The City Council and Planning & Zoning Commission of the
City of Grapevine, Texas met in Joint and Special Session
on this the 24th day of March, 1981 with the following
persons present to-wit:

�..� The meeting was called to order by Mayor Tate.
INVOCATION
Reverand David Whitington, representing Christ Our King
Independent Methodist Church delivered the Invocation.
INTRODUCTIONS & PROCEDURES
Mayor Tate introduced members of the Planning & Zoning
Commission and explained the procedure to be followed
� during the public hearings.
PUBLIC HEARING, ZONING APPLICATION Z81-13, MIKE ROSS
The first order of business was for the City Council and
Planning & Zoning Commission to conduct a public hearing
relative to Zoning Application Z81-13, submitted by Mr.
Mike Ross.
Mayor Tate declared the public hearing open and called
�,,,�, upon the City Secretary to explain the request of the
applicant.
�� The Council was advised that the property in question,
Lots 5, 6, & 7, of Block 8, of the Lucas Addition, was
presently zoned ."SP" Specific Use Permit for commercial
and business uses; for the retail sale of alcoholic beve-
rages for off-premise consumption only and the storage of

alcoholic beverages incidental to said retail sale, all
according to a site plan. It was further noted that
the requested zoning was for "SP" Specific Use Permit
District Zoning for the storage, retail sale, and off-
premise consumption of alcoholic beverages , (beer only)
incidental to the operation of a convenience store and
gasoline service station; further providing for the
construction and operation of a car wash facility, all
in accordance with a site plan; providing for compliance
with "C-2" Community Business District construction re- ,,�
quirements and further allowing all other uses as provided
in the "C-2" Community Business District zoning category.
Mr. Ross addressed the Council advising that he was sub- �
mitting the revised site plan to allow for the construction
of a new convenience store building and car wash facility.
He explained that the new building would be located further
from Northwest Highway allowing for better ingress-egress
and more parking area.
There being little discussion from the Council and Planning
& Zoning Commission, Mayor Tate asked if there were guests
present to speak for or against the zoning request. There
were none.
Commission Member Harlen Joyce, therefore, made a motion
to close their portion of the public hearing. The motion
was seconded by Member Robert Sands and prevailed by
the following vote:

PUBLIC HEARING, ZONING APPLICATION Z81-14 , S.L. WYSE
, The next order of business was for the City Council and
' I Planning & Zoning Commission to conduct a public hearing
' �I relative to Zoning Application Z81-14 , submitted by Mr.
'�, S.L. Wyse.
� Mayor Tate declared the public hearing open and asked the
' City Secretary to explain the application. The Council
was advised that the property in question contained ap-
proximately 85 acres and was located in the James Gibson
Survey, bounded on the south by Bethel Road, on the east
by the Dallas County Line and was east of Highway 121 to
Lewisville. It was further stated that the current zoning
was "R-1" Single Family Dwelling District, with the requested
zoning being for "I-1" Light Industrial District Zoning.

Mr. Sam Wyse addressed the Council advising that the property
was owned by Airport Business Park with plans being for the ,
development of an industrial park. �,,;
Several questions were asked by members of the Planning &
Zoning Commission relative to the access,i.bility of utilities,
construction of buildings incorporating noise preventive
measures, and road accessibility to the property.

Mayor Tate asked if there were guests present to speak
for or against the application. Mr. Mike Vela representing
the Planning Department of D/FW Airport, advised that the
Airport had responded to the request by formal letter.

Dear Mr. Rogers:
In response to your letter of March 13 ,
1981, concerning the above referenced
subject, we have prepared this written
statement to outline our official posi-
tion.
Zoning Application Z81-14 requests a
f. zoning change from "R-1" Single Family
` Dwelling District to "I-1•• Light In-
"`�� dustrial District.
;,,� The projected noise levels for this area,
prepared by the North Central Texas
Council of Governments on October 14 ,
1971, indicate that the subject parcel
of land is situated within the middle
zone of effect - Zone B and the extreme
southern edge of this property lies
within the zone of greatest effect -
Zone C.
A location in Zone B states that an
industrial/manufacturing use may be
generally considered without any special
sound treatment; however, since part of
this property is within Zone C , sound
control in building design should be
considered for the proposed building
use.
Based on the information outlined above,
the DFW Airport does not object to the
subject application if proper sound
'"�`" control is incorporated in building de-
sign.

contour map has been attached for your
reference.

PUBLIC HEARING, ZONING APPLICATION Z81-15, KEN STILES
The next order of business was for the City Council and
Planning & Zoning Commission to conduct a public hearing ;
relative to Zoning Application Z81-15, submitted by <.�
Mr. Ken Stiles. �►
Mayor Tate declared the public hearing open and called upon
the City Secretary to explain the requested zoning. Mrs. �`
Armstrong advised that the property in question was slightly
over four acres located on the west side of Dunn Street in
the Samuel Freeman Survey. She further stated that the
present zoning was "R-1" Single Family Dwelling District with
' the request being for "SP" Specific Use Permit District for
' the construction of single family attached dwellings in ac-
, cordance with a site plan, providing for compliance with all
, construction requirements in the "R-1" Single Family Dwelling
District.
' Mr. Ken Stiles then addressed the Council and Planning &
Zoning Commission and presented a site plan of the proposed
' development.
Questions were asked pertaining to the availability of sewer
and water, square footage of each unit, and the common drive-
ways shown on the plat.
The following guests then spoke in opposition to the requested
zoning: Mr. Bob Murphy, 1869 Chris Craft Drive; Mr. & Mrs.
Richard Grant, 1846 Anglers Plaza; Kathlene Piller, 2006 �
Candle Court; Mr. Joe Kennedy, 1855 Anglers Plaza and Mr.
Bob Blackwell, 1617 Silverside Drive. The concerns expressed
included the Master Plan revision proposing that multi-family ,���,
units be near a thoroughfare, traffic congestion, street
parking, child safety and concern for multi-family near
single family areas.
The City Secretary was then presented a petition containing
sixty-seven signatures in opposition to the requested zoning.

The following letter was then read into the record:

Dear Council Members & Concerned
Citizens of Grapevine
Being unable to attend this evenings
Council meeting, I am requesting that
you read this letter to voice my
strong opposition to two zoning re-
"�"" quests being presented tonight. The
' first one does not affect my property
directly, but it does affect my com-
� munity and those that have a substan-
tial investment in their homes already
located in that area. This request is
for the Specific Use Permit at the ,.
north end of Dunn Street, now zoned
Single Family. To grant this change
which directly and acutely affects these
homeowners, certainly is not fair or
even reasonable. In addition, these
types of requests are becoming common
place and too frequently granted. . . .
Tuesday after Tuesday, Grapevine
residents are required to fight for the
quality of their neighborhoods. We
have more than enough real estate in
Grapevine zoned to suit the type of
construction that Mr. Stiles is re-
questing.
The second request I strongly oppose
involves the property at 101 Brookside
;,,�, Drive at Northwest Highway. I insist
' that you deny this change which affects
my immediate neighborhood for the very
� same reasons I stated previously. We
do not want business "dotted•� all-over
our neighborhood, which we do take pride
in and enjoy. Please help we citizens
in developing orderly growth and a well-
planned community.
Thank you for this consideration of my
views.

PUBLIC HEARING, ZONING APPLICATION Z81-16, BRUCE CASBURN
The next order of business was for the City Council and
Planning & Zoning Commission to conduct a public hearing
relative to Zoning Application Z81-16 , submitted by Mr.
Bruce Casburn.
�
Mayor Tate declared the public hearing open and called
upon the City Secretary to explain the application. It
was reported that the property in question, Lot l , Block �wr
1, Brookside Addition (101 Brookside Drive) , was currently
zoned "R-1" Single Family Dwelling with the requested
zoning being for "C-2" Community Business District Zoning,
or in the alternative, any higher zoning that is more re-
strictive by use or restrictions .
Mr. Casburn then addressed the Council and Planning & Zoning
Commission noting that the property is bounded on the west
by commercial zoning and on the south by Northwest Highway.
He added that the intended use was for a real estate office,
or other low traffic commercial uses.
Questions were then asked pertaining to ownership of the
property and deed restrictions.
Mr. Terry Bland, 202 Brookside then addressed the Council
in opposition to commercial zoning being requested in a re-
sidentially platted neighborhood and presented a petition con-
taining thirty-four signatures.
Applicant, Bruce Casburn, then addressed the Council, expressed �
concern for the opposition, and respectfully requested that
the application be withdrawn.
�
There being no further discussion, Member Sharron Spencer
made a motion that the request for withdrawal be accepted.
The motion was seconded by Member Harlen Joyce and prevailed
by the following vote:

Mayor Tate announced that because of the number in attendance
regarding the zoning applications, the Planning & Zoning
Commission would recess and reconvene in the Council Chambers,
while the Council would recess and reconvene in the Conference
Room. Guests were invited to attend either meeting.

� Mayor Tate called the Council back to order with all
members present.
CONSIDERATION OF THE MINUTES
�
The next order of business was consideration of the Minutes
of March 17, 1981. There being no additions or corrections,
Councilman Mullendore made a motion to waive the reading of
the minutes and approve them as published. The motion was
seconded by Councilman Shafer and prevailed by the following
vote:
Ayes . Tate, Ware, Oliver, Shafer, Mullendore, Dunn, &
Brekken
Nays . None
ORDINANCE, ABANDONMENT OF A PORTION OF SMITH STREET
The next order of business was for the City Council to
consider an ordinance relative to the abandonment of a
portion of Smith Street.
The City Secretary read the caption of the proposed ordinance.
� The Council was reminded that the application for abandonment
had been submitted by First Baptist Church and that a presen-
tation had been previously been made by Dr. George Clerihew
during the meeting of March 3 , 1981.
There being little discussion, Councilman Oliver made a
motion that the ordinance be adopted. The motion was
seconded by Mayor Pro Tem Ware and prevailed by the following
vote:

ORDINANCE NO. 81-17
AN ORDINANCE CLOSING, ABANDONING AND
VACATING A PORTION OF SMITH STREET IN
THE CITY OF GRAPEVINE, TEXAS , AS HERE-
INAFTER DESCRIBED; PROVIDING A SEVER-
ABILITY CLAUSE; AND DECLARING AN EMER-
GENCY
PUBLIC HEARING, SERVICE STATION APPLICATION, MIKE ROSS
,� The next order of business was for the City Council to con-
duct a public hearing relative to a service station applica-
tion, submitted by Mr. Mike Ross.
�
Mayor Tate declared the public hearing open.
Mr. Ross addressed the Council advising that in conjunction
with his zoning application, he was requesting a continuation
of his existing service station through the submission of a
revised site plan. He then presented an artist rendering
of the new facility.

There being little discussion, Mayor Tate asked if there
were any guests present, or if there were any letters to
be presented. There were none.
Council Member Marion Brekken then made a motion to close
the public hearing. The motion was seconded by Councilman
Shafer and prevailed by the following vote:

It was the general concensus of the Council that a decision wwr
pertaining to the application not be made until the zoning
application was acted upon later in the meeting.
ZONING APPLICATION Z81-10, TRAILWOOD MOBILE HOME
The next order of business was for the City Council to consider
the recommendation of the Planning & Zoning Commission, rela-
tive to Zoning Application Z81-10 (Trailwood Mobile Home) ,
and an ordinance if applicable.
A brief history was given advising that during the meeting
of March 17, 1981, the Planning and Zoning Commission had
recommended denial by a vote of four to two. The Council
was advised that in the event 20� of the neighboring property
owners opposed a zoning request, a 3/4 vote (6 members) of the
Council would be necessary to approve the request. Because
there were only five members of the Council in attendance
during that meeting, and there was sufficient opposition,
a motion was made to table consideration of the zoning
pending a full Council. Y
The City Secretary then advised the Council that applicant,
.�,
Herbert Martin had since requested that the application be
referred back to the Planning & Zoning Commission for fur-
ther review.
Mr. Martin was in attendance and further explained that
he wanted the matter referred back to the Planning & Zoning
Commission for guidance on what they feel would be the best
use of the property.
City Attorney, John Boyle noted that in the event the applica-
tion was denied, because of the manner in which the case had
been advertised, the applicant would be prohibited from
reapplying for mobile home zoning "or any higher or more
', ; restrictive zoning" , for a period of one year. It was ex-
' I plained that if the applicant knew what an acceptable use
', would be, he would have an opportunity to withdraw the current
', application, and resubmit a request for a suitable use.
' There being little discussion, Councilman Dunn made a motion
to refer the application back to the Planning & Zoning Commission
for further study. The motion was seconded by Councilman Oliver
and prevailed by the following vote:

ZONING APPLICATION Z81-13, MIKE ROSS
The next order of business was for the City Council to
consider the recommendation of the Planning & Zoning
Commission, relative to Zoning Application Z81-13 (Ross) ,
and a subsequent ordinance, if applicable.
Commission Chairman, Duane Rogers reported that the Planning
& Zoning Commission had recommended approval with the pro-
vision that the entrance/exit on the southeast corner of
�, the property be omitted from the site plan, and that a
common entrance be provided on the south side of the prop-
erty on Northwest Highway.
�"' The City Secretary then read the caption of the proposed
ordinance.
Mayor Pro-Tem Ware made a motion that the recommendation
of the Planning & Zoning Commission be accepted and the
ordinance adopted. The motion was seconded by Councilman
Mullendore and prevailed by the following vote:
Ayes . Tate, Ware, Oliver, Shafer, Dunn, Mullendore, &

AN ORDINANCE AMENDING ORDINANCE NO. 70-10 ,
THE COMPREHENSIVE ZONING ORDINANCE OF THE

KNOWN AS APPENDIX "A" OF THE CITY CODE OF
GRAPEVINE, TEXAS , GRANTING A ZONING CHANGE
ON A TRACT OF LAND DESCRIBED AS BEING A LOT,

The next order of business was for the City Council to
consider the service station application, submitted by
Mr. Ross.
Councilman Mullendore made a motion that the application
be approved. The motion was seconded by Councilman Oliver
and prevailed by the following vote:

The next order of business was for the City Council to
consider the recommendation of the Planning & Zoning Com-
mission, relative to Zoning Application Z81-14 (Wyse) ,
and a subsequent ordinance if applicable.
Chairman Rogers advised that the Planning & Zoning Com-
mission unanimously recommended approval of the requested
zoning.
The City Secretary read the caption of the proposed ordi-
nance.
Council Member Brekken then made a motion that the recommenda-
tion of the Planning & Zoning Commission be accepted and the
ordinance adopted. The motion was seconded by Councilman
Shafer and prevailed by the following vote:

The next order of business was for the City Council to
consider the recommendation of the Planning & Zoning

Commission, relative to Zoning Application Z81-15
(Stiles) , and a subsequent ordinance if applicable.
Chairman Rogers reported that the Planning & Zoning Com-
mission voted to deny the application by the following:
three for the motion, two opposing the motion, and one
abstention. The following reasons were sited for denial:
The proposed use did not conform to the proposed master
plan useage, excess traffic, and concern for the opposition
� expressed by residents of the area in question.
A short discussion then followed among members of the
;�, Council during which concern was expressed that the
area was platted for single family residents , and further
concern relating to the common driveways and proposed
traffic related problems.
Councilman Dunn therefore made a motion to accept the
recommendation of the Planning & Zoning Commission and
deny the application. The motion was seconded by Council
Member Brekken and prevailed by the fo�lowing vote:
Ayes . Tate, Ware, Oliver, Shafer, Mullendore, Dunn, &
Brekken
Nays . None
ADJOURNMENT
There being no further business to come before the Council ,
Councilman Oliver made a motion to adjourn. The motion was
