HomeMy WebLinkAboutRES 1986-033 CITY OF GRAPEVINE, TEXAS RESOLUTION NO. 86-33 A RESOLUTIOIV FINDING THAT AN EMER.GENCY EXISTED ON OR ABOUT JULY 31, 1986 AT T�IE CITY'S WATER TR.EATPdIENT ,,�_ , PLANT NECESSITATING THE LETTING OF A CONTRACT TO GEI�TERAL ELECTRIC CORPOR,ATI�N FOR THE PURCHASE AND II�TSTALLATION OF A HIGH SERVICE WATER PUMP FOR THE AMOUNT OF $7,413.00; NEGATING THE NECESSITY TO AD- �`" VEI�,TISE FOR COMPETITNE BIDS AND R,ATIFYING ALL AC- TIONS TAKEN BY THE CITY STAFF IN AWARDING SAID COIVTRACT AND DECLAR.ING AN EMERGEIVCY. WHEREAS, on July 31, 1986 a high service water pump at the City's water treatment plant broke down, and the pump was not repairable; anc� WHEREAS, it was imperative to preserve the City's property and to protect the citizen's health and welfare in furnishing a water supply that the pump be replaced immediately without complying with the competitive bidding requirements of Tex. Rev. Civ. Stat. Ann. Art. 2368a; and WHEREAS, the City Staff received a bid from General Electric Corporation to replace the damaged water pump and install same promptly for $7,413.00, a cost that is found to be reasonable and within the market value for said water pump; and WHEREAS, a contract was let in the amount of $7,413.00 to General Electric Corporation to replace the damaged water pump with a new water pump and same was done in a satisfactory manner and General Electric Corporation was paid in full; and ,�.�,. � T�'HEREAS, the City Staff has requested the City Council to find that an �� �mergency did exist, that it was valid, legal and correct to waive the statutory competitive bidding requirements and to ratify all actions of the City Staff relative to the awarding of said contract; and d'�HEREAS, the City Council so finds. NOW, THEREFOR,E, BE IT R.ESOLVED BY TI�E CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters sealed in the preamble are found to be true and correct and are incorporated into the body of this Resolution as if copied in their entirety. Section 2. That the City Council does hereby find that an emergency did exist at the water treatment plant on July 31, 1986 and that all actions taken by the City Staff in awarding a contract to the General Electric Corporation in the amount of $7,413.00 are in all things approved and ratified. Section 3. The fact that the present resolutions and re�ulations of the City of Grapevine, Texas, are inadequate to properly safeguard the heaith, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the �""`�° public business, property, health, safety and general welfare of the public which requires that this resolution become effective from and after the date of its passage and it is accordingly so resolved. �:._ PASSED AND APP}ZOVED this the 19� day of August , �986.
