The City Council and the Planning and Zoning Commission of
the City of Grapevine, Texas met in joint session on this
the 21st day of October, 1980 with the following persons

CALL TO ORDER

Mayor Tate called the meeting to order.
INVOCATION
The Invocation was delivered by Planning and Zoning Commission
Member, Robert Sands.
' INTRODUCTIONS & PROCEDURE
Mayor Tate introduced members of the Planning and Zoning
Commission and explained the procedure to be followed during
the public hearings.
PUBLIC HEARING, ZONING APPLICATION Z80-41, SCHEPPS FOOD STORES
The first order of business was for the City Council and
Planning and Zoning Commission to conduct a public hearing rela-
tive to Zoning Application Z80-41, submitted by Schepps Food
Stores.
� Mayor Tate declared the public hearing open and called upon
Assistant City Manager, Bill Eisen to explain the request of
the applicant.
�""' Mr. Eisen reported that the applicant, Schepps Food Stores was
requesting that the property located on the southeast corner of
Mustang and Tanglewood be rezoned from "C-2" Community Business
District to "SP" Specific Use Permit for the storage, retail sale,
and off premise consumption of alcoholic beverages, (beer only)
incidental to the operation of a convenience store and gasoline
service station and other uses as permitted in the "C-2"

Community Business District.
Attorney Scott Keeshin made a presentation on behalf of the
applicants including the history of Schepps past attempts
to obtain a Specific Use Permit in the area in question.
Mr. Keeshin added that at this point in time he felt Schepps
had the support of the citizens. Mr. Keeshin further indicated
that Schepps might decline to locate in Grapevine in the event
the zoning is not approved.
A lengthy Council and Planning and Zoning Commission dis- „�„
cussion was then held relative to store competition, proximity
to an elementary school, and high school, other retail businesses
within the shopping complex, and concern from the Council that
Schepps had applied a third time for zoning in the same area. �`�`
Mayor Tate then asked if there were guests to speak for or
against the application.
The following persons spoke in opposition to the requested
zoning indicating that they were opposed to the sale of beer
in their area:

in regard to the applications. Mr. Eisen answered yes, and �

I appreciate the notification on the above
referenced application on the part of Schepps
Food Stores.
As owner of the adjoining duplex zoned property,
south of the subject site, I would like to go
on record as being in favor of granting "SP"
Specific Use Permit for the storage, retail sale,
and off premise consumption of alcoholic beve-
rages (beer only) , incidental to the operation
of a convenience store. I feel a well managed
establishment such as Schepps Food Stores plus
the added convenience of being able to purchase
beer for off premises consumption would be an
asset to the surrounding community.
If you have any further questions or thoughts on
this matter, please do not hesitate to call upon
me.

TO: The Mayor, City Council, & Planning and Zoning
Commission, City of Grapevine
SUBJECT: Zoning Application Z80-41, submitted by
Schepps Food Stores
I would like to express my opposition to granting
Schepps Food Stores permission to sell beer at their
convenience store to be located at the intersection
of Mustang and Tanglewood as requested by this zon-
ing application. Please consider the following items.
l. Beer is already available at two locations
on Highway 26 within a reasonable distance
from Oak Creek Estates , Creekwood Estates ,
*'�' and the Vineyard.
2. This location is in close proximity to two
r�,,,,,, s choo 1 s.
3. It is not necessary for every convenience
store to sell beer, especially if it is down
within our neighborhoods , and not on a major

thoroughfare. Schepps was content to build on
this location, even though beer zoning was turned
down before construction.
4 . It is my understanding that a strip shopping
center will be built at the intersection of
Timberline and Highway 121, just east of the
apartments currently being constructed in an
area already zoned commercial. This strip
shopping center will no doubt have a convenience
store and will also want to sell beer (perhaps
at a more logical site, as it is next to High- '"""'"
way 121. )
5. It was brought to my attention that Schepps �:-#�
has been quietly seeking support from some
residents in Oak Creek Estates. Since time
did not permit for much public response since
the notice of this public hearing was issued,
I 'm sure there are residents of this area who
are opposed who have been unable to voice their
displeasure.
6 . Lastly, the fact that this zoning case is again
before the City Council, though defeated only
a short time age, leads me to repeat an appeal
I have made to the City Council before:
The City Zoning Ordinances should
be amended such that once a zoning
case is heard, there should be a
reasonable time period to pass be-
fore the zoning case can again be
placed before the City Council--- �
be it 120 days, 180 days , or what-
ever. It is unrealistic to expect �
that your citizens should have to
continually and repeatedly come
voice their opinions as many times �
as some developer has the $90 to
give the City for the zoning applica-
tion filing fee. Sooner or later,
the citizens tire and no one shows
up in opposition representing the
citizens, and the developer gets what
he wanted in the first place. You owe
your citize�s more than that.

Please place my name in opposition to the zoning case �
for Schepps Food Stores for a Specific Use Permit for
the sale of beer for off premise consumption. I feel
that by awarding this zoning case it will bring the
sale of beer closer to our public schools. I am against '��`
the request and speak only as a single school board mem-
ber in asking for you to deny this request.

Mr. Eisen also reported that a petition had been submitted
with fifteen signatures in support of the application.
Mr. Keeshin then made reference to Article 109 . 32 of the
Texas Alcoholic Beverage Control Statute which addresses
the power of cities to distribute and control beer.
There being no further discussion, Planning and Zoning
Commission Member Harlen Joyce made a motion to close their
� portion of the public hearing. The motion was seconded by
Member Gerald Norman and prevailed by the following vote:

PUBLIC HEARING, ZONING APPLICATION Z80-43, SAPIENZA
The next order of business was for the City Council and
Planning and Zoning Commission to conduct a public hearing
relative to Zoning Application Z80-43 , submitted by Suzanne
Sapienza.
Mayor Tate declared the public hearing open.
Mr. Eisen explained that the property in question, 920 and
5 916 South Main Street, was currently zoned "C-2" Community
� Business District with the requested zoning being for a "SP"
Specific Use Permit for the storage, resale, and on premise
consumption of alcoholic beverages , incidental to the operation
�""` of a restaurant and other uses permitted in the "C-2" Community
Business District.
Mr. Tom Sapienza gave a brief presentation advising that
the Italian restaurant would be family operated by his wife
who had a business background, and by one partner with ex-
perience in the restaurant field.
In answer to questions , Mr. Sapienza indicated that beer and
wine only would be served and only in conjunction with the meal. .
A short discussion was then held relative to the amount of
remodeling intended on the existing building and the hours
and days of operation.
There being no further discussion, Mayor Tate asked if there
were any letters or petitions in regard to the application.
Mr. Eisen then read the following letter into the record.

PUBLIC HEARING, ZONING APPLICATION Z80-44, CINCO BANDITOS
The next order of business was for the City Council and Planning
and Zoning Commission to conduct a public hearing relative to
Zoning Application Z80-44 , submitted by Cinco Banditos.
Mayor Tate declared the public hearing open. Mr. Eisen ex-
plained that the property in question was on the east side of
Dooley Street, just north of East Northwest Highway. He further
noted that the present zoning was "C-2" Community Business
District with the requested zoning being for a "SP" Specific
Use Permit for the construction and operation of mini-storage
warehouse units, in accordance with a site plan, and other
uses as permitted in the "C-2" Community Business District
Zoning Category.

There was no one in attendance to represent the applicant.
Mayor Tate asked if there were guests present to speak for or �''
against the application. There were none.
Mr. Eisen indicated that one letter had been received and read
it into the record as follows :

PUBLIC HEARING, ZONING APPLICATION Z80-45, DENNIS ROBERTS
The next order of business was for the City Council and Planning
� and Zoning Commission to conduct a public hearing relative to
� Zoning Application Z80-45 , submitted by Mr. Dennis Roberts .
Mayor Tate declared the public hearing open and called upon
� the Assistant City Manager to explain the application. Mr.
Eisen reported that the property in question was 118 West
Dallas Road. He noted that the current zoning was "L-1"
Limited Industrial Zoning with the requested zoning being for
"I-1" Industrial District Zoning.
Mr. Dennis Roberts made a brief presentation explaining that
the purpose of the requested change was to allow him to take
advantage of the smaller setback requirements in the "I-1"
zoning category. He noted that the existing building would
be torn down and a new one constructed for the purpose of
operating Dennis Electric Company.
There being little discussion from members of the Planning &
Zoning Commission, and Council, Mayor Tate asked if there were
guests present to speak in relation to the requested zoning.
There were none. Mr. Eisen reported that he was not in receipt
of any letters or petitions.
Planning and Zoning Commissioner Ron Cook made a motion to
close their portion of the public hearing. The motion was

following vote:

Mayor Tat� �dvised that the Planning & Zoning Commission
would reconvene in the Civic Center, 311 Main Street to
deliberate the merits of the zoning applications and to
consider other agenda items . He added that the Council �*
would reconvene in the Council Chambers following a recess.

Mayor Pro-Tem Ware called the Council back to order with
all members present with the exception of Mayor Tate.
RESOLUTION, GRAPEVINE INDUSTRIAL DEVELOPMENT BONDS
The next order of business was for the City Council to
consider a resolution approving the issuance of City of
Grapevine Industrial Development Corporation Bonds , Series
1980 (Standard Motor Products , Inc. ) $3 Million and any and
all other related and necessary legal matters .
City Attorney John Boyle explained that the paperwork was not
yet complete and asked that the item be tabled with the schedule
to include the Grapevine Development Corporation meeting at noon
on Tuesday, October 28 , and the Council meeting in Special Ses-
sion at 5 : 00 P.M. on that same date for consideration of this
item.
Councilman Dunn then made a motion to table the item and to �
call a special meeting of the City Council for 5 : 00 P.M, on
October 28 , 1980 for the purpose of considering the bond pur- �"
chasing agreement. The motion was seconded by Councilman
Shafer and prevailed by the following vote: ,��
Ayes . Ware, Oliver, Shafer, Dunn, Mullendore, & Brekken
Nays . None

BIDS, MIDDLE SCHOOL TENNIS COURT FENCE
The next order of business was for the City Council to consider
authorizing the City Staff to accept bids for the Middle School
Tennis Court Fence.
Upon the request of the City Manager, (for the purpose of re-
viewing alternatives) , Councilman Mullendore made a motion
that the item be tabled. The motion was seconded by Council-
man Dunn and prevailed by the following vote:
Ayes . Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken
Nays . None
Absent : Tate
ORDINANCE, ADOPTING 1979 UNIFORM HOUSING CODE

The next order of business was for the City Council to con-
sider amending the City Code, Chapter 7 , Section 140 by adopt-
ing the 1979 edition of the Uniform Housing Code. �
City Engineer, Jim Baddaker explained that recently the Council
adopted the 1979 Building and Fire codes. He further commented
that those two codes inter-related with the Housing Code and
asked that the Council adopt the 1979 Uniform Housing Code in
an effort to become uniform.

Councilman Mullendore made a motion to adopt the ordinance.
The motion was seconded by Councilman Shafer and prevailed
by the following vote:

ORDINANCE NO. 80-58

AN ORDINANCE AMENDING THE CITY CODE, CHAP-
TER 7 , SECTION 140 BY ADOPTING THE 1979
+�,rr EDITION OF THE UNIFORM HOUSING CODE AND
ITS SUBSEQUENT AMENDMENTS; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A PENALTY
AND DECLARING AN EMERGENCY
PAYMENT, LITTLE BEAR CREEK SEWER, TRINITY RIVER AUTHORITY
The next order of business was for the City Council to consider
authorizing payment to Trinity River Authority for the Little
Bear Creek Sewer.
City Engineer, Jim Baddaker gave a brief history of the past
agreement with Trinity River Authority. He further stated that
there were two fees that TRA was requesting to be paid as follows :
(1) $30,173 for the City' s share of the capacity in the

exact balance of the construction fee would be payable by the

then outlined the speed limit proposal for the Trail Lake
Addition.

DISCUSSION, PORTABLE BUILDING REGULATIONS
The next order of business was for the City Council to dis-
cuss amending the City Code relative to relocating portable
structures.
The City Attorney explained that in the ordinance pertaining
to the relocation of portable structures, the current defini-
tions and terms covered "any" structure, including small
portable storage buildings in residential rear yards. He
added that in the past the thrust of the ordinance was to
include larger type structures, or structures used for commer-
cial purposes. The City Attorney further commented if the
Council desired, the Ordinance could be amended to exclude
those structures that are not used for human occupancy, not
used for commercial purposes, and of a certain size. +�►
It was the general concensus of the Council that such an
Ordinance be drafted for future consideration. �,,,,��
Councilman Dunn therefore made a motion to instruct the City
Attor:ney to draft the necessary ordinance. The motion was

PUBLIC UTILITY REGULATORY POLICIES ACT, 1978, HEARING DISCUSSION
The next order of business was for the City Council to consider
the hearing required by the Public Utility Regulatory Policies
Act of 1978.
Assistant City Manager, Bill Eisen advised that the Public
�, Utility Regulatory Policies Act of 1978 was enacted by Con-
gress in an effort to reduce the likelihood of future electricity
and natural gas shortages. He added that one of the requirements
of the law was that all jurisdictions having regulatory authority
�' over gas and electric supplies hold a series of public hearings.
Mr. Eisen continued to explain that the hearing required must
cover eleven proposed standards including peak-load pricing,
advertising as a part of the rate base, and fuel adjustment
charges. The Council was then advised of three possible courses
of action:
(1) The City could relinquish its original jurisdiction
in regulatory matters and turn it over to the
Public Utility Commission;
(2) Council could table consideration of the PURPA
standards until after the Public Utility Commission
and Railroad Commission held their hearings;
(3) The Council could elect to conduct hearings on the
proposed standards .
It was the recommendation of the City Staff and City Attorney
�� that the second recommended course of action be taken.
� Following a short discussion, Councilman Mullendore made a
motion that consideration of the various utility rate making,
� and other standards specified in the Public Utility Regula-
tory Policies Act of 1978 be tabled until after both the
Public Utility Commission and the Railroad Commission of Texas
consider same, at which time this municipal regulatory authority
will schedule a hearing to consider those standards in light
of the determinations made by these state regulatory bodies .

PRELIMINARY PLAT, METROPLACE
The next order of business was for the City Council to consider
the recommendation of the Planning & Zoning Commission rela-
tive to the Metroplace Preliminary Plat.
Chairman Rogers reported that the Planning & Zoning Commission
recommended approval of the preliminary plat.
City Engineer, Jim Baddaker presented the plat and noted
that the development would invo�ve Dallas/Fort Worth Air-
port. He added that the plat showed a street connection to
the west across airport property to a bridge that would be
built under the present State Highway Department contract
for W.D. Tate Avenue, (Highway 121) . Mr. Baddaker advised +�►
that in discussions with Mr. Bob Heath, Manager of Planning
and Engineering at the airport, it was indicated that the
street connection would hinder airport plans for a parking ,�;�,,,
area in this vicinity. Mr. Heath had suggested a north-
south connection to 14th Street, south and east of the proposal
by Metroplace. Mr. Baddaker then recommended approval of the
preliminary plat with the understanding that the access to the
Highway Department bridge be resolved by mutual agreement bet-
ween the City, D/FW Airport and the Developer.

appointing a committee to determine the most desirable place
for a Municipal Complex.

City Manager, Jim Hancock gave a brief history including several
' suggestions to a future city hall complex.
Mayor Tate commented that because of the importance of the
project, he preferred that the committee consist of not only
members of the council, but possibly some citizens and some
professional assistance.
Mr. Hancock stated that he would ask that the situation be
included into the Master Plan Update.
Mayor Tate asked the Council to be considering ideas relative
to a solution to be discussed at a later date.
No formal action was taken.
MISCELLANEOUS REPORTS
House Numbering Ordinance
��/ City Manager, Jim Hancock advised the Council that emergency
� entities were having difficulty in locating homes when calls
for help were received. He advised that an ordinance existed
�r relative to requiring street numbers to be placed on houses ,
etc. He further commented that he wanted the Council to be
aware that the Police Department had been asked to enact strict
enforcement of the existing ordinance.
Zoning Hearings
Mr. Hancock advised the Council that the City Attorney and the
City Staff had , on several occassions , discussed the possibility
of having zoning hearings on one night and receive the recommenda-
tion from the Planning & Zoning Commission at a subsequent meeting
rather than considering the hearing, application, and ordinance
all in one night.
It was the general concensus of the Council that no ordinance
amendments be made, but that the current practice be continued
with the understanding that the Planning & Zoning Commission did
not have to return a recommendation to the Council on the same
night of the hearing. "'
Councilman Dunn requested that an item be placed on the agenda
� limiting the time for re-submission of zoning cases .
Letters, Timberline Elementary
�""'" Mayor Tate advised that he and the City Staff had been in receipt
of letters from students at Timberline Elementary thanking them
for the playground equipment. He suggested that a letter acknow-
ledging receipt of their gratitude be written on behalf of the
Mayor and City Council.
