of Grapevine, Texas met in joint session on this the 20th day of
February, 1979 at 7 : 30 P.M. with the following persons present

CALL TO ORDER
The meeting was called to order by Mayor Tate.
INVOCATION
Reverand David Whitington, Minters Chapel United Methodist Church
delivered the invocation.
PUBLIC HEARING - ZONING APPLICATION N0. Z79-1
The first order of business was for the City Council and the
Planning and Zoning Commission to hold a public hearing on Zoning
Application No. Z79-1 subtnitted by J . K. Buckner.
Mayor Tate declared the public hearing open.
The City Secretary explained that the applicant was requesting
that the zoning of 402 Blevins Street be changed from "R-1" Single �
Family Dwelling to "R-3" Multi-Family Dwelling District .
A short presentation was given by J . K. Buckner on behalf of the
property owner , Mr. Teddy J. Kennedy.
� There was little discussion from the Planning and Zoning Commis-
sion and City Council.
Mayor Tate asked if there were guests present to speak for or
against the application.
Reverand Jerry McClelland, 310 Pebblebrook, Grapevi.ne , Texas ,
suggested that the maximum use of the property be limited to a
four-plex.
Mr. J. B. Hull, 403 Holly, Grapevine, Texas , advised that he was
opposed to the zoning, expecially if a two-story complex was -
- authorized.

The City Secretary then read a letter from Grapevine Investments d
attached hereto and made a part hereof as Exhibit "A" . Mrs .
Arms�rong then read a letter from Pebble Braok Prc►perties at-
�ached hereto and made a part hereof as Exhibit "B" .

The City Secretary explained that �he application referred to j
�hree {3) small tracts of land totalling one {1.} acre out af �he `
C. B. McDonald Survey. She further advised that Ghe applicanG �
was requesting �hat the property in question be rezoned from "R-1" �
Single Family Dwelling Distric� to "C-2" Community Business Dis- �
tric� Zoning. �

Mrs. Knox then presented Mr. Cote' s request stating that her client
�elt the best use for the progerty was of a cammercial natu.re.

; Member Harlen Joyce asked why Mr. Cote had built ha.s commercial '
building on residen�ial property (under the pretense �hat it would
; be a residence} and thert asked for the commerci.al zoning. Mrs , Knox
f stated that she did not knaw.

� Member Robert Sands inquired as to whe�her or not there would be
= sufficient parking without having �a back onto the highway, Mrs .
Knox answered that there wa� ample room foa^ proper parking.

t City Manager Jim Hancock advised that �he znterior of the struc-
i ture was not built in accordance with �he plans submi�ted far a
t building permit , bu� that the facila.ty did meet with commercial
standards .
Following several s�atements from Council Members , Mayor Tate
3 asked if there were any guest in the audience wha wished Ca speak
tor or against �he application.
Mr. Bob Bush, A�torney representing the Grapev�,ne Independent �
'` Schaal District , advised that the School D3.str3.ct was in apposi-
` �ion to �he zoning request . Mr. Bush advised �he Councii tha�
�he School System owned properGy adjacent �o that of Mr. Cote and
gave a history of a law sui� involving the two.
He nated that the Schaol System in�ended to con.tintze to use the ad-
jacen.t property as a baseball diamond and �hat approval o� a com-
; mercial zoning with a bu.ilding con�aining sky lights and glass
r would presen� likely problems . Mr. Bush added tha� there�ore , the
x Grapevine Independent School District took the position of opposing
s the requested zoning.

Mr. Bob Fail , Schoal Superintenden� , stated that he did not per-
sonally appose the zoning requ�st , but he did abject �o the rnanner
in which recent actions had transpired. He asked the Council to
consider the position of the School District in regard ta the mat-
ter.
The City Secretary advised tha� she did na� have any correspondence
relating to the zoning request.
There being no �urther discussion, Mernber Harlen Joyce made a mo�ion
to c2ose the Planning and Zaning Commisszon' s portion af �he public
hearing. The motian was seconded by Member Rober� Sands and pre-
vailed by the follawing vo�e :

Councilman Gideon then made a motion ta close the Council' s portion
of the public hearing. The mo�ion was seconded by Councilman

The next order of �usiness was far the City Cauncil and Planning
and Zoning Commission ta hald a public hearing on Zoning Applica-
�ion No. Z79-3 submitted by Bruce and Shirley Scholimeyer, dba
Wheel Estates Mobile Home Village.
Mayor Tate decalred the public hearing open.
The City Secretary explained that �he property in question con-
�ained approximately twenty-three (23) acres and was cs��z-ently
operating as .� �iobile ha�e park under �he nan-con�orming use pian.
She further explained that if an�T new alterations wer� made, such
as addi�ional construc�ian, the non-conforming use status becomes
invalid and proper zoning must be made. She noted that the current
zoning af the progerty in ques�ion was "R-1" �ingle Family Dwelling
District and that the requested zoning was for "MH" Mabile Home
Dwelling District.
Mr. Schallmeyer then made a short presenta�ion advising that he
was desirous to increase the number of mobile hames on the afore-
mentioned praperty.

The City Secretary explained that the applicants had requested a ::
postponement until the March meeting. �

Member Harlen Joyce made a motion to continue the public hearing a
relative to Zoning Application No. Z79-4 on March 20 , 1979 . The ,�;
motion was seconded by Member Robert Sands and prevailed by the '

; MINUTES - FEBRUARY 6 , 1979
= The next order of business was for the City Council to consider the
' minutes of February 6 , 1979 .
Councilman Dunn made a motion to waive the reading of the minutes
and approve them as printed. The motion was seconded by Councilman
Shafer and prevailed by the following vote :

t CHANGE ORDER - CONCOURSE AND PRO SHOP/RESTAURANT -
� The next order of business was for the City Counc�l to consider an
amendment to Change Order Number One relative to the construction �
; of the Concourse Center and Pro Shop/Restaurant facilities .
The City Manager explained that on February 6 , 1979 the Council
approved Change Order Number One in an effort to reduce the con-
struction cost of the Concourse and Pro Shop/Restaurant. As approved,
� the Change Order reduced costs by $37 , 884. 00 . At that time , Item
� Number Thirteen (13) pertaining to the east elevation of the Con-
� course building was omitted from the Change Order, thereby leaving
' it in the construction plans at a cost of $719 . 00.
�
� Architect Al Mikusek explained that after further negotiations with
� the contractor, he felt it in the best interest of the City to
,

include the item in the Chan e Order and omit it from construc-
tion plans for a savings of �1 , 219 . 00.
The City rianager explained that if the Change Order amendment was
approved, the total results of the Change Order would be as follows :
Original Contract Sum $575 , 000. 00
Decreased by Change Order ��l 39 , 103 . 00
New Contract Sum $535 ,897 . 00
There being little discussion, Councilman Dunn made a motion to
accept the recommendation of the City Staff and Architect and ap-
prove the amendment to Change Order Number One. The motion was
seconded by Councilman Oliver and prevailed by the following vote:
Ayes : Florence, Oliver, Dalton, Dunn, Gideon, Shafer
Nays : None

RESOLUTION N0. 79-3
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS , APPROVING AN AMENDMENT TO
CHANGE ORDER NUMBER ONE RELATIVE TO A CERTAIN
CONSTRUCTION CONTRACT AND AUTHORIZING AND DI-
RECTING THE MAYOR TO EXECUTE SUCH CHANGE ORDER.
ZONING ORDINANCE AMENDMENT - CUL-DE-SAC AND PARKING REQUIREMENTS �
The next order of business was for the City Council to consider an
ordinance amending the Zoning Ordinance in the following areas :
(1) Building measurements pertaining tc�

Dwelling Districts
City Engineer, Jim Baddaker explained the contents of the ordinance.
The caption of the proposed ordinance was read by the City Secretary.
Following a short discussion, Councilman Gideon made a motion to
adopt the ordinance. The motion was seconded by Councilman Shafer
and prevailed by the following vote :

Park and Recreation Director , Kevin Conklin, made a presentation
advising the Council of the contents of the policy.
Following a short discussion, Councilman Oliver made a motion to
adopt the proposed Park and Recreation Department ' s Athletic
Facilities Policy as presented. The motion was seconded by ,
Councilman Dunn and prevailed by the following vote :

Councilman Dunn made a motion to postpone consideration of said

Zoning Commission, by a vote of five to one, had recommended that
a "SP" Specific Use Permit be granted for single story Multi-Family

Following a short discussion, Councilman Gideon made a motion to

Administrative Assistant , Bob Hart , reported that the Planning and
Zoning Commission voted three to three to deny the application. A ¢
second motion was then made to approve the application and it also �

City Attorney John Boyle ruled that if an application was not �
approved, the recommendation from the Planning and Zoning Com- �
mission would be to deny the application with the net result being �
that the property zoning remained the same. �

Councilman Dunn stated that Mr . Cote had made no effort to avoid �
problems (example : glass in the new building) or no effort to live =

faith had not been shown, however , he felt the Council' s respon- s

of Block Two (2) be incorporated into Lots Two (2) and Three (3)
to avoid driveway access from Dove Road.
The City Attorney advised that a final plat could not be approved
on a conditional basis , however, it could be approved authorizing
the Mayor' s signature after the changes had been made.
Councilman Dalton then made a motion to approve the Final Plat of
Tiffany Forest and to instruct the Mayor not to sign said Plat
until the recommended changes had been made. The motion was
seconded by Councilman Shafer and prevailed by the following
vote :

PRELIMINARY PLAT - THE WOODS `

ther Butterfield Court or East Ridge Court to the South property
line to provide circulation and utility access from the south when

As a property owner within 200 feet and in response
to the required notice of a proposed zoning change, I am
writing this to oppose Zoning Application Z79-3 to change
the existing non-conforming mobile home use to a permanent
mobile home park.
The tract of land is now adjacent to two large single
family subdivisions . I, and I am sure others , made a
large home investment based on the assumption the mobile
home park would be reverted to "R-1" use at some future
point in time. Also, the Master Plan has recommended the
property to be a low density, single family residential
area.
It is my opinion that the best development of the
tract would be as a single family subdivision, therefore
remaining "R-1" .
Therefore, I would request that you vote to deny the
application.
