AN ORDINANCE OF THE CITY OF GRAPEVINE,
TEXAS, REGULATING THE SPEED OF VEHICLES
WITHIN THE CITY; SPECIFYING THE REASON-
ABLE AND PRUDENT SPEED FOR PUBLIC STREETS
AND ALLEYS WITHIN THE CITY; AUTHORIZING
THE ERECTION OF TRAFFIC REGULATION SIGNS;
REPEALING CONFLICTING ORDINANCES; PROVIDING
� FOR A PENALTY OF FINE NOT TO EXCEED TWO
HUNDRED ($200. 00) DOLLARS FOR EACH OFFENSE;
PROVIDING A SEVERABILITY CLAUSE; AND DECLAR-
ING AN EMERGENCY.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF GRAPEVINE, TEXAS :
Section 1. General Speed Limits
(a) No person shall drive as defined by State Law
a motor vehicle, a motorcycle, bicycle, motor driven cycle,
motor-assisted cycle, or parkway within the corporate limits
of the City of Grapevine, Tarrant County, Texas, at a speed
greater than is reasonable and prudent under the circumstances
then existing. Except where a special hazard exists that re-
quires lower speeds for compliance with paragraph (b) of
this section, no person shall operate or drive any motor ve-
hicle or other vehicle on any street within the City of Grape-
vine at a greater speed than thirty (30) miles per hour, unless
otherwise provided by subsequent sections of this ordinance or
other ordinances, and any speed in excess of thirty (30) miles
per hour, unless otherwise provided by subsequent sections
of this ordinance or other ordinances, shall be prima facie
evidence that the speed is not reasonable or prudent and is
� unlawful.
I (b) No person shall drive a vehicle upon a public street
'�r`� or a public alley within the corporation limits of the City of
Grapevine at a speed greater than is reasonable and prudent under
the conditions and having regard to the actual and potential
hazards then existing. In every event speed shall be so con-
trolled as may be necessary to avoid colliding with any person,
vehicle or other conveyance on or entering the highway in com-
pliance with legal requirements and the duty of all persons to
use due care.
Section 2. Speed Limits on Certain Public Streets
Upon the basis of an engineering and traffic investigation
heretofore made as authorized by the provisions of Section 169 ,
V.A.T.C.S. , 6701d, Uniform Act Regulating Traffic on Highways ,
' the following prima facie speed limits hereafter indicated for
vehicles are hereby determined and declared to be reasonable
' and safe; and such speed limits are hereby fixed at the rate
of speed indicated for vehicles traveling upon the named public
streets and highways, or parts thereof, of the City, said speed
limit to be in force and effect unless otherwise limited as pre-
scribed by the provisions of this ordinance. The streets and
,�. highways hereby regulated, and the maximum prima facie speed limits
thereof, are as follows:

On William D. Tate Avenue between 35 m.p.h.
State Highway 26 and the south right-
of-way line of State Highway 114.
On Lakeview Drive between 20 m.p.h.
Kimball Road and Lakeshore
Drive
Section 3. That when, upon the basis of an engineering
and traffic investigation, it is necessary that the speed limit
on any street, highway, or alley within the City of Grapevine,
because of the maintenance, construction and/or repair of such
street, highway, or alley or portion thereof, be reduced, the
"�'" City Manager or his agent shall have the authority to erect
signs at the beginning, end and other portions where such street,
highway or alley is under maintenance, construction and/or
+r,�, repair limitjng the speed to the maximum speed determined by
the City Manager or his agent and it is unlawful for any person
to operate or drive any motor vehicle within such posted area
at a speed in excess of said speed, said speed limit hereby
being deemed to the prima facie evidence of reasonable and
prudent maximum speed at which a vehicle may travel on such
portions of said street, highway or alley under construction,
maintenance or repair.
Section 4 . That the City Manager or his agent, is hereby
authorized to have speed limit signs erected, constructed and
placed at such points along said highways, streets or alley or
portions thereof under construction, maintenance or repair
so that travelers will be reasonably notified of said speed.
Section 5. That all ordinances or any parts thereof in
conflict with the terms of this ordinance shall be and hereby
are deemed repealed and of no force or effect provided, however,
that the ordinance or ordinances under which the cases currently
filed and pending in the Municipal Court of the City of Grapevine,
Texas, shall be deemed repealed only when all such cases filed
and pending under such ordinance or ordinances have been dis-
"�� posed of by a final conviction or a finding not guilty of nolo
contendere, or dismissal.

Section 6. Any person, firm or corporation violating
any of the provisions of this ordinance shall be deemed guilty
of a misdemeanor, and upon conviction in the Municipal Court,
shall be fined in an amount not to exceed the sum of Two Hundred
Dollars ($200. 00) for each offense.
Section 7 . If any section, paragraph subdivision, clause,
phrase, or provisions of this ordinance shall be judged invalid
or unconstitutional the same shall not affect the validity of
this ordinance as a whole or any portion thereof other than that
portion so decided to be invalid or unconstitutional.
Section 8. The fact that the traffic regulations of the
City of Grapevine do not adequately regulate the traffic within
the City creates an urgency and an emergency and the preservation
of the public health, safety and welfare requires tha this ordi-
nance shall take effect immediately from and after its passage
and the publication of the caption of said ordinance as the law
and the City Charter in such cases provides.
