RESOLUTION NO. g7-�4
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS, APPROVING AND ADOPTING
WAGE RATES FOR STREET, DRAINAGE AND UTILITY
CONSTRUCTION PROJECTS WITHIN THE CORPORATE
LIMITS OF THE CITY OF GRAPEVINE, TEXAS;

PROVIDING FOR AN EFFECTIVE DATE.
� WHEREAS, Article 1175 of Vernon' s Annotated Texas Civil
Statutes ( "V.A.T.C.S. " ) empowers cities adopting charters or
amendments thereto with full power of local self-government; and
WHEREAS, Article 1175 (16) V.A.T.C.S. specifically
empowers home rule cities with: ( i ) the exclusive dominion,
control and jurisdiction in, over and under the public streets,
avenues, alleys, highways and boulevards, and public grounds of
such cities, and ( ii ) the authority to provide for the
improvement of any public streets, alleys, highways, avenues or
boulevards by paving, raising, grading, filling or otherwise
improving the same; and
WHEREAS, Section 4 of Article 5159a V.A.T.C.S. provides,
in part, that any construction or repair work done under
contract and paid for in whole or in part out of public funds,
other than work done directly by any public utility company
pursuant to order of the Railroad Commission or other public
authority, whether or not done under public supervision or
direction, or paid wholly or in part out of public funds, be
held to be "public works" ; and
��� WHEREAS, Section 1 of Article 5159a V.A.T.C.S.
specifically requires that not less than the general prevailing
rate of per diem wages for work of a similar character in the
locality in which the work is performed, and not less than the
general prevailing rate of per diem wages for legal holiday and
overtime work, be paid to all laborers, workmen and mechanics
employed by or on behalf of the State of Texas, or by or on
behalf of any county, city and county, city, town, district or
other political subdivision of the State, engaged in the
construction of public works, exclusive of maintenance work; and
WHEREAS, Section l, Article 5159a V.A.T.C.S. further
specifies that laborers, workmen and mechanics employed by
contractors or subcontractors in the execution of any contract
or contracts for public works with the State, or any officer or
public body thereof, or in the execution of any contract or
contracts for public works, with any county, city and county,
city, town, district or other political subdivision of this
State, or any officer or public body thereof, be deemed to be
employed upon public works; and
WHEREAS, Section 2 of Article 5159a V.A.T.C.S. requires
the public body awarding any contract for public work on behalf
of the State, or on behalf of any county, city and county,
�"`� city, town, district or other political subdivision thereof, to
ascertain the general prevailing rate of per diem wages in the
locality in which the work is to be performed for each craft or
� type or workman or mechanic needed to execute the contract,
also the prevailing rate for legal holiday and overtime work;
and
WHEREAS, Section 2 Article 5159a V.A.T.C.S. further
declares it to be mandatory upon the contractor to whom the
contract is awarded, and upon the subcontractors under the
contractor, to pay not less than the specified rates to all
laborers, workmen and mechanics employed by them in the
execution of the contract; and
WHEREAS, the City Council of the City of Grapevine, Texas
(hereinafter referred to as the "City" ) is a home rule city and
is subject to the wage restrictions imposed by Article 5159a
V.A.T.C.S. for the construction of public works; and
WHEREAS, the City Council of the City deems it necessary
and expedient to provide wage rates for street, drainage and
utility construction projects within corporate limits of the
City.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1 . That all of the above premises are found to
be true and correct and are incorporated into the body of this
Resolution as if copied in their entirety.
Section 2 . That the City Council of the City hereby
approves and adopts the wage rates for street, drainage and
utility construction projects as set forth on Exhibit "A"
attached hereto, which Exhibit "A" is incorporated herein for
all purposes .
Section 3 . If any section, article, paragraph,
sentence, clause, phrase or word in this Resolution, or
application thereto any person or circumstances is held invalid
or unconstitutional by a Court of competent jurisdiciton, such
holding shall not affect the validity of the remaining portions
of this Resolution; and the City Council hereby declares it
would have passed such remaining portions of this Resolution
despite such invalidity, which remaining portions shall remain
in full force and effect.
Section 4. This Resolution shall be in full force and
� effect from and after its passage, and it is accordingly so
resolved.

Prevailing Rate Determined as provided for in Davis-Bacon Regulat.ions.
Sec. 1.2 Definition
The "prevailing wage" shall be the wage paid to the majority (more than SO
� percent) of the laborers or mechanics in the classification on similar projects
in the area during the period in question. If the same wage is not paid to a
majority of those employed in the classification, the "prevailing wage" shall be
the average of the wages paid , weighted by the total employed in the
classification.
