AN ORDINANCE CLOSING, ABANDONING A� VACATING _
��.�..,..._.,.�
A PORTION OF DUNN STREET IN THE CI Y OF GRAPE-
VINE, TEXAS, AS HEREINAFTER DESCRIBED; PROVID-
ING A SEVERABILITY CLAUSE; PROVIDING AN EFFECT-
IVE DATE; AND DECLARING AN EMERGENCY
WHEREAS, the owner of property abutting a portion of
Dunn Street in the City of Grapevine, Texas has requested
the right-of-way of a portion of Dunn Street, as herein-
after described, be closed, abandoned and vacated; and
WHEREAS, the right-of-way of said street as hereinafter
described is not now needed for public use and will not be
needed in the future for public use; and
WHEREAS, closing, abandoning and vacating the right-of-
way of said street will relieve the City of Grapevine, Texas
from the cost and expense of maintaining said property;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXA5 :
Section 1. That the portion of right-of-way of Dunn
Street located within the property described in Exhibit "A" ,
attached and incorporated herein for all practical purposes ,
is hereby closed, abandoned and vacated for public use and
the same is hereby closed, abandoned, and vacated insofar as
all public right, title, and interest in and to said described
portion of said Right-of-Way, is concerned, provided however,
no utility easements dedicated in the Lakeside Estates sub-
division shall be deemed vacated.
Section 2. That the Mayor, be, and is hereby authorized
to execute a Quit-Claim Deed to evidence release of the City' s
interest in the heretofore described property to the awners of
the property abutting said R.O.W. , who officially declared by
affidavit that Mr. R.E. Murphy and Jay-Mar Corporation are the
rightful owners of the underlying fee title to the right-of-
way vacated and abandoned by this ordinance.
Section 3. That the terms and provisions of this ordinance
shall be deemed to be severable and that if the validity of any
section, subsection, word, sentence or phrase shall be held to
be invalid, it shall not affect the remaining part of this
ordinance.
Section 4. That the effective date of this ordinance shall
be August 19, 1980.
Section 5. The fact that the said portion of right-of-
way of Dunn Street is no longer needed by the public for
public usage or traveling and would create a hardship or
burden upon the City of Grapevine to keep open and maintain
such drainage and utility easements and such street creates
an urgency and an emergency for the immediate preservation
of the public health, safety and general welfare which re-
quires that this ordinance shall take effect immediately .from
and after its passage and it is accordingly so ordained.
