RESOLUTION NO. 84-25
A RESOLUTION IP�ZPOSING A FOR.TY-FNE (45) DAY MORA-
TORIUM ON THE ISSUANCE OF BUILDING PERMITS IN CERTAIN
DEFINED AREAS BY MUTUAL AGREEPJIENT BETWEEN THE CITY
AND THE OWNERS OF THE PROPERTY
� WHER�AS, the Planning and Zoning Commission, City Staff and City
Council have been engaged in the adoption of a new Zoning District Map for the
entire City pursuant ta City Ordinance No. 82-73, the Comprehensive Zoning
� Ordinance; and
WHEREAS, the Public I�earing has been concluded and the Planning and
Zonin� Commission has made its recommendations; and
WHER.EAS, during this process, the City has imposed through the passage
of Resolution Number 83-34, and subsequent amendments, a Moratoriurn on the
issuance of Building Permits that encompassed certain property that was zoned
in a manner inconsistent with the City's 1980 Land Use P✓Iaster Plan; and
WHEREAS, the Moratorium runs through May 3, 19�4, at which time it
expires; and
WHEREAS, the owners of certain property (the "Owners") have requested
the City to readvertise the zoning case as it affects their property in order to
allow the owner to present evidence in support of additional uses and to allow
the Planning and Zonin� Commission and City Council to consider the additional
Zoning Districts; and
WHEREAS, said Owners have agreed to the imposition of a Moratorium on
the issuance of Building Permits for � forty-five (�5) d�y period under �ertain
conditions; and

WHEREAS, the City Council is agreeable to the request tc readvertise
conditioned upon the voluntary aareement by the Owners to allow and authorize
the City to impose a Moratorit�m on the issuance of Building Permits for a forty-
five (45) day perioc�.
`I'HEREFORE, BE IT RESQLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE:
Section l. That a voluntary Nioratorium is hereby imposed on the
issuance of any Building Permits for the property described in the attached
� Exhibits in accordance with the terms of the attached letters which are hereby
accepted and the sworn testimony of the owner or his representative stibmitted
during the Public Hearing for a period of forty-five (a5) days from M�.y 4, 1984
through June 18, 1984. Di�ring said period of time City officials shall issue no
Btailding Permits for all or any portion of the property described in said Exhibits.
Section 2. That this Resolution shall become effective from and after
its passage.

The undersigned (hereinafter referred to as "Owner") is the awner of the above-
described parcel(s) located within the City limits of the City of Grapevine,
Texas.
Subject parcel(s) is being considered for rezoning by the City Council after
receipt of a rec�ndation frcgn the Planning & Zoning Commission, pursuant to
and in accordance with the City of Grapevine's Co�rehensive Zoning Ordinance
No. 82-73, and Tex. Rev. Civ. Stat. Ann. Art. 1011a-1011e.
The descri.bed parcel(s) is subject to a mpratorium relative to the issuance of
building perniits instituted by the passage of Resolution No. 83-34 passed on
September 6, 1983. The moratoritun was extended through May 3, 1984 by the pass-
age of Resolutions No. 84-03 and 84-11.
Owner requested the City to readvertise the zoning case and send out the statu-
tory notice to allaw consideration of additional and less-restrictive zoning
district categories for subject parcel(s) . It is est�mated that it will take
approximately 45 days to process such a zoning case.
The awner hereby irrevocably consents and authorizes the City to impose and/or
extend a mpratoriLun on the issuance of any building permits for the above
described parcel(s) conditioned upon the City instituting a new zoning case
within 10 days of May 3, 1984 for a period of 45 days running from N1ay 4, 1984
through June 18, 1984.
The agreed moratoritun will expire automatically, ipso facto, at the end of the
45 day period unless extended by mutual agreement of the City and the under-
signed.
