AN ORDINANCE AMENDING APPENDIX "A" OF THE
CITY CODE OF GRAPEVINE , TEXAS , SAME BEING
THE COMPREHENSIVE ZONING ORDINANCE BY
AMENDING THE MINIMUM FLOOR AREA REQUIRE-
MENTS IN THE MULTI-FAMILY DWELLING DISTRICT
CATEGORIES; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A PENALTY AND DECLARING AN EMERGENCY.

WHEREAS , the basic zoning ordinance of the City of Grapevine
was adopted to enhance and benefit the health, morals and general
welfare of the citizens and property owners of the City of Grape-
vine; and
WHEREAS , from time to time the Planning and Zoning Commission
recommends that certain specified changes and amendments be pro-
mulgated into the said basic zoning ordinance as same is cofified
in the Code of Ordinances for the City of Grapevine; and
WHEREAS , all of the necessary and required notices have been
complied with and public hearings held as required by State Law
and the City' s Code; and
WHEREAS, the Planning and Zoning Commission has submitted
its recommendations to the City Council that the basic Ordinance
be amended; and
WHEREAS, the City Council does find that the amendments are
in the best interests of the citizens and property owners and that
said amendments do enhance and benefit the health, moral and
general welfare of the citizens and property owners of the City
�,,,.� of Grapevine;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
�� CITY OF GRAPEVINE , TEXAS :
Section 1. The Basic Zoning Ordinance of the City of Grapevine
contained in the Grapevine City Code Appendix "A" is hereby amended
as follows :
Appendix "A" , Chapter 7 ,
Section 202 (7) ,
Floor Area: Every two-family dwelling hereafter erected, con-
structe , reconstructed, or altered in the "R-2" Dwelling District
shall have a minimum floor area, excluding common corridors base-
ments , open and screened porches , and garages , of not less than
six-hundred (600) square feet for each efficiency unit; seven-
hundred fifty (750) square feet for each one bedroom unit; nine-
hundred (900) square feet for each two-bedroom unit; and one-
thousand (1000) square feet for each three-bedroom unit .

Section 302 (6) ,
Floor Area: Every Multi-Family Dwelling hereafter erected, con-
structe , reconstructed, or altered in the "R-3" Dwelling District
�� shall have a minimum floor area, excluding common corridors , base-
ments , open and screened porches , and garages , of not less than
six-hundred (600) square feet for each efficiency unit; seven-
hundred fifty (750) square feet for each one bedroom unit; nine-
hundred (900) square feet for each two bedroom unit; and one-
thousand (1000) square feet for each three-bedroom unit .
Section 2 . Severability - If any section, article,
paragraph, sentence, clause, phrase or word in this ordinance,
or application thereto to any person or circumstances is held
invalid or unconstitutional by a Court of competent juris-
diction such holding shall not affect the validity of the re-
maining portions of the ordinance; and the City Council hereby
declares it would have passed such remaining portions of the
ordinance despite such invalidity, which remaining portions
shall remain in full force and effect.
Section 3 . Penalty - Any person violating any of the
provisions of this ordinance shall be deemed guilty of a mis- -
demeanor and upon conviction thereof shall be fined in a sum
not to exceed two hundred dollars ($200. 00) and a separate `
offense shall be deemed committed upon each day during or on
which a violation occurs or continues after the notice period
provided herein has expired. The Court shall order removal
and abatement of the nuisance.
Section 4. Emergency - The fact that the present zoning
ordinance and regulations of the City of Grapevine are in-
adequate to properly safeguard helth, safety, morals , peace
and general welfare of the inhabitants of the City of Grapevine,
creates an urgency and an emergency and in the preservation
of the public health, safety and welfare requires that this
ordinance shall take effect immediately from and after its
passage and the publication of the caption as the law and charter
in such cases provides .
