� The City Council of the City of Grapevine met in regular
session on this the 21st day of March, 1978 at 7:30 P.M.
with the following members present to-wit:
William D. Tate Mayor
Doil Dalton Mayor Pro-tem
Charles Gideon Councilman
David Rlorence Councilman
Larry Oliver Councilman
Willis Pirkle Councilman
Charles Dunn Councilman
constituting a quorum with,

Mayor Tate called the meeting to order.
INVOCATION
The invocation was delivered by Councilman Larry Oliver.

MINUTES
The first order of business was consideration of the minutes
of March 7, 1978. Councilman Oliver made a motion to approve
the minutes as printed. The motion was seconded by Councilman
Florence and prevailed by the following vote:
Ayes: Tate, Gideon, Florence, Oliver, Dunn, Dalton and Pirkle.
Nays: None
ORDINANCE - INFORMAL BID REQUIREMENTS
The next order of business was for the City Council to consider
an ordinance establishing a procedure relative to bid require-
ments in regard to the purchase of items of equipment.
The City Manager explained that he did not have an opportunity
to review the proposed ordinance prior to the council meeting
and recommended that the item be tabled pending further study.
Councilman Pirkle then made a motion that the item be tabled.
The mofiion was seconded by Councilman Dunn and prevailed by
.�
the following vote:
Ayes: Tate, Gideon, Rlorence, Oliver, Dunn, Dalton and Pirkle.
Nays: None
ORDINANCE - PORNOGRAPHIC MOVIES
The next order of business was for the City Council to consider
an ordinance prohibiting pornographic movie theaters in the
City of Grapevine.

The City Secretary read the caption of the proposed ordinance. �
The City Attorney explained that the state law prohibited �.
the exhibition, on a commercial basis, of obscene movies,
therefore, the council would not be in a position to draft �'
an ordinance that would attempt to totally proclude the �
movie theaters. He advised that the ordinance he had pre-
pared would prohibit the showing of movies that show sexually �
explicit matters within a thousand feet of a school, church, �
residential districts or public park. He suggested that if �
the Council proceeded with this type of ordinance, that
they might also consider the handling of movie theaters �
through the zoning ordinance by requiring a specific use �
permit. He added that this action would require amending �
the zoning ordinance. �

Councilman Dunn asked if the proposed ordinance could contain �
a section prohibiting book stores dealing primarily with
adult type materials. The City Attorney stated that it was �
advisable to consider the movies on a separate basis since �
they were referred to under lst Amendment Rights . He i
further acknowledged that a series of ordinances dealing �
with such items as bookstores, nude wrestling and modeling, �
etc. could be considered. Councilman Dunn then requested �
that the City Attorney draft a suitable ordinance pertain- �
fi ing to bookstores . �

Councilman Oliver stated that he would prefer to review the �
ordinances prior to their passage. He then made a motion „
to table consideration of this item pending further study. �
The motion was seconded by Councilman Florence and prevailed �
by the following vote: �
Ayes: Tate, Dalton, Gideon, F'lorence, Oliver and Dunn �
Nays: Pirkle �
� ORDINANCE - ALCOHOLIC BEVERAGE NEAR CHURCHES, ETC. �'
� The next order of business was for the City �;ouncil to dis- �
� cuss amending the alcoholic regulatory ordinance relative to �
� the serving of alcoholic beverages near schools, churches, �'
hospitals, etc. �

The City Secretary read the caption of the proposed ordinance. �'
The City Attorney explained that the proposed ordinance �'
amendment would require the distance to be 1000 feet (rather �,
than the existing 300 feet) . �

± After a lengthy discussion, Councilman � made a motion �
' that the proposed ordinance be amended to refer to a distance �
; of 500 feet and that the ordinance then be adopted. The �
motion was seconded by Councilman Dalton and prevailed by �
' the following vote: �
Ayes: Tate, Dalton, Gideon, Florence, Oliver, Dunn & Pirkle �

EXECUTIVE SESSION - PERSONNEL & LITIGATION �
�
At 8:05 P.M. the City Council recessed to the Conference �
Room to discuss pending litigation pursuant to Article �
6252-17, Section 2, Subsections (e) and (f) , Texas Civil �.
Statutes. �

The Council reconvened in the Council Chambers at 8:45 P.M. �
with all members present and took the following action rela- _
tive to personnel: �
�

PERSONNEL - ADDITIONAL POLICE ORFICERS
Councilman Pirkle made a motion to accept the recommendation
of the City Manager and authorize the hiring of two (2)
additional police officers as provided in the budget. The
motion was seconded by Councilman Oliver and prevailed by
the following vote:
Ayes: Tate, Dalton, Gideon, Rlorence, Oliver, Dunn & Pirkle
Nays: None
PERSONNEL - ADDITIONAL ELECTRICAL `INSPECTOR
The City Manager then explained that because of an extreme
increase in building construction, an additional electrical
inspector was needed. He advised that building permits were
789b above the budget amount and that funds therefore were
available for the additional staff inember.
Councilman Oliver made a motion to accept the recommendation
of the City Manager and authorize the hiring of an additional
electrical inspector. The motion was seconded by Councilman
Dalton and prevailed by the following vote:
Ayes: Tate, Dalton, Gideon, Florence, Oliver, Dunn & Pirkle
Nays: None
RESOLUTION - LITIGATION AGREEMENTS, A. C. STONE
The next order of business was for the City Council to consider
a resolution authorizing execution of settlement of litigation
agreements, A. C. Stone et al vs. City of Grapevine.
The City Attorney explained the series of resolutions and
� ordinance that w�ould be considered relative to settlement of
the Stone law suit.
Councilman Dunn then made a motion to adopt the resolution
authorizing the execution of litigation agreements, A. C.
Stone et al vs. City of Grapevine. The motion was seconded
by Councilman Pirkle and prevailed by the following vote:
Ayes: Tate, Dalton, Gideon, Florence, Oliver, Dunn & Pirkle
Nays: None
RESOLUTION NO. 78-9
A RESOLUTION AUTHORIZING EXECUTION OF SETTLBMENT
OF LITIGATION AGREEMENTS, A. C. STONE ET AL VS.
CITY OF GRAPEVINE.

The next order of business �a s for the City Council to consider
an ordinance disannexing certain property. The City Secretary
read the caption of the proposed ordinance.
Councilman Pirkle made a motion to adopt the ordinance dis-
annexing certain property. The motion was seconded by Council-
