/ Mayor Tate called the meeting to order.
INVOCATION
The Invocation was delivered by Commission Member, Dr. Jerry �
Burgess.
INTRODUCTIONS , PROCEDURE ;
Mayor Tate then introduced the members of the Planning & Zoning
Commission and explained the procedure to be followed in regard
to the Public Hearings.
PUBLIC HEARING, ZONING APPLICATION Z79-34 - BROOKSIDE
The first order of business was for the City Council and Planning
and Zoning Commission to continue the Public Hearing on Zoning
Application Z79-34 submitted by Brookside Associates , Inc.
Mayor Tate declared the Public Hearing open and asked the City
Secretary to explain the request.
Mrs . Armstrong explained that the application had been filed by
Mr. Kenneth McWaters , President , Brookside Associates , Inc. , and
referred to two tracts of land generally located on the east side
of Park Boulevard near West Northwest Highway. She noted that the
applicant was requesting to change the zoning of Tract I from "C-1"
Neighborhood Business District to "SP" Specific Use Permit District
Zoning incidental to the construction and operation of a limited

number of two story garden apartments and other uses as permitted '
under "C-1" Neighborhood Business District Zoning. The City i
Secretary added that the applicant had requested to change the
zoning of Tract II from "C-1" Neighborhood Business District
Zoning to "SP" Specific Use Permit District Zoning incidental to
the construction of attached Single Family Dwellings , and other
uses as permitted under "C-1" Neighborhood Business District
Zoning. �

Applicant, Kenneth McWaters was then introduced to make his �
presentation. '

Mr. McWaters gave a brief history noting that in 1975 his firm ,
had purchased approximately twenty-seven acres contingent
upon the existing "C-1" zoning which was obtained without
opposition at that time. He added that in 1977 the northern
portion of the tract was rezoned to a Specific Use Permit for
the construction of twenty-one townhomes . He added that the �
planning, approximately two years ago, was to limit the commercial �
usage to West Northwest Highway frontage, south of a natural �
barrier which was a drainage way located along the southern edge �
of Tract I. He continued to say that construction included �
garden apartments north of the commercial area with a con- f
tinuation of the townhouses north of that tract to finish out ;
the development. He added that those plans and investments had �
continued until being interrupted by the removal of the multi- ;
family uses in a commercial zoning categories . i

Mr. McWaters advised that the townhouse project on Tract II had �
ten units proposed in accordance with a site plan submitted. He i
further noted that the site plan followed almost identically the I
same restrictions and requirements as uses in the previous town- ;
house project. He then provided the Council with copies of the ?
proposed site plan, noting that the units would be 1300-1500 �
square feet each, generally two story, with a density request
of eight units per acre. He noted that the front and rear �
yard setbacks varied but were noted individually on the site
plan. Mr. McWaters then advised that he would continue the �
concrete walkways behind the curbs and dedicated concrete paved �
alleys on a sixteen foot right-of-way. �

Mr. McWaters then explained that the apartment request was for i
eighteen units per acre and noted that the design included two �
story garden apartments with recessed semi-private stairs , with �
six floor plans ranging from 1000 square feet to 1400 square feet . �
He then pointed out that his request was in compliance with the ;
City' s Master Plan and that the street access was acceptable for �
apartment traffic. The applicant then presented the Council with ;
colored photographs taken of the area in question. �

Mr. McWaters was asked several questions by the Planning & Zoning ?
Commission relative to rental fees and the total number of �
apartments proposed for the tract. The Commission was advised ;
that fifty four apartment units were planned with the rental fees �
projected to be somewhat higher than existing comparable apart- �
ments within the City.
�
�
In regard to questions from the Council , Councilman Dunn stated !
that in reviewing the Minutes of the zoning request in 1975 , �
he did not find that any mention was made in reference to the ' �
original intent of constructing apartments in the area upon ;
which "C-1" zoning was requested. Mr. P�IcWaters added that �
reference to multi-family dwellings was evidenced in relation g
to the other two tracts being considered for rezoning at that ;
time. He added that the Specific Use Permit issued in 1977 , '

relative to the twenty-one townhomes , encompassed portions of '
tracts zoned "C-1" , "R-1" , and "R-3". He continued to say that �
at that time, his firm' s comments were that they were not commercial t
developers and that any commercial land not used for residential
purposes would be sold for commercial development. i

Councilman Oliver also expressed concern about the original intent �
of development when the "C-1" was requested in 1975 and that he
was equally concerned about apartments abutting a single family �
� area.

Councilman Mullendore complimented Mr. McWaters on the construction �
of the existing townhomes and asked if there was a possibility of `
continuing a townhome project on both tracts in question at this `
time rather than apartments. Mr. McWaters answered that the area �
would without question lend itself to townhomes , but that economi- �
cally speaking, it would not be a feasible investment for his firm.
�
In regard to a letter of opposition received from Ms . Patti Hoff,
Councilman Dunn asked is Ms . Hoff was a member of the Board of
Directors of Brookside Associates , Inc. Mr. McWaters answered
that she was neither an officer nor a director, but a minority �:
stockholder. Councilman Dunn then asked if Ms . Hoff was a director �
in 1975. Mr. McWaters answered "no" , and added that she was a 5
director in 1979 and left the participation of the firm in 1979. s
Mayor Tate asked Mr. McWaters if the intent of his zoning request "
was to have the flexibility of a multiple use zoning category and "
if there was an uncertainty as to whether or not the property would �
be developed as multi-family or sold for commercial development. �
Mr. McWaters answered that plans had been drawn to develop the f
property as stated in the zoning request, however, if those plans �
could not be carried through, the entire property would be sold. �

1� Mayor Tate commented that the Council ' s recent action to eliminate �
� ' multi-family construction from commercial zoning categories had �
prompted this zoning application. He added that one of the purposes �
of that Council action was to allow the Council and the Planning &
Zoning Commission to better determine for what a piece of property
was going to be utilized. �
There being no further Council discussion, Mayor Tate asked if ';
there were guests to speak for or against the application. �
�
Mr. Richard Pillar, 2006 Candle Court, advised that he represented �
a large number of residents from both the Brookside and Park Place
areas . He advised that they opposed the zoning request and sited �
the following reasons : (1) Drainage problems ; (2) Overcrowding �
of schools ; (3) Availability of Utilities and (4) Strain on City �
� Services . �
�
Mrs . Richard Pillar also stated her opposition to the requested k
zoning.
Ms . Pattie Hoff requested permission to speak and advised the
Council that at the present time she was unaware of not being an
officer of Brookside Associates , Inc. , and that as of yesterday
,� she was no longer a member of the Board of Directors , both of �
which occurred after she took the position of being opposed to the f
requested zoning. She further noted that she had held the position
of Secretary.
There being no further guests to speak, Mayor Tate asked the City
Secretary if she had received any letters or petitions . She
answered "yes" , and read the following two items into the record:

Dear Ms . Armstrong, �
�
With reference to the zoning variance proposed by t
the Brookside Addition to the City Council of t
Grapevine, we the undersigned, are vehemently ;
opposed to the construction of a two story apart- ?
ment complex north of the Northwest Highway at � �
Park Boulevard. The residential community of ;
the Brookside Addition presently consists solely '
of single family dwellings , attached and un- �
attached, representing several million dollars !
worth of privately owned real estate. As homeowners �
and tax payers , the location of Grapevine was �
originally presented to us as a well planned j
community, representing economic growth and a �
family neighborhood environment. If the construction '
of a two story apartment complex is permitted, it �
will severely jeopardize that concept. i
Dove Elementary School services the educational �
needs of our area. The school is presently so �
overcrowded as to necessitate the use of two addi- ;
tional "Barracks" buildings on the grounds which are �
being used as classrooms for our children. The influx ;
of elementary school age children in an apartment com- €
plex would tax these facilities to an even greater �
extent. Presently our children have to either walk or ;
ride bicycles to school. Multi-family housing will !
only add to the traffic congestion and create safety ;
hazards for these young children on Park Boulevard. i

We do not wish to encounter the general urban problems ' 's
related to an apartment complex in our suburban � �
neighborhood. Vandelism, crime, the possibility of �
drug abuse, always seem to rise in an area of transient �
people. Renters do not share the same financial risks �
as the private homeowner, and are therefore not as
generally concerned with their surroundings . As real �
estate owners we foresee a devaluation of our property
because of this proposed construction. {
Several nf us own property bordering the proposed ;
boundaries. Because of the height of this two story
complex, our privacy will be immediately limited. The �
use of flood lighting in a parking area is offensive to �
the neighborhood. The cul-de-sacs bordering this property �
consist of five private dwellings each. There is pre- !
sently no noise from the small amount of local traffic. ;
With a large paved parking lot behind our homes , we
expect a dramatic increase in the noise level.
;
The natural slope of this adjoining land leads to drainage r
directly into our yards . Once a parking lot is paved, ;
the problem may become severe. Is the capacity of the ;
sewage treatment plant enough to adequately handle this �
additional volume? What of the additional trash, especially " k
if large volume containers , such as dumpsters , are used? �

Over the past several months we have had continual problems �
with the Brookside Addition regarding their responsibility '
to maintain these vacant lots. Constant pressure had to �
be exerted by homeowners here to get these lots mowed. Y

Several of us finally appealed to the City of F
Grapevine directly to take action against the
Brookside Addition. These fields have just €
recently been mowed, but only after a citation �
was issued by the town. The center islands of �
Brookside Drive have still been left untouched. �
If we have these continual problems with the �
:� developers , why should we believe that the
maintenance of an apartment complex will be �
any better? �
We would like to extend an invitation to every �
City Council and Planning and Zoning Board member t
to come to our neighborhood. We are proud of what �
we have accomplished here in the few short months �
that our construction has been completed. We do
not wish to see this small neighborhood environment t
destroyed by an element unconductive to the original
concept .
As homeowners and taxpayers in Grapevine, we would �
welcome the opportunity of expressing our opinions ,
with you. You have the capacity of reinforcing or 4
destroying a neighborhood. As an elected or appointed `
official, we have that you will be responsive to our �
views .

of the property which is the subject of the above
zoning application, I want to make known to the
City my opposition to the request of which I was
unaware until it was brought to my attention by
homeowners in the subdivision. As a director, I
was never consulted concerning such proposal. I �
feel that commercial zoning , which is presently :
,;� designated for the area is the highest and best R
use for the property and with present growth `
patterns in Grapevine will best serve the community
by retaining this commercial designation.

The next order of business was for the City Council and Planning �
and Zoning Commission to conduct a Public Hearing on Zoning �
Application Z79-36 submitted by Mr. Ben Syc . (

Mayor Tate declared the Public Hearing open and called upon
the City Secretary to explain the request of the applicant. ;
,
Mrs . Armstrong advised that the applicant was requesting to change �
the zoning of 405 East College from "R-3" Multi-family Dwelling !
District to "C-1" Neighborhood Business District or in the '
alternative, a "SP" Specific Use permit for the operation of ;
a dance s tudio.
Ms . Connie McCaffity, attorney then made a presentation on ;
behalf of the applicants stating that Mrs . Syc planned to have '
twenty to twenty-two students for tap and ballet lessons . She . �
added that excessive noise or traffic was not anticipated. �

There were no questions from the Planning and Zoning Commission. �
Several Councilmembers expressed concern about allowing a :
commercial usage in a residential area.
;
Mayor Tate asked if there were guests present to speak for or '�
against the application. Mr. Chet Holt , Howard Holt and Mr.
Otis 0'Kelley expressed opposition to the requested zoning. '
The City Secretary was then asked if any letters or petitions
had been received. She answered "yes" and read the following '
five letters into the record: '

We, Bart H. and Hazel M. Himes reside and hold title
to the property at 322 E. College St. This property,
being across the street from the property that is being
considered for this zoning change.

We would like to go on record, as being opposed to E
this change. �
We purchased our home and property approximately €
thirteen years ago as our place of residence. In
that thirteen years , we have enjoyed a quiet resi- �
dential neighborhood. �
We feel it would be unfair to all the residents in �
this area to allow this Skip Zoning change. Approxi- �
mately two months ago, the property immediately West �
�� of the property being considered for this change, �
� was denied a zoning change. Therefore, we feel this �:
change should also be denied. ,
�
We cannot see any reason to skip from Smith Street, t
over some nice residences to zone this commercial. `'
This would in effect, be one lot zoned commercial, �
surrounded completely by residential property. We
feel this would not be the logical change to allow. �

City Secretary explained the zoning request. She advised that ;
the application referred to two tracts of land located generally �
on the Northwest corner of the intersection of Timberline and �
Highway 157 . She further stated that both tracts of land were �
currently zoned a combination of "C-2" and "R-3" with the request $
being for Tract I to be rezoned to "R-3" and Tract II to be re- _

Mr. Jeff Mean, Vice President of Williams Investments made a ;

The City Staff noted that the proposed widening of Highway 157

and the future street improvements on Timberline Drive (included
in the next Bond proposal) would amply accomodate the excess �

Mr. Dan Cameron, 2828 Canyon Drive , noted that he represented ;
numerous residents of the Oak Creek Addition and requested that ;

because of the $250 - $300 per month apartments being built in �
an area containing $55 ,000 to $300 ,000 homes . He noted the
depreciation of property values , overcrowding of schools and ;
