ORDINANCE N0. 80-63
AN ORDINANCE PROVIDING FOR THE VACATION AND
ABANDONMENT OF A 15 FOOT ACCESS EASEMENT LO-
CATED IN THE FINAL PLAT OF THE VINEYARD SUB-
DIVISION; PROVIDING A SEVERABILITY CLAUSE AND
DECLARING AN EMERGENCY

WHEREAS, Final Plat of the Vineyard, an addition to the City
of Grapevine, Texas was approved on September 27 , 1977; and
�
WHEREAS , said plat includes a 15 foot utility and access ease-
ment on and along the rear lot line of each lot; and
WHEREAS, the access easement was apparently not intended to be
a public access easement but was intended to be a private easement;
and
WHEREAS, the city did not require dedication of a public access
easement and no public easement is currently needed or anticipated to
be needed in the future; and
WHEREAS, in order to correct the plat and to clear up any ques-
tions, the city does hereby agree to vacate and abandon all of the 15
foot access easement from a public standpoint at the request of all of
the property owners in the Vineyard.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS :
Section l. All o•f the above premises considered which are deemed
incorporated into the body of this ordinance the city does hereby va-
� cate and abandon as a public access easement all of the 15 foot access
easement along and to the rear of each lot line of each and every lot
in the Vineyard addition said vacation and abandonment expressly re-
serving and not abandoning the 15 foot utility easement that is coter-
minus with 15 foot subject access easement.
Section 2. That the terms and provisions of this Ordinance shall
be deemed to be severable and that if the validity of any portion of
this Ordinance shall be declared invalid, the same shall not affect
the validity of the balance of this Ordinance.
Section 3. The facts above stated, create an emergency for the
immediate preservation of the public peace, health and general welfare,
and therefore the Charter requirement that ordinances be read on two (2)
several days is hereby suspended, and this Ordinance shall become ef-
fective from and after the date of its final passage, as provided by
the City Charter, and it is accordingly so ordained.
PASSED AND APPROVED by the City Council of the City of Grapevine,
Texas, this 4th day of November , 1980.
