A RESOLLTTION OF THE CIT�' COUNCIL OF THE CITg' OF
GRAPEVINE, TEXAS, IN OPPOSI'i'ION TO ANY LEGISLATION
WHICIi WOULD ALLOW A TELECOMMUNICATIONS UTILITY TO
CHARGE A R,ATE FOR CALLS QRIGINATING AND TERMI-
NATING WITHIN THE SAME LOCAL CALLING AREA OR WITHIN
AN EXTENDED SERVICE AREA OF A MUNICIPALITY IF THE
RATE IS BASED QN THE DURATION, DISTANCE, OR TIME OF
DAY OF A CALL; DIRECTING A COPY OF THIS RESOLUTION BE
SENT TO APPROPRIATE LEGISLATORS; PROVIDING FOR AN
EFFECTIVE DATE UPON PASSAGE AND APPROVAL
�rVHEREAS, House Bill 909 prohibits a telecommunications utility pro-
viding local exchange telephone service within a certified exchange area from
charging a rate for calls originating and terminatin� within the same local
calling area if the rate is based on the duration, distance, or time of day of a
call; and
WHEREAS, as presently written, House Bill 909 would effectively permit
the charging of a rate for calls in an extended service area of a municipality
even if the rate is based on the duration, distance, or time of day of a call; and
WHEREAS, the effect of any legislation which would allow the charging
of a rate for such calls within an extended service area would be contrary to
the policy of this State to protect the public interest and having adequate and
efficient telecommunciations service available to all citizens of the State at
just, fair, and reasonable rates; and
WI-�EREAS, the City of Grapevine, Texas, (the "City"), in the interest of
its citizer�s, and for the good of the community, opposes any legislation which
would allow the charging of a rate for calls originating and terminating within
the same local �alling area, or within any extended service area, if the rate is
based on the duraYion, distance, or time of day of a call.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL O]E THE
' C;ITY �F GRAPEVINE, TEXAS:
�ection l. That all of the findings contained in the preamble of this
Resolution are found to be true and correct and the City Coun,�il does hereby
incorporate said findings into the body of this Resolution as if copied in their
entirety.
�ection 2. That by passage of this Resolution, the City of Grapevine,
Texas, expresses its opposition to any legislation which would allow the charging
of a rate for calls originating and terminating within the same local calling area,
or within an extended service area of a municipality, if the rate is based on the
d�ration, distance, or time of day of a call.
�ection 3. That a copy of this Resolution be sent to each of those
Representatives and Senators who represent the City, to-wit: Representative
Charles Evans and Senator Bob McFarland.
5ection 4. That this Resolution be in full force and effect from and
af'ter its passage and approval.
