A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS, RATIFYING AND APPROVING
THE VERBAL AGREEMENT ENTERED INTO WITH
TRUMBULL ASPHALT FOR THE PURCHASE OF LIQUID
°� ASPHALT CEMENT TO BE USED IN SEAL COATING
STREETS WITHIN THE CITY AT A PRICE OF $ 0.60
PER GALLON; AUTHORIZING THE CITY MANAGER TO
� ENTER INTO A CONTRACT WITH TRUMBULL ASPHALT
FOR THE PURCHASE OF LIQUID ASPHALT CEMENT AT
A PRICE OF $ 0.57 PER GALLON AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the City of Grapevine, Texas, (the "City") sought
competitive bids for the purchase of approximately 50, 000 gallons
of liquid asphalt cement (Type AC-10) to be used in the seal
coating process on designated roadways within the City; and
WHEREAS, bid packets were sent to seven companies but only
one bid was received and opened on April 6, 1988, the deadline
for receiving bids; and
WHEREAS, the sole bid received by the City on April 6, 1988,
was from Wright Asphalt Products Co. , which bid was insufficient
for the reason that the price quoted was made subject to change
without notice; and
WHEREAS, as part of its preventative maintenance program,
the City has planned to apply liquid asphalt cement to
approximately fifty-one streets within the City during the summer
months of 1988 (the "project") ; and
WHEREAS, application of the liquid asphalt cement must occur
during the hottest months of the year; and
WHEREAS, subsequent to the bid opening, the City received a
negotiated bid from Wright Asphalt Products Co. for the price of
$ 0.5645 per gallon, firm for one day, and from Trumbull Asphalt,
a Division of Owens-Corning Fiberglass Corporation ("Trumbull
Asphalt") for the price of $ 0.57 per gallon, firm for ninety
days, both of which negotiated bid prices are made subject to any
Texas Railroad Commission mandated increase in hauling rates and
the City desires to enter into a contract for that amount; and
WHEREAS, the purchase of the liquid asphalt cement is
necessary to preserve the public health and safety of the City's
residents; and
WHEREAS, because the liquid asphalt cement must be applied
within the next two months, an emergency existed which required _
the liquid asphalt cement to be purchased without further
compliance with the competitive bidding process; and

WHEREAS, due to the necessity of commencing the pro�ect
without further delay, a negotiated verbal agreement was
entered into on August 8, 1988, between the City and Trumbull
Asphalt for the purchase of liquid asphalt cement at a price of
$ 0. 60 per gallon, plus any Texas Railroad Commission mandated
increase in hauling rates; and
WHEREAS, the City Council desires to ratify and approve this
agreement entered into by the City with Trumbull Asphalt for the
purchase of liquid asphalt cement at a price of $ 0. 60 per
gallon, plus any Texas Railroad Commission mandated increase in
hauling rates.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1. That all of the matters stated in the preamble of
this resolution are hereby incorporated into the body of this
resolution as if copied in their entirety.
Section 2 . The City Council hereby ratifies and approves the
` � agreement entered into with Trumbull Asphalt for the purchase of
liquid asphalt cement at a price of $ 0. 60 per gallon, plus any
Texas Railroad Commission mandated increase in hauling rates.

Section 3 . The City Council hereby authorizes the City
Manager to enter into a contract with Trumbull Asphalt for the
purchase of liquid asphalt cement to complete the project at a
price of $ 0.57 per gallon, which price is firm for ninety
(90) days, plus any Texas Railroad Commission mandated increase
in hauling rates.
Section 4. This resolution shall be effective immediately
from and after its passage and approval by the City Council.
