RESOLUTION NO. 80-27
A RESOLUTION FINDING THAT A PUBLIC NEC-
ESSITY AND NEED EXISTS FOR THE CITY TO
ACQUIRE AN EASEMENT FOR SANITARY SEWER
PURPOSES ON, OVER AND ACROSS THE PROP�
ERTY DESCRIBED IN THE BODY OF THE RESO-

ING THE CITY ATTORNEY TO FILE CONDEM-
' NATION PROCEEDINGS

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE,
TEXAS:
Section 1. That the City Council does hereby find that a public necessity
and need exists in the City in order for the City to improve and expand its
sanitary easement for sanitary sewer purposes, both a permanent easement and
a construction easement on, over and across all of that lot, tract or parcel of
land situated within the City limits of the City of Grapevine, Tarrant County,
Texas, and described in Exhibit "A" which is attached hereto and incorporated
herein for all purposes from the owners of the property:
Lois S. Martin and Margaret Minor Schilken.
Section 2. The sanitary sewer easement to be acquired is for the purpose
�, of constructing, reconstructing and maintaining a sanitary sewer line and
necessary appurtenances in, under, over, upon and across the property described
in Exhibit "A".
Section 3. The City Manager is instructed to offer the owners the sum of
$ 1,000.00 as cost consideration for the easement. In the event the owners
reject the offer, the City Attorney is directed to file a condemnation suit in
Tarrant County, in order to permit the City to obtain the easement pursuant to
its power of eminent domain.

"EXHIBIT A" for Resolution No. 80-27
PERMANENT EASEMENT
Beginning at a point that bears Westerly a distance of 2 .5

feet from a fence corner adjacent to College Street, being
the Northeast corner of said tract;
THENCE: S 24° 20 ' W, a distance of 69.7 feet, more or
�� less, to a point;
THENCE: S 16° 22 ' E, a distance of 83. 4 feet, more or
less, to a point;
THENCE: S 02° 12 ' W, a distance of 91. 5 feet, more or
less, to a point;
THENCE: S 30° 13 ' E, a distance of 14 .5 feet, more or
less, to a point on The East property line, and
end of easement.
Said permanent easement being 10 feet in width, and 259.1
feet in length, measured along the centerline of said ease-
ment.
CONSTRUCTION EASEMENT

In addition to the permanent easement as described above, an
additional construction easement is to be furnished. This
�' easement will lie adjacent and parallel to the West side of
the ten foot permanent easement. Being 25 feet in width
and 275 feet in length, more or less , for initial construc-
tion purposes only.
