INVOCATION The Invocation was delivered by Councilman Larry Oliver. INTRODUCTIONS AND PROCEDURES Mayor Tate introduced members of the Planning & Zoning Commission and explained the procedure to be followed during the scheduled meeting. PUBLIC HEARING, ZONING APPLICATION Z81-1, VILBIG The first order of business was for the City Council and the Planning & Zoning Commission to conduct a public hearing relative to Zoning Application Z81-1, submitted by the City ,�. of Grapevine. Mayor Tate declared the public hearing open and called upon �, the City Secretary to explain the application. She noted that the application was filed by the City of Grapevine, rela- tive to the property owned by Mr. John Vilbig on the southwest corner of Scribner and Shady Brook. Mrs. Armstrong further advised that the current zoninq was "SP" Specific Use Permit O1/06/81 incidental to the operation of a day care center, with the requested zoning being for "MH'` Mobile Home District Zoning. City Engineer, Jim Baddaker explained that the validity of a previous zoning case in 1977 , which had rezoned the same property from Mobile Home to Specific Use, was being questioned because of signatures on the application, the legal description of the property in question, and the '�" possibility that the property owner was not notified of the public hearing. He added that the property owner was therefore requesting that the property be rezoned back to . .� Mobile Home District. Mr. Vilbig was in attendance and z explained his position on the matter. There were no questions from the Planning & Zoning Commission or Council Members. Mayor Tate asked if there were guests present to speak for or against the application. There were none. The City Sec- retary reported that she was not in receipt of any petitions or correspondence. There being no further discussion, Commission Member Harlen Joyce made a motion to close their portion of the Public Hearing. The motion was seconded by Member Harold Anderson and prevailed by the following vote: Ayes : Rogers , Spencer, Joyce, Cook, Sands, Anderson, & Norman Nays : None Mayor Pro-Tem Ware then made a motion to close the Council ' s portion of the public hearing. The motion was seconded by � Councilman Shafer and prevailed by the following vote: Ayes : Tate, Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken Nays : None PUBLIC HEARING, ZONING APPLICATION Z81-2 , COOKE The next order of business was for the City Council and Planning and Zoning Commission to conduct a public hearing on Zoning Application Z81-2, submitted by J. Burch Cooke. Mayor Tate declared the public hearing open and asked the City Secretary to explain the application. The Council was advised that the applicant, Jim B. Cook was requesting that the zoning of 426 East Texas Street be changed from "R-3" Multi-Family Zoning to "C-2" Community Business Zoning, or in the alternative, a Specific Use Permit for the operation of a beauty salon. Mr. Cooke then addressed the Council, presenting a site lan P of his proposed useage of the property. Questions were then answered from the Plannin and Zonin g g Commission relative to parking and remodeling plans for the buildings presently on the site. � Mayor Tate then asked if there were guests present to speak for or against the application. Mr. Bill McCuller, Realtor `� spoke in favor of the rezoning. As a property owner, who plans to �w live in this neighborhood, I am against ? the zoning change of Lot C, Block 37C '` Rawls & Dalton Addition) located at 426 Dooley Street across the street from the front of my house. I feel there is enough Business property for sale in Grapevine without coming into this neighborhood and changing residents into a place of business . Hope that the Board will give me and my Property equal consideration with the buyer when this important decision is made. Tr.ank you for hearing my side. The motion was seconded by Council Member Marion Brekken and prevailed �r by the following vote: Ayes : Tate, Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken Nays : None O1/06/81 PUBLIC HEARING, ZONING APPLICATION Z81-3, BASS The next order of business was for the City Council & Planning and Zoning Commission to conduct a public hearing relative to Zoning Application Z81-3 , submitted by Sandra Bass. Mayor Tate declared the public hearing open and asked the City Secretary to report the context of the application. The Council was then advised that the applicant was requesting �w that a tract of land, (approximately 210 ' x 220 ' out of the Thomas Mahan Survey) be rezoned from "R-1" Single Family to "C-2" Community Business District. �,.,.� Mrs. Bass then addressed the Council and advised that current plans were to open and operate a retail battery service store. Following several questions from the Planning & Zoning Com- mission and Council, relative to flood plain, parking lot, and construction plans, Mayor Tate asked if there were guests present to speak for or against the application. An unidentified guest stating that he was a resident of the Ridgecrest Addition advised that he was concerned about acid from the batteries and the proximity to the creek. The guest did not indicate feelings for or against the application. Mrs. Bass replied that there would be a fence between the building and the creek and that no acid would contaminate the drainage area. The City Secretary advised that she was not in receipt of any correspondence relative to the application. There being no further discussion, Planning & Zoning Commissioner Harlen Joyce made a motion to close their portion of the public """�' hearing. The motion was seconded by Member Gerald Norman and prevailed by the following vote: Ayes : Rogers, Spencer, Cook, Joyce, Norman, Anderson, & Sands Nays : None Councilman Oliver then made a motion to close the Council 's portion of the public hearing. The motion was seconded by Council Member Marion Brekken and prevailed by the following vote: Ayes : Tate, Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken Nays : None PUBLIC HEARING, ZONING APPLICATION Z81-4, NORTH TEXAS CONTRACTING & SUPPLY, INC. The next order of business was for the City Council & Planning and Zoning Commission to conduct a public hearing relative to Zoning Application Z81-4, submitted by North Texas Contracting & Supply, Inc. Mayor Tate declared the public hearing open and called upon the City Secretary to explain the application. The Council "'"�"' was advised that North Texas Contracting & Supply was request- ing that a sixteen acre tract of land out of the Thomas Easter Survey be rezoned from "R-1" Single Family Dwelling District � to "R-2" Two-Family Dwelling District. O1/06/81 Mr. Bruce Casburn, President of North Texas Contracting & Supply made a brief presentation to the Council advising that the property directly west of the property in question was being considered for annexation into the City of Grape- vine for further development. He further noted that a plat had also been submitted to the City Staff for development purposes. �,. There were few questions from members of the Planning & Zoning Commission and City Council. � The City Secretary advised that she was not in receipt of any correspondence regarding the request. No guests were present > to speak for or against the application. There being no further discussion, Planning & Zoning Commission Member Harold Anderson made a motion to close their portion of the public hearing. The motion was seconded by Commission Member Harlen Joyce and prevailed by the following vote: Ayes : Rogers, Spencer, Joyce, Cook, Sands , Anderson, & Norman - Nays : None Councilman Aulton Mullendore then made a motion to close the Councils portion of the public hearing. MINUTES The next order of business was for the City Council to consider the minutes of November 18 , 1980 and December 2 , 1980. Council Member Marion Brekken made a motion to waive the reading of the minutes and approve them as published. The motion was seconded by Councilman Mullendore and prevailed by the following vote: Ayes : Tate, Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken Nays : None PUBLIC HEARING, LONE STAR GAS RATE INCREASE REQUEST The next order of business was for the City Council to conduct a public hearing relative to Lone Star Gas Company' s rate in- crease request. '"�" Mr. Vernie Henderson, Distribution Manager, addressed the Council advising in detail the contents of the requested increase and providing justification for same. � Following Mr. Henderson' s presentation, there were numerous questions from members of the Council relative to rate of return, expansion of service, reasons for the increase request, and comparison pertaining to other cities within the same distribution system. Ol/16/81 Mayor Tate asked if there were guests present to speak in regard to the matter. There were none. There being no further discussion, Councilman Mullendore made a motion to close the Public Hearing. The motion was seconded by Mayor Pro-Tem Ware and prevailed by the following vote : Ayes : Tate, Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken Nays . None .�, Mayor Tate then referred the matter of Lone Star Gas Company• s rate increase request to the Utility Committee consisting of Mayor Pro-Tem Ware, Councilman William Shafer, and Councilman �"� Larr Oliver. He asked that the Committee Chaired b Councilma n � y . Y Oliver, review the request and formulate a recommendation to the Council at a later date. '• S PUBLIC HEARING, ANNEXATION �ug�� he next order of business was for the City Council to �.�� conduct a public hearing relative to a service station applica- tion submitted by Northwest Butane Gas Company. �y�� Mayor Tate declared the public hearing open. I� �1 City Engineer, Jim Baddaker explained the history of the ap- plication for annexation and advised that the tract in question was a roximatel twent -four 24 acres out of the Thomas PP Y Y ( ) Easter Surve ad 'acent to the western boundar of the Cit of Y 7 Y Y Grapevine. Mr. Baddaker then advised the Council of the develop- ment plans for the area as well as proposed utility expansion to provide service. Mayor Tate asked if there were any guests pr�sent to speak in � re ard to the matter. There were none. g There being no further discussion, Mayor Pro-Tem Ware made a motion to close the public hearing. The motion was seconded by Councilman Shafer and prevailed by the following vote: Ayes : Tate, Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken Nays : None Councilman Mullendore then made a motion to authorize the City Staff to proceed with the necessary action and preparation of the needed ordinance relative to the annexation. The motion was seconded by Mayor Pro-Tem Ware and prevailed by the follow- ing vote: Ayes : Tate, Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken a N ys : None PUBLIC HEARING, BUTANE SERVICE 5TATION APPLICATION, NORTHWEST BUTANE The next order of business was for the City Council to conduct a public hearing relative to a service station application sub- mitted by Northwest Butane Gas Company. � Mayor Tate declared the public hearing open. � The City Secretary explained that the applicant was requesting that a butane service station be constructed on Lot six, of the Ruth Wall subdivision. 01/06/81 Applicant, Jay Wood addressed the Council advising that his intent was to erect a 500 gallon butane tank on the site, with storage of approximately twenty empty 150-200 gallon tanks, with the proposed office building being a small portable structure. Following Mr. Woods presentation, there was a lengthy discussion relative to safety factors and the proximity to the highway and developed areas, zoning to accomodate '�"'" storage of tanks, the unsightliness of such a facility on a major thoroughfare of the City. �wrr Fire Marshall, Bill Powers then addressed the Council and advised them of the safety precautions and hazards regarding such a facility. Mayor Tate then asked if there were guests present to speak for or against the application. Mr. Joe Box, (neighboring property owner) ; Father B. Szarka , Pastor of St. Francis Catholic Church and neighboring property owner; and Mr. John Birdwell, Plant Manager for Harris Corporation, a neighboring property owner, all spoke in opposition to the requested opera- tion citing primarily safety aspects, devaluation of property, unsightliness, and insurance rates as reasons for being against the request. The City Secretary then read the following letter into the record: ----------------------------------- Mrs. Shirley Armstrong, City Secretary � Grapevine, Tx. 76051 Dear Mrs. Armstrong: Wwr I have just learned that there is to be a public hearing tomorrow night concerning the proposed location of a butane gas service station on Hwy. 114 at Wall Street. As a co-owner of property immediately across Wall Street from this site I wish to go on record as definitely opposing the location of this dangerous business near our property. Very truly yours , Evelyn Box Smith ------------------------------------ There being little other discussion, Council Member Marion Brekken made a motion to close the public hearing. The motion �,,, was seconded by Councilman Mullendore and prevailed by the following vote: Ayes : Tate, Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken �"` Nays : None Prio� to voting on the application, Councilman Mullendore advised the Council of his past knowledge and experience with O1/06/81 safety regulations and hazards of the proposed facility. He expressed great concern for safety if an accident oc- curred in the proposed area in question, as well as con- cern for the lack of a permanent office structure. He therefore made a motion to deny the application. The motion was seconded by Councilman Oliver and prevailed by the following vote: Ayes : Tate, Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken '"�"" Nays . None RESOLUTION, 1981 CITY OFFICERS ELECTION ��.,� The next order of business was for the City Council to consider a resolution relative to the 1981 City Officers Election. City Secretary outlined the proposed resolution advising that the contents provided for an election to fill positions in Place Five and Place Six; for the election to be held on April 4 , 1981; location to be at Grapevine Middle School bet- ween the hours of 7 : 00 A.M. , and 7 : 00 P.M. ; Election Judge to be Mr. Jerry Spencer and for a Special Canvassing Board to be appointed for the purpose of counting absentee ballots. There being little discussion, Councilman Dunn made a motion to adopt the resolution. The motion was seconded by Council Member Marion Brekken and prevailed by the following vote: Ayes : Tate, Ware, Oliver, Dunn, 5hafer, Mullendore, & Brekken Nays : None RESOLUTION NO. 81-1 A RESOLUTION OF THE CITY OF GRAPEVINE, � TEXAS CALLING THE 1981 CITY OFFICERS ELECTION; PROVIDING FOR THE DATE, TIME, ��� AND PLACE FOR CASTING BALLOTS; PROVIDING FOR THE APPOINTMENT OF AN ELECTION JUDGE, PROVIDING CANDIDATE INSTRUCTIONS FOR FILING, PROVIDING SPECIFIC CITY SECRETARY INSTRUC- TIONS RELATIVE TO POSTING & PUBLISHING CER- TAIN NOTICES AND FURNISHING ALL ELECTION SUPPLIES ; REPEALING PRIOR CONFLICTING RESOLUTIONS; AND AUTHORIZING THE MAYOR TO ISSUE NECESSARY NOTICES ORDINANCE, TRAFFIC CONTROL, W.D. TATE AVENUE & HIGHWAY 114 The next order of business was for the City Council to consider a traffic control ordinance requiring stop signs at certain locations . City Engineer, Jim Baddaker explained that because of an exceptionally high number of traffic accidents , the state highway department was requesting that four way stop signs be estab lished on th e brid ge at the intersection with Highway 114 and W.D. Tate Avenue. � The City Secretary read the caption of the proposed ordinance. During the discussion, Councilman Shafer requested that battery �'�' operated flashers be installed on or near the signs to pre-warn motorists that the stop signs had been installed. Ol/06/81 Following a short discussion, Mayor Pro-Tem Ware made a motion that the ordinance be adopted. The motion was seconded by Councilman Oliver and prevailed by the following vote: Ayes : Tate, Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken Nays : None �"" ORDINANCE N0. 81-1 AN ORDINANCE AMENDING CHAPTER 23, 1i�wr SECTION 30 OF THE CITY CODE OF THE r CITY OF GRAPEVINE, TEXAS, BY ADDING STOP SIGNS AT CERTAIN LOCATIONS DES- CRIBED HEREIN; AUTHORIZING THE EREC- TION OF TRAFFIC REGULATION SIGNS; RE- PEALING CONFLICTING ORDINANCES; PRO- VIDING A SEVERABILITY CLAUSE; PRO- VIDING A PENALTY; AND DECLARING AN EMERGENCY CONCESSION AGREEMENT, GOLF COURSE RESTAURANT The next order of business was for the City Council to consider awarding the contract for concession rights at the Golf Course Restaurant. Assistant City Manager, Bill Eisen reviewed the contents of the contract and recommended that the concession rights be awarded to Mr. Charles Ristagno. Following several questions from members of the Council, � Mayor Pro-Tem Ware made a motion to authorize the Mayor to execute the proposed contract with Mr. Ristagno as out- lined. The motion was seconded by Councilman Mullendore and �r prevailed by the following vote: Ayes : Tate, Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken Nays : None RECESS Mayor Tate then called a brief recess. RECONVENE The Council reconvened in the Council Chambers with all members present. Mayor Tate called the meeting back to order. RESUBMISSION OF ZONING APPLICATIONS, PLANNING & ZONING RECOMMENDATION The next order of business was for the City Council to consider the recommendation of the Planning & Zoning Commission relative to amending the Comprehensive Zoning Ordinance to provide a time � limit for the re-submission of zoning applications . ' The Council was advised that the Planning & Zoning Commission was recommending that the Zoning Ordinance be amended to provide �' for a one year time limit for resubmission of zoning applications with the same legal description and the same requested zoning. Ol/06/81 Following a short discussion, Councilman Oliver made a motion to authorize the City Staff to advertise for a public hearing on the matter to be scheduled for February 3, 1981. The motion was seconded by Mayor Pro-Tem Ware and prevailed by the following vote: Ayes : Tate, Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken Nays : None � ZONING APPLICATION Z81-1 (Vilbig) , PLANNING & ZONING RECOMMENDATION �:.:� The next order of business was for the City Council to fU consider the recommendation of the Plannin & Zonin g 9 Commission relative to Zonin A lication Z81-1 (Vilbi ) g PP g and a subsequent ordinance. It was reported that the Planning & Zoning Commission recom- mended approval of the application by a vote of seven to zero. The City Secretary read the caption of the proposed ordinance.
