Home My WebLink AboutORD 1981-017 i ORDINANCE NO. 81-17 AN ORDINANCE CLOSING, ABANDONING AND VACATING A PORTION OF SMITH STREET IN THE CITY OF GRAPEVINE, TEXAS, AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY WHEREAS , the owner of property abutting a portion of Smith Street in the City of Grapevine, Texas has requested the right-of-way of a portion of Smith Street, as herein- after described, be closed, abandoned and vacated; and WHEREAS, the right-of-way of said street as hereinafter described is not now needed for public use and will not be needed in the future for public use; and WHEREAS , closing, abandoning and vacating the right-of- way of said street will relieve the City of Grapevine, Texas, from the cost and expense of maintaining said property; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS : Section l. That the portion of right-of-way of Smith Street located within the property described in Exhibit "A" , attached and incorporated herein for all practical purposes, is hereby closed, abandoned and vacated for public use and the same is hereby closed, abandoned, and vacated insofar as all public right, title, and interest in and to said described portion of said Right-of-Way, is concerned. Section 2. That the Mayor, be, and is hereby authorized to execute a Quit-Claim Deed to convey the heretofore described property to the owner of the property abutting said R.O.W. , who officially declared by affidavit that the First Baptist Church of Grapevine is the rightful fee owner of the right- of-way vacated and abandoned by this ordinance. Section 3. That the terms and provisions of this ordi- nance shall be deemed to be severable and that if the valid- ity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 4 . The fact that the said portion of right-of- way of Smith Street is no longer needed by the public for public usage or traveling and would create a hardship or burden upon the City of Grapevine to keep open and maintain such drainage and utility easements and such street creates an urgency and an emergency for the immediate preservation of the public health, safety and general welfare which re- quires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
