ORDINANCE NO. 81-46
AN ORDINANCE CLOSING, ABANDONING, AND
VACATING A PORTION OF ESTILL STREET IN
THE CITY OF GRAPEVINE, TEXAS, AS HERE-
INAFTER DESCRIBED; PROVIDING A SEVER-
ABILITY CLAUSE; PROVIDING AN EFFEC-
TIVE DATE; AND DECLARING AN EMERGENCY
�
WHEREAS, the owner of property abutting a portion of
Estill Street in the City of Grapevine, Texas has requested
the right-of-way of a portion of Estill Street, as herein-
after described, be closed, abandoned, and vacated; and
WHEREAS, the right-of-way of said street as hereinafter
described is not now needed for public use and will not be
needed in the future for public use; and
WHEREAS, closing, abandoning, and vacating the right-
of-way of said street will relieve the City of Grapevine,
Texas from the cost and expense of maintaining said property;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS :
Section 1. That the portion of right-of-way of Estill
Street located within the property described in Exhibits "A"
and "B" , attached and incorporated herein for all practical
purposes, is hereby closed, abandoned, and vacated for public
� use and the same is hereby closed, abandoned, and vacated inso-
far as all public right, title, and interest in and to said
described portion of said Right-of-Way, is concerned, provided
� however, that a ten-foot utility easement on the south portion
of said street shall be retained for utility purposes only.
Section 2 . That the Mayor, be, and is hereby authorized
to execute Quitclaim Deeds to evidence release of the City' s
interest in the heretofore described property to the owners
of the property abutting said R. O. W. , who officially de-
clared by affidavit that they are the rightful owners of the
underlying fee title to the right-of-way vacated and aban-
doned by this ordinance.
Section 3. That the terms and provisions of this ordi-
nance shall be deemed to be severable and that if the validity
of any section, subsection, word, sentence, or phrase shall be
held to be invalid, it shall not affect the remaining part of
this ordinance.
Section 4. That the effective date of this ordinance
shall be July 21, 1981.
Section 5. The fact that the said portion of right-of-
�r�# way of Estill Street is no longer needed by the public for
public usage or traveling and would create a hardship or bur-
den upon the City of Grapevine to keep open and maintain such
street creates an urgency and an emergency for the immediate
preservation of the public health, safety and general welfare
which requires that this ordinance shall take effect immed-
iately from and after its passage and it is accordingly so
ordained.
