A. "An ordinance regulating and governing the
storage, sale, possession, or serving of
alcoholic beverages within the corporate
limits of the City of Grapevine, Texas ;
providing for such uses to be permitted
only on property zoned within the City Code
of Grapevine, Texas , Title 10, Chapter 12,
same being the "SP" Specific Use Permit
District; adding such uses to the use
schedule in the City Code of Grapevine,
Texas, Title 10, Chapter 12, Section 4;
exempting from this ordinance such uses
when on residential property and under
certain specified conditions; providing
a penalty; providing a severability clause;
and declaring an emergency."
In accordance with Article 6252-17, V.A.T.C.S. , as
amended by Chapter 227, Acts of the 61st Legislature,
regular session, 1g69, the City Council Agenda was
prepared and posted on this the 31th day of July, 1973.

The City Council and the Planning & Zoning Commission of the
City of Grapevine, Texas, convened in special joint meeting
at 7:38 p.m. , on this the 6th day of August, 1973, with the
following members present, to-wit:
William D. Tate Mayor
Doil Dalton Councilman
Tommy Eidson Councilman
Phil Parker Councilman
C.D. Pittard Councilman
Millard Dilg Councilman
constituting a quorum, an d Thelma Conine being absent, and
Ted Ware Chairman
Harlen Joyce Member

constituting a quorum, and Don Stiles being absent, and
Mayor Tate called the meeting to order.

Mayor Tate opened the public hearing of proposed Ordinance
No. 73-31 . The City Manager read the caption as follows;
AN ORDINANCE REGULATING AND GOVERNING THE STORAGE, �
SALE� POSSESSION, OR SERVING OF ALCOHOLIC BEVERAGES
WITHIN THE CORPORATE LIMITS OF. THE CITY OF GRAPEVINE,
TEXAS; :.PROVIDING FOR SUCH USES �O BE PERMITTED ONLY
ON PROPERTY ZONED WITHIN THE CITY CODE OF GRAPEVINE,
TEXAS� TITLE 10, CHAPTER 12, SAME BEING THE "SP"
SPECIFIC USE PERMIT DISTRICT; ADDING SUCH USES TO
THE USE SCHEDULE IN THE CITY CODE OF GRAPEVINE, ,
TEXAS, TITLE 10, CHAPTER 12, SECTION 4; ADDING TO
THE SPECIFIC USE SCHEDULE, TITLE 10, CHAPTER 12,
SECTION 4, ANY USE OR USES NOT PROHIBITED BY THE
ZONING ORDINANCE; PROVIDING A PROCEDURE FOR THE
OWNERS OF NEWLY ANNEXED PROPERTY TO MAKE APPLICATION;
EXEMPTING FROM THIS ORDINANCE CERTAIN SPECIFIED USES
AND UNDER CERTAIN SPECIFIED CONDITIONS; PROVIDING A
PENALTY; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING
AN EMERGENCY. (

The City Attorney stated the proposed ordinance would amend
the Zoning Ordinance, by providing for anyone desiring to
store, sale, possess, or serve alcoholic beverages to obtain
a zoning change to the "SP" Specific Use Permit District,
regardless of their present zoning classification. He stated
the "SP"-alcoholic beverages zoning applications would be
handled in fhe same manner as other zoning applications.

The City Attorney stated the Specific Use Permit District �
allows the Planning & Zoning Commission to require a site �
plan, which includes the off-street parking, configuration, �
size, and construction of the building, type and character �
of signs. He stated a person must apply to the State for "

He stated the ordinance includes a section exempting its ,
enforcement when the storage or serving of alcoholic N

or occupants of the premises and their guests at no charge. �.

He stated he felt the ordinance is a reasonable approach �:
and recommends it for Council consideration. �'
Mayor Tate stated the Planning & Zoning Commission would `

ordinance would be considered at tomorrow night' s meeting �
(August 7, 1973, 7;30 p.m. ) . f;
Ray Chasteen asked if there are any regulations concerning �
signs in the proposed ordinance. The City Attorney stated �
in the Specific Use Permit District, under Section 10-12-3, �
(c) & (d) , the City Council can set development standards, �
and require a site plan which would describe the number and a'
types of si�s. �
Jesse Woods asked if a site plan could be required of a f
present building. The City Attorney stated a site plan �
could be required at the pleasure of the Planning & Zoning �
�
Commission or City Council .
Frank Andy asked if the Dallas/Fort Worth Regional Airport �

� would require a zoning change. Mayor Tate replied they �
would. e
Bob England asked if alcoholic beverages could be sold in �
any zoning district. Mayor Tate stated any person that �;
wishes to sale alcoholic beverages must obtain a Specific ;
Use Permit District for such, regardless of the present �
zoning classification. E`

The City Attorne,� stated several surrounding cities regulate �
alcoholic beverages by their zoning ordinance. �

With no further discussion of proposed Ordinance No. 73-31, i
Mayor Tate closed the public hearing. �
