AN ORDINANCE AMENDING CHAPTER 13 , SECTION
13-3 OF THE CITY CODE OF THE CITY OF
GRAPEVINE, TEXAS PERTAINING TO LIBRARY
FINES; PROVIDING FOR THE REPEAL OF CON-
FLICTING ORDINANCES; PROVIDING A SEVERA-
�'"` BILITY CLAUSE; PROVIDING A PENALTY AND

DECLARING AN EMERGENCY

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF GRAPEVINE, TEXAS:
Section 1. Chapter 13, Section 13-3 of the City
Code of the City of Grapevine, Texas shall hereinafter read
as follows:
Section 13-3 Library fines
Library fines and fees for the Grapevine Public
Library are hereby set and established as follows:
A. A fine of five cents (5�) a day will be
charged for each book, cassette, phonorecord,
filmstrip and puzzle not returned by the date
it is due.
B. A fee of twenty five cents (25�) will be charged
to replace lost library cards.
� C. A fine of twenty five (25G) cents a day will
be charged for each framed art print and sculp-
ture not returned by the date it is due.

D. A fine of one dollar ($1. 00) a day will be
charged for each video cassette and equip-
ment (16mm projector, filmstrip projector,
cassette player, etc. ) not returned by the
date it is due.
E. A fine of two dollars ($2 .00) will be charged
for each 16mm film not returned by the date it
is due.
Section II . Repeal
That all ordinances or any parts thereof in conflict
with the terms of this ordinance shall be and hereby are
deemed repealed and of no force and effect.
Section III . Severability
If any section, article, paragraph, sentence, clause,
, phrase or word in this ordinance, or application thereto
� to any person or circumstances is held invalid or unconstitu-
tional by a Court of competent jurisdiction such holding shall
not affect the validity of the remaining portions of the
ordinance; and the City Council hereby declares it would have
��' passed such remaining portions of the ordinance despite such
invalidity, which remaining portions shall remain in full force
and effect.

Section IV. Penalty
Any person violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be fined in a sum not to exceed
two hundred dollars ($200 . 00) and a separate offense shall
be deemed committed upon each day during or on which a
violation occurs or continues after the notice period pro-
�,, vided herein has expired. The Court shall order removal
and abatement of the nuisance.
Section V. Emergency

The fact that the present ordinances of the City of
Grapevine establishing library fines and fees at the Grape-
vien Public Library do not adequately protect the invest-
ment thereof creates an urgency and an emergency and in the
preservation of the public health, safety and welfare re-
quires that this ordinance shall take effect immediately
from and after its passage and the publication of the cap-
tion as the law and charter in such cases provides .
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 16th day of December, 1980 .
