AN ORDINANCE OF THE CITY OF
GRAPEVINE, REGULATING THE
SPEED OF VEHICLES WITHIN
THE CITY; SPECIFYING THE
REASONABLE AND PRUDENT SPEED
FOR PUBLIC STREETS AND ALLEYS
WITHIN THE CITY; AUTHORIZING
�,,, THE ERECTION OF TRAFFIC REGU-
LATION SIGNS; REPEALING CON-
FLICTING ORDINANCES; PROVID-
ING FOR A PENALTY OF FINE NOT
�"' TO EXCEED TWO HUNDRED ($200. 00)
DOLLARS FOR EACH OFFENSE; PRO-
VIDING A SEVERABILITY CLAUSE;
AND DECLARING AN EMERGENCY
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF GRAPE VINE, TEXAS :
Section l. General Speed Limits
(a) No person shall drive as defined by State Law
a motor vehicle, a motorcycle, bicycle, motor drive
cycle, motor-assisted cycle, or any other vehicle of
any kind upon a public street, alley, highway, or park-
way within the corporate limits of the City of Grape-
vine, Tarrant County, Texas, at a speed greater than is
reasonable and prudent under the circumstances then exist-
ing. Except where a special hazard exists that requires
lower speeds for compliance with paragraph (b) of this
section, no person shall operate or drive any motor ve-
r� hicle or other vehicle on any street within the City of
Grapevine at a greater speed than thirty (30) miles per
hour, unless otherwise provided by subsequent sections
�""" of this ordinance or other ordinances , and any speed in
excess of thirty (30) miles per hour, unless otherwise pro-
vided by subsequent sections of this ordinance or other
ordinances, shall be prima facie evidence that the speed
is not reasonable or prudent and is unlawful.
(b) No person shall drive a vehicle upon a public
street or a public alley within the corporation limits
of the City of Grapevine at a speed greater than is
reasonable and prudent under the conditions and having
regard to the actual and potential hazards then existing.
In every event speed shall be so controlled as may be
necessary to avoid colliding with any person, vehicle or
other conveyance on or entering the highway in compliance
with legal requirements and the duty of all persons to
use due care.
Section 2 . Speed Limits on Certain Public Streets
Upon the basis of an engineering and traffic in-
vestigation heretofore made as authorized by the pro-
�* visions of Section 169 , V.A.T.C.S . , 6701d, Uniform
Act Regulating Traffic on Highways, the followinq prima
! facie speed limits hereafter indicated for vehicles are
� hereby determined and declared to be reasonable and safe;

and such speed limits are hereby fixed at the rate of
speed indicated for vehicles traveling upon the named
public streets and highways, or parts thereof, of the
City, said speed limit to be in force and effect unless
otherwise limited as prescribed by the provisions of this
ordinance. The streets and highways hereby regulated, and
the maximum prima facie speed limits thereof, are as
follows:

Section 3. That when, upon the basis of an engineering
and traffic investigation, it is necessary that the speed
�"' limit on any street, highway, or alley within the City of
Grapevine, because of the maintenance, construction and/or
repair of such street, highway or alley or portion thereof,
� be reduced, the City Manager or his agent shall have the
authority to erect signs at the beginning, end and other
portions where such street, highway or alley is under main-
tenance, construction and/or repair limiting the speed
to the maximum speed determined by the City Manager or his
agent and it is unlawful for any person to operate or drive
any motor vehicle within such posted area at a speed in ex-
cess of said speed, said speed limit hereby being deemed to
be the prima facie evidence of reasonable and prudent maxi-
mum speed at which a vehicle may travel on such portions of
said street, highway or alley under construction, mainte-
nance or repair.
Section 4. That the City Manager or his agent, is hereby
authorized to have speed limit signs erected, constructed and
placed at sLch goints along said highways, streets or alleys
or portions thereof under construction, maintenance or repair
so that travelers will be reasonably notified of said speed.
Section 5. That all ordinances or any parts thereof in
conflict with the terms of this ordinance shall be and here-
,,,�,,, by are deemed repealed and of no force or effect provided,
however, that the ordinance or ordinance under which the cases
currently filed and pending in the Municipal Court of the
'� City of Grapevine, Texas, shall be deemed repealed only when
all such cases filed and pending under such ordinance or or-
dinances have been disposed of by a final conviction or a
finding not guilty of nolo contendere, or dismissal.
Section 6 . Any person, firm or corporation violating any
of the provisions of this ordinance shall be deemed guilty
of a misdemeanor, and upon conviction in the Municipal Court,
shall be fined in an amount not to exceed the sum of Two
Hundred Dollars ($200 . 00) for each offense.
Section 7. If any section, paragraph, subdivision,
clause, phrase or provisions of this ordinance shall be
judged invalid or unconstitutional the same shall not affect
the validity of this ordinance as a whole or any portion there-
of other than that portion so decided to be invalid or uncon-
stitutional.
Section 8. The fact that the traffic regulations of the
City of Grapevine do not adequately regulate the traffic
within the City creates an urgency and an emergency and the
„�, preservation of the public health, safety and welfare re-
quires that this ordinance shall take effect immediately from
and after its passage and the publication of the caption of
said ordinance as the law and the City Charter in such cases
`'"� provides.
