ATNE TO `�I�E PURCHASE OF A NINET�-FNE FOOT QUIN-
TUPLE LADDER FIRE TRUCK FROM THE LOWEST, RESPON-
SIBLE BIDDE�i, AFTER CONSIDERA'➢.'ION OF ALL EVIDENCE
PR,E�ENTED ON THE QUESTION OF THE PURCHASE PURSUANT
TO TEX. R]EV. CN. STAT. ANN., AR.T. 2368a; APPROVING THE
"�`°�' PU]R.CHASE OF SAID FIRE TRUCK FRO1�7 �Z.IGGS FIRST LINE
EQUIPMENT; PROVIDING A SEVIERABILTY CLAUSE AND DE-
CLARING AN EM�RGENCY.

WHEREAS, the City Council did authorize the City staff to advertise for
competitive bids for the purchase of a ninety-five foot quintuple ladder fire
truck ("fire truck") in accordance with Tex. Rev. Civ. Stat. Ann., art. 2368a; and
WHEREAS, competitive bids were sought after a.l.l public notice and other
requirements of Tex. Rev. Civ. Stat. Ann., art. 2368a had been complied with;
and
WHEIZEAS, Sutphen Corporation submitted the lowest bid on the fire
truck in the amount of $405,833.00 and Riggs First Line Equipment submitted
the second lowest bid on the fire truck in the amount of $407,093.00; and
WHEREAS, Riggs First Line Equipment submitted the lowest and best
delivery date at 150 to 180 days and Supthen Corporation submitted the second
lowest delivery date at 365 days; and
WHEREAS, the bid of Riggs First Line Equipment provides for climbing
rails as an integral design of the aerial devise, a critical featu�e included in the
bid specifications of the City, while the bids submitted by Supthen Corporation
provided for climbing rails as add-ons; and
� � WHEREt�S, Riggs First Line Equipment has the ability to offer efficient
and complete service of the fire truck and has a service truck available 2� hours
�.,� a day; and
WHEREAS, the City staff has concluded that the second lowest bidder,
�.iggs First Line Equipment, is the lowest, responsible bidder due to its ability
to deliver the fire truck in significantly less time and in that t1�e features of the
Ri�gs First Line Equipment fire truck more substantially meets the needs of the
City as specif'ied in the City's bid specifications; and
WHEREAS, the City Council has conc�uded, based on all oi the evidence
presented, that the lowest, re�ponsible bidder for the purchase of a ninety-five
foot quintuple ladder fire truck is R,iggs First Line Equipment.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CI'i'Y OF G�i.APEVINE, TEXAS:
�ection 1. That all of the statements contained in the prearnble are
found to be true and correct and are hereby incorporated into the body of this
resolution as if copied an their entirety.
Section 2. That the purchase of the ninety-five foot quintuple ladder
fire truck is awarded to Riggs First Line Equipment in the arnount of
�E,�, $407,093.00, and the City Council finds that Ri�gs First Line Equipment is the
lowest, responsible bidder.
Section 3. If any section, article, paragraph, sentence, clause, phrase or
'�"� word in this resoiution or application thereto any person or circurnstances is held
invalid or unconstitutional by a Court of competent jurisdiction, such holding
shall not affect the validity of the remaining portions of this resolution; and the
City Council hereby declares it would have passed such remaining portions of the
resolution despite such invalidity, which remaining portions shall remabn in full
force and effect.
Section 4. The fact that the present resolutions and regulations of the
City of Grapevine, Texas, are inadequate to properly safeguard the health,
safety, morals, peace, and general welfare of the inhabitants of the City of
Grapevine, Texas, creates an emergency for the immediate preservation of the
public business, property, health, safety, and general welfare of the public which
requires that this resolution become effective from and after the date of its
passage and it is accordingly so resolved.
