I A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TARRANT COUNTY, TEXAS,
REQUESTING THAT THE TEXAS LEGISLATURE IN ITS
1989 LEGISLATIVE SESSION ADOPT AN ACT
AUTHORIZING CITIES TO PROTEST THE APPRAISED
VALUE OF PROPERTY BEFORE THE APPRAISAL REVIEW

' BOARD AND PROVIDING AN EFFECTIVE DATE
� WHEREAS, when the Texas Property Tax Code was adopted in
I 1982, the Texas Legislature specifically gave taxing units such
�� as Grapevine the ability to protest the appraised value of
property within its corporate limits before the appraisal review
board; and
i WHEREAS, on January 1 , 1984, the Legislature prohibited
taxing units from protesting the appraised value of properties
i citing as a reason the fact that appraisal review boards would be
inundated with protests from taxing units; and

WHEREAS, passage of the Act, a copy of which is attached

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
� CITY OF GRAPEVINE, TEXAS:
I� * Section 1 . That the City Council hereby adopts and
recommends for approval by the 1989 Session of the Texas
Legislature the Act attached hereto as Exhibit "A" , allowing the
City to protest the value of property before the appraisal review
board.
' Section 2 . That the Mayor and the City Manager are hereby
! authorized and directed to forward a copy of this resolution to
� the appropriate legislators and legislative committees in order
�� to have said Act adopted by the Texas Legislation.
I�I Section 3. That this resolution shall become effective from
' and after the date of its passage.

A BILL TO BE ENTITLED
AN ACT
I
Relating to the ability of a taxing unit to appeal the
appraised value of property.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
' Section 1 . Section 134, Chapter 13, Acts of the 67th
Legislature, First Called Session, 1981 (Texas Property Tax Code,
Section 41 . 03) is hereby amended by amending Section 41. 03 (1) of
the Property Tax Code, which shall read as follows :
" (1) a determination of the appraised value of
'� property or, in the case of land appraised provided in
Subchapter C, D, or E, Chapter 23 of this code, a
� determination of its a praised value or market value" ;
Section 2. If any word, phrase, clause, paragraph,
sentence, part, portion, or provision of this Act or the
application thereof to any person or circumstance shall be held
, ,e to be invalid or unconstitutional, the remainder of this Act
shall nevertheless be valid, and the Legislature hereby declares
that this Act would have been enacted without such invalid or
unconstitutional word, phrase, clause, paragraph, sentence, part,
portion, or provision. All of the terms and provisions of this
Act are to be liberally construed to effectuate the purposes,
powers, rights, functions, and authorities herein set forth.
Section 3. The importance of this legislation and the
crowded condition of the calendars in both houses creates an
emergency and an imperative public necessity that the
constitutional rule requiring bills to be read on three separate
days in each house be suspended, and this rule is hereby
suspended, and that this Act take effect and be in force from and

' after its passage, and it is so enacted.
