RESOLUTION NO. 75-34
WHEREAS, it was deemed necessary by the City Council
of the City of Grapevine, Texas, to collect delinquent
taxes owed to the City of Grapevine; and

WHEREAS, in order to collect said delinquent taxes,
it was found necessary to employ an attorney to collect
same;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF GRAPEVINE, TEXAS:
SECTION 1. That the Mayor be, and he is hereby
directed to execute the contract for the collection of
delinquent taxes between the City of Grapevine and John
F. Boyle, Jr. , said contract being attached hereto and
made a part hereof.
SECTION 2. That this resolution shall take effect

from and after its date of passage and it is accordingly
so ordered.

CONTRACT ROR CALLECTION OF DELINQUENT TAXES

This CONTRACT is made and entered into by and between
the CITY OF GRAPEVINE, TEXAS, acting herein by and through its
� governing body, the City Council, hereinafter called "F'irst
Party" , and JOHN R. BOYLE, JR. , Attorney at Law, 1313 Fidelity
Union Life Building, Dallas, Texas, hereinafter called
"Second Party" .
I.
First Party agrees to employ, and does hereby employ,
Second Party to enforce by suit or otherwise the collection of
all delinquent taxes, penalty and interest owing to Rirst
Party, the accounts of which First Party turns over to Second
Party for collection. First Party agrees to turn over all
real and personal property delinquent accounts that are two (2)

years or more years delinquent.

II .
Second Party is to call to the attention of the Collector
or other officials any errors, double assessments or other dis-
crepancies coming und�r his observation d uring the progress of
the work, and is to intervene on behalf of First Party in all
suits for taxes hereinafter filed by any taxing unit on
property located within its corporate limits, condemnation
suits and bankruptcy suits.
III .
First Party agrees to furnish delinquent tax statements
to the Second Party on all property within the taxing jurisdic-
� tion. Second Party shall make certain that the forms for said
statements shall be sufficient to collect the delinquent taxes
assessed, and shall be responsible for determining that penalty
and interest has been correctly computed on statements before
such statements are filed with any suit for the collection of
the taxes assessed thereon.
IV.
Second Party agrees to file suit and reduce to judgment
and sale the vacant and uninhabited property located within
the taxing jurisdiction, provided Rirst Party will furnish the
necessary data and information as to the name, identity and
location of the necessary parties, and legal description of
the property to be sold. Second Party agrees to sue for re-
;� covery of the costs as court costs as provided by Article 7345b,
Section 6, Revised Civil Statutes of Texas.
V.
First Party agrees to advance the necessary court costs
deposits for the filing of any suit for collection of the
delinquent taxes as required by the court in which said suit
is filed, and Second Party agrees to sue for recovery of said
costs as court costs, as provided by law.
VI .
Second Party agrees to make progress reports to First

Party on request, and to advise First Party of all cases wherein
investigation reveals taxpayers to be financially unable to pay
their delinquent taxes.
VII .
First Party agrees to pay to Second Party as compensation
for services required hereunder fifteen per cent (15%) of the
amount collected of all delinquent taxes, penalty and interest
of the years covered by this contract, actually collected and
paid to the Collector of Taxes during the term of this contract
as and when collected, whether suit has actually been filed
thereon or not. Al1 compensation above provided for shall be-
come the property of the Second Part at the time payment of
taxes, penalty and interest is made to the Collector. The
�,,,,, Collector shall pay over said funds to Second Party monthly
by check.
VIII.
This contract is drawn to cover a period of two (2)
years beginning the day of , 197 ,
and ending the day of , 197 ,
provided, however, that Second Party shall have an additional
'"'�'' six (6) months to reduce to judgment all suits filed prior to
ii�r the date last mentioned. In consideration of the terms and
compensation herein stated, Second Party herein hereby accepts
said employment and undertakes the performance of this contract
as above written. This contract is executed on behalf of First
Party by the presiding officer of its governing body, who is
authorized to execute this instrument by order heretofore
passed and duly recorded in the Minutes of the City Council of
the City of Grapevine.
IX.
Either party may cancel this contract upon giving the
other party sixty (60) days written notice.
