RESOLUTION NO. 83--24
A RESOLUTION AWARDING A CONTRACT FOR THE PURCHASE
OF AN IBM SYSTEM/36 COMPUTER SYSTEM FROM IBM CORP-
ORATION; FINDING THAT AN EMERGENCY AND URGENT
PUBLIC NECESSITY EXISTS THAT NECESSITATES THE PUR-
� CHASE OF SUBJECT EQUIPMENT; FINDING THAT THE CITY'S
EXISTING SYSTEM IS COMPATIBLE FROM AN ECONOMIC AND
REALISTIC STANDPOINT TO BE IMPROVED UPON AND MODI-
�"""' FIED BY THIS SUBJECT EQUIPMENT DUE TO ITS UNIQUE
CHARACTERISTICS; FINDING THAT THE PR,INCIPAL AMOUNT
OF THE CONTRACT AS BID IS THE LOWEST COMPETITIVE
PRICE IN THE MARKET PLACE FOR THIS TYPE OF EQUIP-
MENT; FINDING THAT THE SAVINGS TO THE CITY AND ITS
TAXPAYERS ARE SUBSTANTIAL; PROVIDING A SEVERABILITY;
AND DECLARING AN EMERGENCY
WHEREAS, in August of 1979 the City authorized and did purchase an
IBM System/34 Computer System which system has been upgraded to the systems
limit of 256 Kb of inemory and 256 Mb oi mass storage; and
WHEREAS, it was initially anticipatc�d that the above described upgrading
would be sufficient to ��idress the City's need in the foreseeable future; and
WHERLAS, the City's needs for this type of equipment have increased
dram�t��:ally and it is necessary to expand the systems capabilities to meet the
c�r�moin� and ever increasing needs of the City's citizens; and
Fi`IHEREAS, the City Staff that works with the computer system daily and
,� has ex�erienced the problems brought about as a result of the rapid growth has
concluded that the needs of the City create an emergency condition and an
urgent public necessity to immediately purchase equipment to expand the system
�""` and the City Council so agrees and finds; and
WHEREAS, the IBM System/36 is the logical migration path for the City
due to its cost, its capacity, its speed and the fact that System/34 is directly
upgradable to System/36 which eliminates the conversion cost; and
WHEREAS, the City Council finds that the said System/36 has unique
characteristics that are not found in other equipment in so far as a conversion
is concerned; and
WHEREAS, the City Council finds that the sales price bid by IBM
Corporation for the System/36 with all attachments is the lowest and best bid
available in the market place and the City, its citizens and its taxpayers savings
are substantial.
NOW, �''HEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF G�;�yPEVINE:
Section 1. That all of the statements contained in the preamble are
found to be true and correct and are incorporated herein as if copied in their
entirety in the body of this Resolution.

Section 2. That the City Council does hereby find, based on the above
recited facts, that all competitive bidding requirements of State Law have been
�„ duly and reasonably satisfied and that the bid of IBM Corporation for a
System/36 capacity system, which system is described in detail in the bid
proposal which proposal is incorporated by reference into the body of this
Resolution, is the lowest and best bid and that the City does hereby award a
contract to IBM Corporation for the following amount:
System/36-1
All required attachments $79,500
Less Discount 23,000
Net Amount $56,5U0
�„ Section 3. Severability. If any section, article, paragraph, sentence,
clause, phrase or word in this ordinance, or application thereto to any person or
circumstance is held invalid or unconstitutional by a Court of competent
' jurisdiction such holding shall not affect the validity of the remaining portions
'�"""'' of the ordinance; and the City Council hereby declares it would have passed such
remaining portions of the ordinance despite such invalidity, which remaining
portions shall remain in full force and effect.
Section 4. Emergency. The fact that there is an immediate and
urgent need to purchase an IBM/36 Computer equipment, creates an urgency an.`',
an emergency in the preservation of the public health, safety and welfare
requires that this resolution shall take effect immediately from and after its
passage.
DULY PASSED by the City Council of the City of Grapevine, Texas, this
