A RESOLUTION DETERMINING THE NECESSITY OF
ACQUIRING RIGHT-OF-WAY FOR PUBLIC STREET
PURPOSES AND EASEMENTS UNDER, OVER AND ACROSS
THE HEREINAFTER DESCRIBED LAND, AND
AUTHORIZING ITS CONDEMNATION AND/OR
APPROPRIATION TO BE USED IN CONNECTION WITH

LOOP 382 AND PROVIDING AN EFFECTIVE DATE

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE,
TEXAS:
Section 1 . That it is hereby determined that public
necessity requires the widening and improvements of Dallas Road
from State Highway 114 to Loop 382 and the City of Grapevine
should acquire right-of-way for public street purposes and an
easement under, over and across the land necessary for said
project.
Section 2 . That the property described in the attached
Exhibit "A" incorporated herein for all purposes is hereby
determined to be necessary for the above-mentioned project. That
for the purpose of acquiring right-of-way for public street
purposes and easements, over and across said property, the
Director of Public Works or such employee as he may designate, is
hereby authorized and directed to offer the sum of Twelve
Thousand Ninety-four pollars ($12, 094 . 00) for the hereinafter
described property as payment for right-of-way for public street
purposes and the easements acquired and full damages allowable by
law, which amount represents the fair cash market value of said
easements and the land to be acquired.
� j Section 3 . That the City of Grapevine determines to
appropriate right-of-way for public street purposes and easements
under, over and across said property for the purpose of widening
and improving Dallas Road from State Highway 114 to Loop 382 , as
authorized under the laws of the State of Texas and the
provisions of the Charter of the City of Grapevine.
Section 4 . The owner or party claiming an interest in said
property, and the legal description thereof, are as follows:
Owners: Omega Industries, Inc.
Gayle Perry, President
Tenant: None
Lienholder (s) : None
Legal Description: See attached Exhibit "A"
Section 5 . That, in the event the prvperty owner accepts

the offer made as authorized herein, the Director of Finance be
and is hereby authorized to draw a warrant in favor of the a ove
named owner in the amount of Twelve Thousand Ninety-four pollars
($12, 094 . 00) . This sum represents compensation in the amount of
Two Thousand Five Hundred Twenty-four pollars ($2,524 . 00) for
right-of-way for public street purposes to 0.0166 acres of land,
Nine Thousand Three Hundred Thirty Dollars ($9, 330 .00) for a
drainage easement and a permanent slope easement, and Two Hundred
Forty Dollars ($240 . 00) for a temporary construction easement to
the property, less oil, gas and sulphur. The total offer of
Twelve Thousand Ninety-Four pollars ($12 , 094 .00) represents
Twelve Thousarid Ninety-Four pollars ($12, 094 . 00) as value for the
right-of-way for public street purposes and easements to be
purchased with no payment being made for damages, if any, to the
remaining property.
Section 6 . That the necessary instruments of conveyance be
approved by the City Attorney as to form and subsequently filed
with the County Clerk and returned to the City Secretary for
permanent record.
Section 7 . That the City is to have possession of the
property on closing.
Section 8 . Should the employee designated to make the
�` � official offer report to the City Attorney that the hereinabove
named property owner has refused to accept the sum of money
offered by the City of Grapevine as compensation for the taking
�.:� of the subject land from said owner under the laws of eminent
domain, which amount the City Council deems to be fair cash
market value and just compensation, in compliance with the laws
of the State of Texas, this will be evidence that the City of
Grapevine cannot agree with the property owner as to the damages
legally allowable by law. In such case, the City Attorney is
authorized and requested to file the necessary suit (s) and take
the necessary action for the prompt acquisition of said property
in condemnation or in any manner provided by law.
Section 9 . That should it be subsequently determined that
additional persons other than those named herein have an interest
in said property, then in that event, the City Attorney is
authorized and directed to join said parties as Defendants in
said condemnation suit (s) .
Section 10. That this resolution shall become effective
from and after the date of its passage.

BEING 0.0166 acres of land situated in the Wm. Dooley Survey, Abstract 422,
and the E. Moore Survey, Abstract 1029, Tarrant County, Texas, and being part of
the same land as described in a deed from Trader House Properties, Inc. , to
Omega Industries, Inc. , dated August 26, 1982 and recorded in Volume 7496, Page
2286 of the Deed Records of Tarrant County, Texas, said 0.0166 acres of land
being more particularly described by metes and bounds as follows:
BEGINNING at a 1/2" iron rod found for the Southwest corner of said Omega
tract, said point being at the intersection of the West boundary line of said
Omega tract and the existing North right-af-way line of Dallas Road;
THENCE North 00° 04' 00" West, a distance of 5.29 feet with the West boun-
dary line of said Omega tract to a 1/2" iron rod set for corner in the proposed
North right-of-way line of Dallas Road (90.00' R.O.W.);
THENCE North 8E° 03' 20" East, a distance of 19.02 feet with the proposed
North right-of-way line o£ said Dallas Road parallel with and 45 feet from the
proposed centerline of said Dallas Road to a 1/2" iron rod set at the beginning
of a curve to the right whose functions are as follows: an angle of 07° 53' 08",
a radius of 999.93 feet, a tangent of 68.92 £eet, a length of 137.62 feet and
whose chord bears North 89° 59' S5" East, a distance of 137.51 feet;

BEING a 0.2324 acre drainage easement situated in the William Dooley Survey,

Inc. to Omega Industries, Inc., dated August 26, 1982, and recorded in Volume

of land to be more particularly described by metes and bounds as follows:
BEGINNING at a point for corner at the intersection of the existing North
right-of-way line of Dallas Road and the proposed North right-of-way line of
Dallas Road, said point for corner being South 87° 34' S8" East, a distance of
156.62 feet from a 1/2" iron rod found for the existing Southwest corner of the
above referenced Omega Industries, Inc. tract and being in a curve to the left
whose functions are as follows: an Angle of 04° 47' 41", a Radius of 999.93
feet, a Tangent of. 41 .86 feet and whose chord bears North 88° 27' 22" West, a
distance of 83.65 feet; .
THENCE in a Northwesterly direction with said curve to the left and the pro-
