ORDINANCE NO. 79-40
AN ORDINANCE OF THE CITY OF GRAPEVINE , TEXAS , REQUIRING
ALL NEW CONSTRUCTION OF SINGLE FAMILY RESIDENCES AND
MULTI-FAMILY DWELLINGS TO INCORPORATE CERTAIN SPECIFIED
SAFETY FEATURES RELATING TO COMPOSITION OF WOOD DOORS ,
0PDEAD BOLT LOCKS , SECONDARY LOCKING DEVICES AND KEY
OPERATED LOCKING DEVICES; PROVIDING AN EFFECTIVE DATE ;
PROVIDING A SEVERABILITY CLAUSE ; PROVIDING A PENALTY AND
DECLARING AN EMERGENCY.
WHEREAS , based upon recommendations of the Grapevine Police
Department, the City Council has concluded that the danger of
burglaries and crimes against persons in areas around single family
and multi family dwellings could be lessened by requiring certain
safety features in the doors leading into said dwellings , and
WHEREAS , the City Council has concluded that such requirements
would not render any undue economic hardship on the citizens of this
City but would tend to enhance and improve the quality of life , and
WHEREAS , the City Council has concluded that it is in the best
interest of the citizens of this City and will tend to benefit the
health, morals and general welfare of this community to approve
such provisions .
NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE , TEXAS :
Section 1. All new construction of single family and
multi-family dwellings (multi-family being structures containing
two (2) or more dwelling units) shall incorporate the following
provisions into said new construction :
(A) All wooden doors leading from the outside directly
into the single family dwelling or directly into
the multi-family structure or directly into the
multi-family living unit shall comply with the
following criteria:
(1) Said wood door shall be of solid core
construction and a minimum of 1-3/8"
thick.
(2) Said wood doors shall be secured with a
dead bolt lock having a minimum bolt
throw of one (1) inch which shall
penetrate into a metal strike plate.
(3) In the event breakable glass is within
forty (40) inches of the dead bolt lock,
,,, the lock shall be key operated on both
ow
sides .
(B) All metal doors leading from the outside directly into
,,,, the single family dwelling or into the multi-family
structure or living unit shall comply with the
following criteria:
(1) Said doors shall be secured with a dead bolt
lock as described in (A) 2 and 3 above.
(C) All sliding glass doors leading from the outside
directly into the single family dwelling or into
the multi-family structure or living unit shall be
secured with a secondary locking device that
inhibits lifting or prying.
(D) All Dutch doors leading from the outside directly into
the single family dwelling or into the multi-family
structure or living unit shall have a concealed flush
bolt locking device to interlock the upper and lower
halves . In addition, the Dutch door shall be secured
with a dead bolt lock as described in (A) 2 and 3 above.
As an alternative to the interlocking device, each half
of the door shall be secured with a deadbolt lock as
described in (A) 2 and 3 .
(E) All garage doors shall be equipped with a key-operated
locking device.
Section 2 . This ordinance shall become effective thirty (30)
days after passage of same.
Section 3 . Severability. If any section, article , paragraph,
sentence, clause , phrase or word in this ordinance , or application
thereto to any person or circumstances is held invalid or unconsti-
tutional by a Court of competent jurisdiction, such holding shall not
affect the validity of the remaining portions of the ordinance and the
City Council hereby declares it would have passed such remaining
portions of the ordinance despite such invalidity, which remaining
portions shall remain in full force and effect .
Section 4. Penalty. Any person violating or failing to comply
with any provision of this ordinance shall be fined upon conviction
not less than one dollar ($1. 00) nor more than two hundred dollars
($200. 00) , and each day any violation or non-compliance continues shall
constitute a separate offense.
Section 5 , Emergency. The fact that the present policies and
ordinances relating to the incorporation of certain specified safety
features relating to composition of wooden doors , dead bolt locks ,
secondary locking devices and key operated locking devices to be
required on all new construction of single family residences and
multi-family dwellings are inadequate to properly safeguard the
health, safety, morals , peace and general welfare of the inhabitants
of the City creates an emergency for the immediate preservation of
the public business , property, health, safety and general welfare of
the public which requires that this ordinance shall become effective
from and after the date of its passage, as provided by the Charter
of the City and it is accordingly so ordained.
