right-of-way of said street and all drain-
age and utility easements as hereinafter described are not
now needed for public use and will not be needed in the
future for public use; and
WHEREAS , closing, abandoning and vacating the right-of-
way of said street and all drainage and utility easements
will relieve the City of Grapevine, Texas , from the cost and
expense of maintaining said property; .
NOP7, THEREFORE, BE IT OP.DAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS :
Section 1. That the portion of right-of-way of Kelsey
Court, and all drainage and utility easements located with-
in the property described by metes and bounds in Exhibit
"A" , attached and incorporated herein for all practical
purposes , is hereby closed, abandoned and vacated for public
� use and the same is hereby closed, abandoned, and vacated
insofar as all public right, title, and interest in and to
said described portion of said Right-of-Way, drainage and
utility easements are concerned.
Section 2. That the r�ayor, be, and is hereby authorized
to execute a Quit-Claim Deed to convey the heretofore des-
cribed property to the owner of the property abutting said
R.O.W. , who officially declared by affidavit that she is the
rightful fee owner of the right-of-way vacated and abandoned
by this ordinance.
Section 3. That the terms and provisions of this ordi-
nance shall be deemed to be severable and that if the validity
of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining
part of this ordinance.
Section 4 . The fact that the said portion of right-of-
way of Kelsey Court and all drainage and utility easements
are no longer needed by the public for public usage or traveling
and would create a hardship or burden upon the City of Grapevine
to keep open and maintain such drainaqe and utility easements and

such street creates an urgency and an emergency for the
immediate preservation of the public health, safety and
general welfare which requires that this ordinance shall
take effect immediately from and after its passage and
it is accordingly so ordained.
PASSED AND APPROVED BY THE CITY COUNCIL of the City
of Grapevine, Texas on this the 17 day of March ,
1981.
