Hancock City Manager Bob Hart Administrative Assistant John F. Boyle , Jr. City Attorney Shirley Armstrong City Secretary CALL TO ORDER Mayor Tate called the meeting to order. INVOCATION The Invocation was delivered by Reverand Albert Warnken, Memorial Baptist Church. MINUTES The first order of business was for the City Council to consider the minutes of March 20 , 1979 . Councilman Dalton made a motion to waive the reading of the minutes and approve them as published. The motion was seconded by Council- man Shafer and prevailed by the following vote : Ayes : Tate, Florence, Ware, Oliver, Dalton, Shafer , and Dunn Nays : None 1 I BOUNDARY - COLLEYVILLE/GRAPEVINE � The next order of business was for the City Council to consider a contract relative to the Colleyville/Grapevine Boundary. � Mayor Tate advised that those in the audience who wanted to speak in regard to this item would be given an opportunity to do so later in the meeting. He �alled upon Councilman Dunn, Boundary Committee Mem- ber, to make a statement. Councilman Dunn commented that a great deal of time, effort , and study had gone into the matter by the Colley- ville Boundary Committee, the City Managers from both cities , and by Councilman Florence who served on the Grapevi.ne �oundary Committee. He further stated that it was the Commi.ttee ' s recommendation that the City of Grapevine enter into the contract agreement. City Manager Jim Hancock then, by use of a transparency, explained � the proposed boundary. See Exhibit "A" attached hereto and made a part hereof. The City Attorney then explained that the contractua�. agreement being � considered was for the purpose of delineating a proposed boundary with ? the two cities agreeing and signing the contract to go forward and take the necessary legal steps to finalize the matter. He further commented that acceptance of the contract would not be the legal step that accom- ` plished the boundary agreement itself. Mr. Boyle added that legal pro- ' cedures were lengthy and included disannexation ordinances , relinquish- ment and waiver of extra territorial rights and claims , and then annexa- tion proceedings would be instituted as required under the Annexation � Act. i � 04/03/79 � Councilman Florence , Member of the Boundary Committee, stated that �' the Committees had attempted to make the boundary as straight as � passible without dividing individually owned property between the � two cities . He added Pool Road was considered also in an effort €' to assign the maintenance of both the north and south side of the �' road to one jurisdiction. � � Mr. Jack Newell, (presently a Grapevine Citizen, living wi�hir the � area that would be disannexed to Colleyville) , presented the Council � with a petition signed by twenty (20) citizens who were petitioning t to remain within the City Limits of Grapevine. See Exhibit "B" at- � tached hereto and made a part hereof. � �: Mr. Ken Sauer stated that upon the purchase of his property he was � advised that deed records indicated his property to be in Tarrant � County and not in either Grapevine or Colleyville. Mr. Sauer asked ; if Grapevine had annexed his property through Tarrant County so as to have the power to trade his property to Colleyville. � �. � City Attorney John Boyle explained that the City of Grapevine , as a � Home Rule City, has the legal power to unilaterally annex without # the property owner petitioning. He continued to say that the Munic- j ipal Annexation Act went into effect in 1963 , if the property was not � annexed prior to that time, and the two cities were side by side , � then it would be in an area called the overlapping extra-territorial � jurisdiction of the two cities . He added that it would be up to the ;: two cities to contract and apportion out that area by contract much � like the one being considered by the Council at the present time. � Mr. Boyle further stated that it would be necessary to research the � question raised since it had been his understanding that all of the ; area in question had been annexed, or claimed �� have been annexed by Grapevine , Colleyville , or both. � 4 Mayor Tate commented that the problem was , if there was property with- � in the extra-territorial jurisdiction of the two cities , then both € cities ' ordinances , as far as annexation, may be invalid until that � line is agreed upon and that extra-territorial jurisdiciton is ap- � portioned. He added, however, that annexation and disannexation or- � dinances would have to be approved prior to the finalization of the � boundary settlement. � x Mr. Hancock asked if the majority of the citizens represented lived � within the E. J . Cox Survey. Those in attendance indicated yes . � � Mayor Tate was advised that a similar petiton was being presented at � the Colleyville City Council meeting. � � Mayor Tate then commented that it was not the intent of the City of � Grapevine to give up any of its citizens . He added that it was � paramount to the City to reach an agreement on a boundary so that � the City would not become involved in future litigation, and so E that the people who live in that area would know where to pay taxes � and where to vote. He continued to say that the City of Grapevine ,' would like to have all of those people within our City, but that any � agreement at all had to be mutual between Grapevine and Colleyville, � and that some compromises would have to be made. � � Mr. Newell asked if there could be a delay in entering into the con- � tract agreement with the City of Colleyville. � � Mayor Tate answered that an effort was being made to allow those � Councilmen who had worked on the boundary agreement to initiate the � contract prior to the election. He again advised those in atten- � dance that acceptance of the contract was not the final step in � reaching an agreement. � � � Councilman Dalton added that taking action on the contract would � show Grapevine ' s good faith and would allow for negotiations . � Councilman Dunn stated that he felt Grapevine should honor their � position by entering into the contract agreement . `a Councilman Dunn then made a motion to enter into a contract agree- � ment with the City of Colleyville , that the petition be presented � i E' � � � 4 04/03/79 by the City of Grapevine to the City of Colleyville and that the two committees meet again to determine what could be worked out. The motion was seconded �y Councilman Florence and prevailed by � the following vote : a ' Ayes : Tate, Florence, Oliver, Ware, Dalton, Dunn, and Shafer Nays : None ; (See Exhibit "C" , Contract Agreement , attached hereto and made a ' part hereof) . PUBLIC HEARING - MULTI-FAMILY PARKING REQUIREMENTS : I j The next order of business was for the City Council to hold a Public Hearing and consider a subsequent ordinance relative to an amendment to the recently approved ordinance on revised parking requirements in Multi-F�:mily Districts . j Mayor Tate declared the Public Hearing open. City Manager Jim Hancock advised that the Council had recently ap- I proved an ordinance increasing the required parking spaces in Multi- Family Districts from 12 spaces per unit to 22 parking spaces per unit. He further noted that the ordinance had an effective date of � February 20 , 1979 . He added that two developers had, on the basis � of City Staff information, already acquired financing for their pro- � jects . Mr. Hancock further stated that he felt some consideration should be given to the two affected developers . Mr. Jim Baddaker, City Engineer, advised the Council that the Plan- ' ning and Zoning Commission held a Public Hearing on the matter on March 29 , 1979 and recommended that an ordinance be prepared with special provisions as follows : That the developer have a letter from his lender stating that construction financing had been acquired prior to February 20 , 1979 ; that in order to waive the new parking re- quirements , the City Staff prepare a letter stating that the site plan met the ordinance requirements prior to February 20 , 1979 ; and that � the building permit be obtained on or prior to June l , 1979 . i �� � Mayor Tate asked if there were guests in the audience to speak for or against the proposed ordinance. � Mr. Willard Baker, developer of Oakwood Apartments , and Mr. Ticknor , developer of a new sixty-four (64) unit apartment complex, both ap- peared before the Council and asked that consideration be given to allow them to continue their project under the ordinance al�iowing 12 parking spaces per unit. During the following discussion, it was the general concensus o� the Council that the ordinance waiving the new parking requirements apply only to the two projects discussed and that the date �or obtaining the building permit be extended to June 30 , 1979 , rather than June 1 , 1979 . There being no further discussion, Councilman Dunn made a motion to close the Public Hearing. The motion was seconded by Councilman Oliver and prevailed by the following vote : Ayes : Tate , Florence, Oliver, Dalton, Dunn, Shafer , and Ware Nays : None Councilman Dalton then made a motion to instruct the City Attorney � to draft an amendment ordinance in accordance with the Council' s discussion. The motion was seconded by Councilman Ware and prevailed by the following vote : Ayes : Tate, Florence , Oliver, Ware , Dalton, Dunn, and Shafer � Nays : None � PUBLIC HEARING - SIGN SETBACK The next order of business was for the City Council. to hold a Public Hearing and consider a subsequent ordinance to amend the zoning ordi- nance as it relates to sign setback requirements . Mayor Tate declared the public hearing open. � � 04/03/79 � � City Manager Jim Hancock advised that the C�.ty Staff has , i�n the � past , received complaints about the sign setback requa�rements . He ; further stated that as s result , numerous persons have appeared be- s fore the Board of Zoning Adjustment to request a variance in the set- � back requirements . Mr. Hancock commented that it was the feeling of � the City Staff that the situation warranted Council consideration. 4: City Engineer Jim Baddaker advised that in many cases , with the pre- _, sent fifteen foot setback requirement , a parking space was lost in � an effort to comply with the existing ordinance. He explained further � that if a builder placed a commercial building on the front property � line (which is permissable in commercial zoning) a roof sign would � have to be set back fifteen feet from the front of the building. � Mr. Baddaker stated that the Planning & Zoning Commission held their � Public Hearing on the matter on March 29 , 1979 , and it was their rec- � ommendation, as well as that of the City Staff, that the sign set- � back requirement be eliminated from the "C-1" and "C-2" Zoning cat- _ egories and that a clause be inserted to read that any sign could not < restrict the visibility of traffic , nor project or cantilever over � the property line. Mayor Tate asked if there were guests present to speak for or against ; the recommended sign setback amendment . There were none. � � Councilman Oliver then made a motion to close the Public Hearing. The : motion was seconded by Councilman Dalton and prevailed by the follow- g ing vote : ;. � Ayes : Tate , Florence , Ware , Oliver , Dalton, Dunn, and Shafer 4 Nays : None � Councilman Florence then made a motion to authorize the City Attorney �' to draft an ordinance incorporating the proposed changes . The motion � was seconded by Councilman Dunn and prevailed by the following vote : 6 d � Ayes : Tate , Florence , Ware , Oliver , Dalton, Dunn, and Shafer i Nays : None ; � INDIAN HOUSING PROGRAM � ; � ; The next order of business was for Mr. Wa1t Broemer , Executive Direc- ; ` tor of the Texas Indian Commission to make a presentation pertaining � ; to a housing program for Indians . � E Mr. Broemer began his presentation by stating that the Texas Indian � Commission was a State Statutory Agency that was created in 1965 by � the State Legislature. He stated that there were approximately 35 ,000 ' Indians in Texas , 25 , 000 of which lived in the metroplex. He added = that in 1977 the State Legislature recognized that assistance was ' needed, therefore amended the bill so that the Texas Indian Commission could work with the six (6) Intertribal Organizations charted through � the State. A Federal loan committment was obtained thru HUD in the amount of sixteen million dollars to build four hundred units of ' Indian Mutual Help Housing . He then outlined the cooperati.on agree- _ ment proposed to the City of Grapevine as follows : � A. The City would have the right to site by site construction approval with complete control of each project. B. The program would include new construction or rehabilitation -° of sub-standard housing, x � C. No concentration of Indians - only two project houses al�,owed ' on each city block. � D. The Indian Family to do "sweat equity" work to allow $500 . 00 � down payment per house. ' t E. House payment to be 25% of income until house is paid for with the program being geared for twenty-five years . F. When family is capable of carrying note themselves , then t private financing is obtained (usually occurs between twelve � to sixteen years .� F $ G. Until house is paid off, or until the family assumes4/0�3/79 their own loan, the house is tax exempt. H. The Texas Indian Commission would pay only ten percent of the amount payed per month on the house in lieu of taxes . Following a lengthy discussion, Councilman Ware made a motion to table the item for further disucssion and to authorize the City Staff to place consideration of the subsequent resolution on the next agenda. The motion was seconded by Councilman Oliver and pre- vailed by the folllowing vote : � Ayes : Tate, Florence , Ware, Shafer , Oliver, Dalton, and Dunn Nays : None GR.ANT - POLICE DEPARTMENT RADIO EQUIPMENT The next order of business was for the City Council to consider a resolution authorizing the Police Department to apply for a grant from the Texas Criminal Justice Division for the purpose of obtain- ing radio equipment. The City Manager explained that the estimated total cost was $30 , 750. with the City' s portion being 25% or $7 , 687 . He further noted that funds were not provided for in the current operating budget , therefore, if approved, the Council would need to authorize additional funds � from the unappropriated fund balance. He advised that it was the recommendation of the City Staff that the resolution be approved. The City Secretary then explained the contents of the proposed resolu- tion. Councilman Dalton made a motion that the resolution be adopted. The motion was seconded by Councilman Shafer and prevailed by the following vote : ; Ayes : Tate , Florence, Ware , Shafer , Oliver, Dalton, and Dunn Nays : None RESOLUTION N0. 79-8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE , AUTHORIZING THE CITY OF GRAPEVZNE TO APPLY FOR A GRANT FROM THE TEXAS CRIMINAL JUSTICE DIVISION PROVIDING 75% FUNDING FOR THE PURCHASE OF RADIO COMMUNICATIONS EQUI�MENT ORDINANCE - GOLF COURSE CLOSING-TRESPASSING The next order of business was for the City Council to consider an ordinance restricting unauthorized personnel on the Golf Course after closing hours . The City Secretary read the caption of the proposed ordinance. The City Attorney briefly explained the contents of the ordinance. Councilman Florence made a motion to adopt the ordinance. The motion was seconded by Councilman Ware and prevailed by the following vote : Ayes : Tate , Florence, Ware, Shafer , 0liver , Dalton, and Dunn Nays : None � ORDINANCE N0. 79-17 AN ORDIANCE OF THE CITY OF GRAPEVINE PROVIDING FOR IT TO BE UNLAWFUL FOR UNAUTHORIZED PARTIES TO ENTER INTO OR BE WITHIN THE AREA DELINEATED AS THE GRAPEVINE MUNICIPAL GOLF COURSE DURING CERTAIN HOURS ; PROVIDING FOR SIGNS TO BE POSTED ACCORDINGLY; PROVIDING A PENALTY ; PROVIDING A SEVEI�B�II��ITY- CLAUSE; AND DECLARING AN EMERGENCY � � � ADdOURNMENT 04/03/79 � ; There being no further business to come before the Council , Council- ` man Dalton made a motion to adjourn. The motion was seconded by Councilman Oliver and all in attendance voted aye. ' � r . • ' .• � �# + � ; , � ' EXHIBIT "C" � BOUNDARY AGREEMENT THIS AGREEMENT is made and entered into by and between ^ the City of Colleyville, Texas, hereinafter referred to as ° COLLEYVILLE, and the City of Grapevine, Texas, hereinafter refer- 3 red to as GRAPEVINE. WHEREAS, COLLEYVILLE 's Northeast boundary and GRAPEVINE's � Southwest boundary are now contiguous; and, WHEREAS, said boundary does not presently allow the maxi- mi.zation of the development and delivery of City services to the area in question; and, WHEREAS, the Cities desire to modify their mutual bound- ary so as to allow each City to maximize the development and delivery of City services to the area; and, WHEREAS, representatives of COLLEYVILLE and GRAPEVINE have met and agreed upon a mutual boundary, which is in the best inter- ' � est of the citizens of each City. NOW, THEREFORE, for and in consideration of the mutual covenants, conditions, and promises expressed herein, COLLEYVILLE and GRAPEVINE agree as follows: � I tem I. �� Statement of Intent ` � Representatives of each City have met and agreed upon the mutual boundary which the Cities wish to effect by this agreement. A metes and bounds description of said mutual boundary line is k attached hereto and incorporated herein as Exhibit "A" . The line delineated by said metes and bounds description shall be herein- - after referred to as the "Boundary Line". It is the intent of ; '� COLLEYVILLE and GRAPEVINE to modify their respective boundaries i so as to bring all properties lying along and Southwest of the Boundary Line within the City of COLLEYVILLE and to bring all pro- perties lying along and Northeast of the Boundary Line within the City of GRAPEVINE. Each party understands that it will be neces- sary to disannex a portion of each respective City so as to allow the other City to annex same. Item II . Disannexation and Retention of Extraterritorial Jurisdiction � Upon execution hereof, COLLEYVILLE shall take and begin all proceeding� necessary to disannex all properties lying along and Northeast of the Boundary Line, and COLLEYVILLE shall disannex all properties lying along and NortYieast of the Boundary Line. GRAPEVINE grants, quitclaims, relinquishes and apportions unto COLLEYVILLE all extraterritorial jurisdiction rights, which GRAPE- VINE has or may acquire in the property disannexed by COLLEYVILLE pursuant hereto, provided, however, that upon the completion of • all conditions incorporated in Item III hereof, the extraterritorial jurisdiction rights of the respective parties shall be modified as stated in Item III. Upon execution hereof, GRAPEVINE shall take and begin all ` proceedings necessary to disannex all properties lying along and ,: Southwest of the Boundary Line, and GRAPEVINE shall disannex all properties lying along and Southwest of the Boundary Line.
