AN ORDINANCE OF THE CITY OF GRAPEVINE PRO-
HIBITING POSSESSION AND USE OF GLASS BEV-
ERAGE CONTAINERS WITHIN CERTAIN DEFINED
BEACH AREAS LOCATED CONTIGUOUS TO GRAPE-
,�,,, VINE LAKE; DEFINING TERMS; PROVIDING EXCEP-
TIONS; PROVIDING FOR THE PLACING OF SIGNS
AND MARKERS; PROVIDING A PENALTY, PROVIDING
A SEVERABILITY CLAUSE; AND DECLARING AN
�"" EMERGENCY
WHEREAS, it has been determined that glass beverage containers pose a
threat of serious harm, injury and damage to persons, especially children, using
the beach area of Grapevine Lake located on property owned by the United
States Government under the supervision of the Department of the Army, Fort
Worth District Corps of Engineers located within the City limits of the City of
Grapevine, and
WHEREAS, after conducting public hearings on the matter of safety at
Grapevine Lake and after conferring with Representatives of the Fort Worth
District Corps of Engineers, the City Council has concluded that in the interest
of preserving and protecting the health, safety, morals and general welfare of
the citizens, it becomes necessary to pass an ordinance prohibiting the use and
possession of all types of glass beverage containers in, upon or within those areas
specifically designated herein;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
�,., Section l. Definitions:
(A) "Glass Beverage Container" means a container for the holding
�� of a liquid for drinking purposes, which container is made of
glass.
(B) "Beach Area" is defined as all of the area contiguous to
Grapevine Lake in the City of Grapevine, Texas, between 540'
mean sea level and the edge of the water of Grapevine Lake.
Section 2. (A) It shall be unlav,�ful for any person to use or possess any
glass beverage container in the beach area.
(B) The prohibition in Section 2(A) above shall not apply
where any such glass beverage container is used or possessed within the
immediate enclosed confines of any privately owned or operated business nor
inside a motor vehicle.
Section 3. The City Manager is directed to place prominent signs within
the beach area advising persons of the prohibition contained in this ordinance.
Section 4. Penalty. Any person violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof,
shall be fined $1.00 to $200.00; each day such violation continues shall constitute
�,,, a separate and distinct offense.
Section 5. Severability. If any section, sentence, phrase, word,
paragraph, or provision o this ordinance or the application of that section,
'�""" sentence, phrase, word, paragraph, or provision to any person, situation or
circumstance is for any reason adjudged invalid, the adjudication shall not affect
any other section, sentence, phrase, word, paragraph or provision of this
ordinance or the application of any other section, sentence, phrase, word,
paragraph, or provision to any other person, situation or circumstance nor shall
such adjudication affect any other section, sentence, phrase, word, paragraph or
provision of the Grapevine City Code. The City Council declares that it would
have adopted the valid portions and applications of this ordinance without the
invalid part, and to this end the provisions of this ordinance are declared to be
severable.
Section 6. E m ergency. The fact that the present ordinances and
regulations of the City o�Grapevine, Texas, are inadequate to properly
safeguard the health, safety, morals, peace and general welfare of the
inhabitants of the City of Grapevine, Texas, creates an emergency for the
immediate preservation of public business, property, health, safety and general
welfare of the public which requires that this ordinance shall become effective
from and after the date of its passage and it is accordingly so obtained.
