ORDINANCE NO. 79-48
AN ORDINANCE OF THE CITY OF GRAPEVINE , TEXAS ,
AMENDING THE BASIC ZONING ORDINANCE OF THE
CITY CONTAINED IN APPENDIX "A" , THE CODE OF
ORDINANCES , THE CITY OF GRAPEVINE BY AMENDING
SECTION 7 , SUBSECTION 7-101 (6) RELATING TO
ACCESSORY BUILDINGS SPECIFICALLY THE BUILDING
__ SET BACK REQUIREMENTS OF SAID ACCESSORY
STRUCTURES ; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A PENALTY AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE ,
TEXAS :
Section 1. That the Basic City of Grapevine, Texas Zoning
Ordinance contained in Appendix "A" of the Code of Ordinances of the
City of Grapevine , Texas is hereby amended by amending Section 7 ,
Subsection 7-101 (6) relating to accessory structures to hereinafter
read as follows :
"Sec. 7-101 (6)
(A) Accessory buildings , including a private garage
and servant quarters , when located not less than
eighty (80) feet from the front property line,
nor less than six (6) feet from any other property
line, except as provided in (B) , provided that said
accessory buildings shall not occupy in excess of
fifty (50) per cent of the minimum required rear
yard in the case of an one (1) story building, or
forty (40) per cent of the minimum required rear
yard in the case of a two (2) story building. No
such servant quarters , however, shall be leased
or rented to anyone other than to the family of
a bona fide servant giving more than fifty (50)
percent of said servant' s time to the family
occupying the premises to which the servant ' s
house is an accessory building. No accessory
building in this district shall be used for
commercial purposes (the term "commercial purposes"
shall include part-time business) .
(B) Rear Yard Building Set Back. Accessory building
sixteen (16) feet or less in height shall not be
constructed closer than six (6) feet to the rear
property line. Structures in excess of sixteen
(16) feet in height shall set back from the rear
property line not less than six (6) feet plus two
(2) additional feet for each additional foot of
height over sixteen (16) feet. The height of the
structure shall be measured from the top of the
slab or from its bottom floor. "

Section 2 . Severability. If any section, article , paragraph,
sentence, clause, phrase or word in this ordinance, or application
thereto to any person or circumstances is held invalid or unconsti-
tutional by a Court of competent jurisdiction, such holding shall
not affect the validity of the remaining portions of the ordinance
and the City Council hereby declares it would have passed such
remaining portions of the ordinance despite such invalidity, which
remaining portions shall remain in full force and effect.
Section 3 . Penalty. Any person violating any of the provisions
of this ordinance shall be deemed of a misdemeanor and subject to a
fine not to exceed Two Hundred Dollars ($200. 00) for each offense
and each and every day any such violation shall exist or continue
shall constitute a separate offense.
Section 4. Emergency. The fact that the present ordinances
relating to set back requirements of accessory buildings are inadequate
creates an urgency and emergency and in the preservation of the public
health, safety and welfare requires that this ordinance shall take
0000 effect immediately from and after its passage and the publication of
the caption as the law and charter in such cases provide.
DULY PASSED by the City Council of the City of Grapevine , Texas ,
this 4th day of September , 1979 .
