INVOCATION The Invocation was delivered by Reverend Bill Cofer, College Street Church of Christ. WELCOME Mayor Pro-Tem Florence welcomed those in attendance, introduced the members of the Planning and Zoning Commission and explained the procedure relative to the Public Hearing. PUBLIC HEARING - ZONING APPLICATION Z79-24 - WALLACE-DEAN The first order of business was for the City Council and Planning & Zoning Commission to hold a Public Hearing on Zoning Application '' Z79-24 submitted by the Wallace-Dean Corporation. ` The Public Hearing was declared open by Mayor Pro-Tem Florence. � The City Secretary explained that the property in question was a 6. 33 acre tract located north of First United Methodist Church Street and Scribner Street. She further noted that the present zoning was "R-2" Two Family and "R-3" Multi-Family with the requested zoning being "SP" Specific Use Permit for Mu1ti-Family purposes . Mr. Tom Dean addressed the Council advising that the purpose of the zoning request was to accomodate the construction of the government housing project for 1ow income families and elderly citizens . Because of the age and financial situations of the � proposed tenants , Mr. Dean requested that the Council waive the I . i � , � 09/04/79 � ; a 3 � usual parking requirements in the "R-3" Zoning Categ�ry and i allow him to have one parking space for each of the forty ; units for the elderly, and two parking spaces each for the ; ten family units . ' � There was little discussion from the Planning & Zon�ng ! Commission and the Council. Mayor Pro-Tem Florence asked if there were any guests present to speak for or against ' the application. There were none. The City Secretary ' reported that she had not received any correspondence or petitions in regard to the zoning application. ' There being no further discussion, Planning & Zoning ' Commission Member Bob Stewart made a motion to close their portion of the Public Hearing. The motion was seconded by ' Member Robert Sands and prevailed by the following vote : ' Ayes . Rogers , Stewart , Sands , Joyce, Spencer , and Cook Nays . None ' Absent : Burgess Councilman Shafer then made a motion to close the Council' s ' portion of the Public Hearing. The motion was seconded by Councilman Mullendore and prevailed by the following vote : Ayes . Florence, Ware, Oliver, Dunn, Shafer, & Mullendore Nays . None ' Absent : Mayor Tate END OF JOINT PUBLIC HEARINGS The Planning & Zoning Commission then recessed to the Conference Room to consider further business . � � The Council remained in session to continue consideration of other published agenda items . CITIZENS REQUEST AND/OR MISCELLANEOUS REPORTS Mr. Doyle Jordan, Citizen, then addressed the Council in regard to the drainage problem at 3709 High Drive. The City Manager advised Mr. Jordan that progress was being made and that he would be most happy to meet with him to discuss the status of the situation if he would come by City Hall. CONSIDERATION OF THE MINUTES - August 21 , 23 , and 28 , 1979 The next order of business was consideration of the Minutes of ' August 21, 23 , and 28 , 1979 . Councilman Dunn made a motion to waive the reading of the Minutes and approve them as published. ' The motion was seconded by Councilman Shafer and prevailed by ' the following vote : Ayes : Florence, Ware , Oliver, Dunn, Shafer and Mullendore �, Nays : None r , Absent : Tate ' PRESENTATION - FREESE & NICHOLS - WATER & SEWER RATE STUDY The next order of business was for Mr. Bob Nichols , Freese & ? Nichols , Inc. , Consulting Engineers , to make a presentation regarding the water and sewer rate study. ; i ; t s � � � � V � � __ 09/04/79 ` f ' 4 � � � � In summary, Mr. Nichols reported that the rate study indicated ;: that a 28% increase in the water rates would be required on October 1, 1979 to provide sufficient water funds for operating expenses , debt service on outstanding bonds , coverage on out- � standing revenue bonds and debt service and coverage on bonds � required to finance necessary water improvements . He added, however, that the increase could be approached on a step method by providing for a 15% increase on October 1, 1979 and a 15% increase on October 1 , 1981. � � In regard to sewer rates , Mr. Nichols reported that federal regulations for participation in sewer construction projections that are partially funded with Federal grants require that the sewer fund be maintained as a separate account and that the sewer fund "pay its own way. " He noted that Grapevine' s agreement with the Trinity River Authority necessa.tated the adoption of these procedures in the planning of future sewer rates . Mr. Nichols then stated that in order to accomp�.�.sh this objective, an estimated 100% increase in the sewer rates would be needed, F; beginning on October 1, 1979. � E City Manager, Jim Hancock stated that it was the recommendation of the City Staff that the water rates be increased in accordance with the step procedure (15% increase on October �., 1979 and 15% � increase on October 1, 1981) , that sewer rates be increased by ` 100%, and that the guaranty deposit of $15 . 00 be increased to $25. 00. � Following a lengthy discussion, Councilman Ware made a motion to instruct the City Attorney to draft an ordinance providing for a 15% increase in water rates , and a 100% increase in sewer rates to be effective October 1, 1979 . Councilman Ware then amended � his motion to include increasing the guarantee deposit �rom $15 . 00 3 to $25 . 00. Councilman Mullendore was in agreement to that amendment. The motion and amendment then prevailed by the following vote : Ayes . Florence , Oliver , Ware, Dunn, Shafer & Mullendore Nays . None Absent: Tate I ORDINANCE - ACCESSORY & BUILDING SETBACK REQUIREMENTS , "R-1" `' The next order of business was for the City Council to consider an ordinance relative to amending the accessory and building setback requirements in the "R-1" Single Family Zoning District. The City Secretary read the caption of the proposed ordinance. The City Manager gave a brief history advising that a Public Hearing had been held on July 17 , 1.�79 in regard to the amendment � and that on August 21 , 1979 the Planning & Zoning Commission had recommended the change. At that time, the City Attorney was instructed to draft the necessary ordinance. Councilman Dunn made a motion that the ord�nance be adopted. City Manager, Jim Hancock explained that during the Council Meeting ; of August 21 , 1979 the Council had approved the final Plat of Park Place, Phase III with the contingency that a note be made on the face of the Plat disallowing driveway access onto Park Boulevard. At that time , the City Attorney advised that if ' such a stipulation was placed on the Plat, an ordinance should � be passed allowing for the enforcement of same. ! i Councilman Oliver then made a motion that the ordinance be approved. The motion was seconded by Councilman Mullendore and prevailed by the following vote : ' ; Ayes . Florence, Oliver , Dunn, Shafer, Mullendore & Ware � Nays . We have also reviewed the City' s history of investing idle funds during the past two years . � ; Our conclusion, after our reviews , is that American Bank of ' Commerce should be awarded the depository bid contract as being the most competitive bid and that the contract which either would yield higher interest income or lower expenses for the ' City as applicable thereto. € � � We would be happy to discuss our comparisons of the two bids on 3 an item for item basis should you so desire. The next order of business was for the City Counci7. to consider � an ordinance abandoning a portion of the street right-of-way on ' Brookside Drive. � R The City Manager gave a brief history stating that a 10'X315 ' strip had been dedicated in excess of the street right-of-way � needed. He advised that all of the utility companies affected � had given their consent for the abandonment. Mr. Hancock advised � that it was the recommendation of the City Staff that the abandonment be approved. Following a short discussion, it was the concensus of the Council that a twenty mile per hour speed limit be enforced on Timberline Drive from its intersection with Mustang Drive to approximately the second platted lot southwest of Kerr Drive on school days from 7 : 00 - 9 : 00 A.M. and from 2 : 00 - 4: 00 P.M. Councilman Oliver made a motion that the ordinance be adopted as � discussed. The motion was seconded by Councilman Shafer and prevailed by the following vote: Ayes . Following a short discussion, Councilman Dunn suggested that further consideration be given to the matter to determine ' various options . ' Councilman Dunn therefore made a motion that the item be tabled. The motion was seconded by Councilman Ware and prevailed by the following vote : ' Ayes .
