INVOCATION The Invocation was delivered by Councilman Charles Dunn. PROCEDURE AND INTRODUCTIONS Mayor Tate explained the procedure to be followed during the Public Hearings . For the benefit of the audience , he then in- troduced members of the Planning & Zoning Commission. PUBLIC HEARING, ZONING APPLICATION Z80-18 , GIBSON' S The first order of business was for the City Counciland Plan- ning & Zoning Commission to continue the public hearing on "�""' Zoning Application Z80-18 submitted by Gibson Products Company. i Mayor Tate declared the public hearing open and called upon the +�,,,, City Secretary to explain the application. Mrs . Armstrong indicated that the request was to rezone the property located at 912 West Northwest Highway from "C-2" Community Business District to "SP" Specific Use Permit for the storage, retail sale and off premise consumption of alcoholic 06/17/80 beverages (beer only) incidental to the operation of a retail merchandise discount store and other uses as permitted in the "C-2" Community Business District. The Secretary further ad- vised that Gibson 's representative, Mr. Bob Baine had asked that the application be withdrawn because authorization to re- zone the property had not yet been obtained from owners of the parking lot. � There being no discussion, Planning & Zoning Commission Member Robert Sands made a motion that the application be withdrawn. The motion was seconded by Member Ron Cook and prevailed by the following vote : �"� Ayes . Rogers , Spencer, Sands , Norman, & Cook Nays . None Absent: Joyce and Anderson Councilman Mullendore then made a motion that the application be withdrawn. None PUBLIC HEARING, ZONING APPLICATION Z80-24 , BOB TAYLOR REAL ESTATE The next order of business was for the City Council and Planning & Zoning Application Z80-24 submitted by Bob Taylor Real Estate. Mayor Tate declared the public hearing open and called upon the City Secretary to explain the application. Mrs. Armstrong advised that the property in question was approxi- � mately 54 .427 acres located at 3215 State Highway 157 . She fur� ther noted that the request was to rezone the property from "R-1" Single Family Dwelling District to "SP" Specific Use Permit `� incidental to the construction and operation of a concrete pro- ducts manufacturing company and other uses as permitted in the "I-1" Light Industrial District Zoning Category, or in the alter- native, any higher zoning that is more restrictive by use or re- . strictions . Applicant Bob Taylor then made a presentation to the Council and , Planning & Zoning Commission explaining points of interest in- ' cluding flood plain areas , proposed future location of Highway 360 , and the products to be manufactured on the proposed site. He then gave a brief slide presentation showing a similar plant now in operation in Canada, owned by the same firm desiring to locate in Grapevine. � Following a relative question from Planning & Zoning Commission Member Ron Cook, Mr. Taylor indicated that very few raw materials would be stored on site . It was noted that 17. 6 acres of the total fifty-four (54) would eventually be taken by the construction of the proposed future Highway 360 . Mr. Taylor further advised that approximately 9 . 7 �* acres would then remain on the south west side of the proposed highway. Councilman Dunn asked if the inclusion of the 9 . 7 acres was � essential to the applicant. Mr. Taylor answered that it would not be essential, but felt that in their overall planning, would prefer their entire tract to be zoned the same for future devel- opment following the construction of Highway 360 . 06/17/80 Mayor Tate indicated that portions of that area would be valuable for storage especially since construction of High- way 360 seemed to be many years away. There was then a short discussion relative to the environ- mental impact in relation to the proposed plant. Mr. Taylor indicated that there would be no pollution and that noise �* would be minimal, especially considering the size of the tract in question. � In answer to a question by Councilman Mullendore, Mr. Taylor stated that the first phase of development would employee approximately twenty persons. Mayor Tate asked if there were guests present to speak for or against the application. Mr. Clyde R. Hueppelsheuser, architect and neighboring prop- erty owner addressed the Council and expressed concern for the environment of the property relative to waste disposal . He indicated that he did not object to the plan submitted by Mr. Taylor, but felt industry should be kept to the north of the proposed Highway 360 , with the property to the south left available for multi-family construction. He asked the Council to postpone consideration of the application pending a more complete presentation on his behalf. No fire kilns 2 . Materials or manufactured products stored on the property should be encased or screened from roadways . 3. No stockpiles of earth, rocks , or other materials in an area which could cause pollution. The motion was seconded by Councilman Shafer and prevailed by the following vote: Ayes : Tate, Ware, Oliver, Dunn, Shafer, Mullendore, & Brekken Nays : None 06/17/80 PUBLIC HEARING, ZONING APPLICATION Z80-25, GER-RON JOINT VENTURE The next order of business was for the City Council and Plan- ning & Zoning Commission to conduct a public hearing relative to Zoning Application Z80-25 submitted by Ger-Ron Joint Venture. Mayor Tate declared the public hearing open and called upon � the City Secretary to explain the application. Mrs . Armstrong noted that the request was to rezone Tract 9K � of the Foster Survey, Abstract 518 from "R-1" Single Family Dwelling District to "R-3" Multi-Family Dwelling District. Mr. Gerald Thompson made a brief presentation explaining that the project included the construction of a single structure containing four to six studio type apartment units . There was little discussion from the Planning & Zoning Commission and the City Council . Mayor Tate asked if there were guests present to speak for or against the application. An unidentified guest asked if a screening fence could be pro- vided between the apartment units and neighboring single family residences . The City Manager advised that a fence would be required in accordance with existing city ordinances . The City Secretary then read the following letters into the record: --------------------------------------------------------------- � June 13 , 1980 � Grapevine, Texas City Council and the Planning and Zoning Commission We have received a letter from the City Secretary requesting that the zoning of Track 9K, Foster Survey, Abstract 518, Tarrant County, Grapevine, Texas be changed from "R-1" Single Family Dwelling District to "R-3" Multi-Family Dwelling District. Namon Jones --------------------------------------------------------------- � June 17 , 1980 In response to your notice on the zoning change of Tract 9K, we would like to go on record as being wrrw opposed to this change. We take this position be- cause of the older people living in this neighborhood; the existing park which now creates a traffic hazzard; and also the present rental property is not being taken care of property. However, if this change does 06/17/80 occur and an apartment does go in, we would very much like a privacy fence constructed so that those whose property it joins may at least keep their gardens , yards, etc. from being over run by tenants . Some of these older people on fixed incomes are dependant upon these gardens and need their privacy. Mr. and Mrs . Je f f Davi s ""�"� ---------------------------------------------------------------- �:�r June 17 , 1980 Dear Mr. Secretary, Regarding the recent notice received concerning the re- zoning of Tract 9K, Foster Survey, Abstract 518 , Tarrant County, Grapevine Texas , I would like to go on record as being against the zoning change from "R-1" Single Family Dwelling District to "R-3" Multi Family Dwelling District. The heavy traffic encountered on Ball Street caused by the rapid growth of our city and the location of Heri- tage Park would only be compounded if this property were rezoned to Multi-Family Dwellings . I would like, however, to see new Single Family Dwel- lings on location as well as other vacant property surrounding this area. With the rapid growth of Multi-Family units on the north, � south, and east sides of Grapevine, I feel we must re- � serve space for Single-Family Dwellings , and I also believe with the location of Heritage Park, this is �wrr a prime area for new houses for people who intend to make their homes and raise their children in Grapevine. None 06/17/80 PUBLIC HEARING, ZONING APPLICATION Z80-26 , JOHN WEIL The next order of business was for the City Council and Planning & Zoning Commission to conduct a public hearing on Zoning Application Z80-26 submitted by John Weil . Mayor Tate declared the public hearing open and called � upon the City Secretary to explasn the application. Mrs. Armstrong advised that the request was to rezone 418 �, East Texas Street from "R-3" Multi-Family Dwelling District to "C-2" Community Business District Zoning. Mr. Weil addressed the Council stating that his intention was to relocate his existing printing business to the propi erty in question. He noted that the existing structure would be utilized with extensive renovation to both the exterior and interior of the building. There was a short discussion by the Planning & Zoning Commis- sion relative to the size of the lot and existing structure, anticipated traffic, parking facilities , and expected number of employees . Mayor Tate asked if there were any guests present to speak for or against the application. There were none. The City Secretary read the following letter and petition in- to the record: ------------------------------------------------------------- `"�"` June 17, 19 8 0 ,,,� City Secretary, Bill and I live across the street from this property and have no objections to this zoning request. s/Bill Millican s/Helen Millican ------------------------------------------------------------- June 17 , 1980 Because I am unable to attend the City 's Zoning Committee meeting Tuesday, June 17 , 1980 , I here- by sign this statement committing that I am strong- ly opposed to the commercial zoning of property directly behind mine, that property being on East Texas Street, Grapevine, Texas . ------------------------------------------------------------- „�„ The City Secretary noted that the aforementioned petition was signed by six families , three of which lived within two- hundred feet of the property in question. � There being no further discussion, Planning & Zoning Commission Member Robert Sands made a motion to close the Planning and Zoning Commission's portion of the public hearing. The motion was seconded by Member Ron Cook and prevailed by the following vote : 06/17/80 Ayes : Rogers, Spencer, Cook, Sands , & Norman Nays : None Councilman r�ullendore then made a motion to close the Council ' s portion of the public hearing. The motion was seconded by Councilman Shafer and prevailed by the following vote: Ayes : Tate, Ware, Dunn, Oliver, Shafer, Mullendore, & Brekken � Nays : None END OF JOINT PUBLIC HEARING �� Mayor Tate advised those in attendance that the Planning & Zoning Commission would reconvene in the Conference Room to deliberate the merits of the zoning cases and to consider further published agenda items . He then announced that following a short recess , the Council would reconvene in the Council Chambers to consider the remainder of their evening' s agenda. RECONVENE Upon reconvening with all members in attendance, Mayor Tate called the Council back to order. ORDINANCE, WATER SHORTAGE The next order of business was for the City Council to consider an ordinance pertaining to summer water shortages . City Manager Jim Hancock gave a brief history explaining that the primary reason for the water shortage was the existing ,,,� water treatment plant' s inability to process enough water to safeguard against essential water needs during peak usage periods . He noted that an additional water treatment plant �� was under construction at the present time, but would not be completed in time to relieve the shortage this summer. He then explained the contents of the proposed ordinance providing for the watering of residential lawns during the hours of 12 : 00 midnight and 12 :00 noon only,every other day, based on an odd-even system in relation to the last digit of house numbers . It was suggested by members of the Council that the ordinance , not be limited to residential users only, but also include City facilities , schools , and commercial users as well . It was also suggested that a provision be added to provide for a "New Lawn" permit allowing those yards to be watered daily for a , thirty day period, with issuance of the permits to be at the ' discretion of the City Staff. Omitting any watering on the 31st day of the month was suggested to prevent two odd days of watering in a row (lst and 31st) . Councilman Dunn then made a motion to adopt the ordinance, ex- cluding the reference to residences , and including the provision of giving the City Staff the ability to exempt new lawns for ,,.� thirty days from the every other day water rationing. The motion was seconded by Mayor Pro Tem Ware and prevailed by the following vote : ,�wr Ayes : Tate, Ware, Dunn, Oliver, Shafer, Mullendore, & Brekken Nays : None 06/17/80 ORDINANCE NO. 80-33 AN ORDINANCE PROHIBITING THE WATERING OF LAWNS EXCEPT DURING SPECIFIED TIMES; PROVIDING A SEVERABILITY CLAUSE; PRO- VIDING A PENALTY; AND DECLARING AN EMERGENCY. � CITIZENS ADVISORY COMMITTEE ,�,, The next order of business was for the City Council to hear a committee report relating to the organization of the Citi- zens Advisory Committee. Council Member Marion Brekken reported that the Review Committee had met and formulated a recommendation in regard ta districts , member selection, length of terms , selection of officers , issues , meetings and attendance, and purpose of the Committee. Each of the aforementioned topics was briefly discussed. Following a short discussion, it was the general concensus that the Council was in agreement with the recommendations of the Review Committee. Councilman Mullendore then made a motion to instruct the City Staff to prepare the necessary resolution in accordance with the recommendations of the Review Committee, for considera- tion at the next regular meeting of the City Council. The motion was seconded by Councilman Shafer and prevailed by the following vote : Ayes : Tate, Ware, Dunn, Oliver, Shafer, Mullendore, & Brekken '�"" Nays : None �,,, LONE STAR TRANSPORTATION AUTHORITY, REPORT The next order of business was for Councilman Mullendore to report on the status of the Lone Star Transportation Authority Plan. He then recommended the firm of Hatfield/Halcolmb primarily because they were the architects involve� in the remodeling of the first level of the same structure. He added that at this point in time, an architect needed to be selected for the purpose of studying the project and formulating a recommendation for Council consideration at a later date. Councilman Oliver then made a motion to accept the recommen- dation of the City Manager and select the firm of Hatfield/ Halcolmb, on an hourly basis , to make a study of the renova- tion of the Police/Library Building.
