A. Consideration of an ordinance amending Ordinance No . 70-10,
a Zoning !Jrdinance, granting a zoning change on a tract of
land in the Thomas Mahan Survey , Abstract No . 1050, �rom
"R-1 " to "SP" Specific Use Permit District - Nursing Home,
on SECOND AND FINAL READING.

The City Council and the Planning 6 Zoning Commission of the
Ci�y oP Grapevine, Texas, convened in joint meeting at 7:36 p . m. ,
on this the z5th day of September, 1973, with tl-ie following
members present, to-wit:

Mayor Tate called the meeting to order.
The Invocation was given by Corbett Emery.
Mayor Tate opened the public hearing on zoning case [Z-73-22] ,
Nu-Way �istributors, Inc. requesting "SP'T Speci�ic Use Permit
District - alcoholic beverages �or off-premise consumption on
a tract o� land in the Elizabeth Cox Survey. [5028 South �
Highway 157) '
No one was present to speak on behalf o� the zoning application,
therefore, Mayor `Tate postponed the public hearing.
Mayor Tate openerJ tFie public hearing on zoning case [Z-73-24] ,
Jess Mitchell requesting a change in zoning �rom "R-1 "to "C-2"
Community Business District on a �ract of land in the William
P. Herring Survey, Abstract No. 663. [�ove Road at Dove Loop
Road)
Robert Taylor spoke on bel-�al� of tl-ie zoning application.
He stated the tract contains [7. 73] acres, and is planned to
be developed into a small convenience shopping center in the
near. f uture.
W�itl-i no �urther discussion on zoning case [Z-.73-,24] , Mayor Tate
closed the public hearing.
Mayor Tate re-opened the public hearing on zoning case [Z-73-22] ,
Nu-Way Distributors, Inc. , as Don Delp , representative o� the
zoning application was present. Mr. Delp spoke on behal�
� of the zoning application. He stated there are no plans to
enlarge the present building. He stated grocery sales repre- I
sent a majority of the business's gross sales.
The City Secretary stated a petition opposing the zoning
application had been received.
With no �urther discussion on zoning case [Z-73-22) , Mayor Tate
closed the public hearing.
Mayor Tate opened the public hearing on zoning case [Z-73-25] ,
Roy Leal [Dixie Grocery) requesting "SP" Speci�ic Use Permit �

South Highway 157]
Roy Leal spoke on behalf of the zoning application. He stated
there are no plans to enlarge the present building. He stated
he would strictly enforce all city and state laws pertaining
to alcoholic beverages.
Mr. Leal stated the junk cars at his business did not belong
to him, but he has requested the owner to remove them.
� The City Secretary steted a petition opposing the zoning
' application had been received.
Jack Thompson, owner of property adjacent to the zoning appli-
cation, spoke in opposition to the zoning application.
With no f urther discussion on zoning case [Z-73-25) , Mayor
; Tate closed the public hearing.
Mayor Tate opened the public hearing on zoning case [Z-73-26] ,
Silver Lake Enterprises, Inc . requesting "SP" Specific Use
Permit District - alcoholic beverages �or off-premise consumption
on Tract A-1A and A-2A of Grapevine Reservoir.
No one was present to speak on behalf of the zoning application,
�'i therefore, Mayor Tate postponed the public hearing.

Mayor Tate opened the public hearing on zoning case [Z-73-27] ,
Sundown Sales , Inc. [Buddies Supermarket] requesting "SP" Specific
Use Permit District - alcoholic beverages for off-premise con-
sumption on a tract of land in the Original Town o� Grapevine.
[613 Main Street]
C. E. Harness, Store Manager, spoke on behalf of the zoning
application. He stated the beer will be available both hot
' and cold, and will be sold only by adults.
Councilman Eidson asked the City Attorney i� the submitted
site plan would allow the sale of alcoholic beverages at both
the present and new [when completed] locations. The City Att-
orney stated the Council should make provisions in the zoning
amendment ordinance to allow the sale of alcoholic beverages
to the present building and then to the new building when com-
pleted. Mayor Tate asked Mr. Harness to provide the Council
a site plan showing both present an�l proposed lacations of the
supermarket facility.
Mayor Tate re-opened the public hearing on zoning case [Z-73-26) ,
Silver Lake Enterprises, Inc. , as Norris Graham, representative
o� the zoning application was present. Mr. Graham spoke on
behalf of the zoning application. He stated his application
was only to apply to tf-�e marina, and not to any other portion
of the Silver Lake Enterprise, Inc. �acility. The Council
asked Mr. Graham to provide a more specific site plan of the
marina.
Mr. Graham stated "premises" would only apply to the marina,
whereas a person could consume alcoholic beverages in the dock
area.

Mayor Tate opened the public hearing on zoning case [Z-73-28] ,
M.R. Blanks [Red Ball Service Station and Grocery) requesting
"SP" Specific Use Permit District - alcoholic beverages �or
o�f-premise consumption on a tract of land in the J. N. Gibson
Survey. [3311 Highway 121 West).
M. R. Blanks spoke on behalf of the zoning application.

He stated the majority o� his business is from the sal� o�
gasoline. He stated he would control the sale of beer to
high school students during school hours .
With no �urther discussion on zoning case [Z-73-28] , Mayor
Tate closed the public hearing.

Mayor Tate opened the public hearing on zoning case [Z-73-30] , �
the Dallas/Fort Worth Regional Airport Board in association
with tl-ie Dobb's House, Inc. and the Fred Harvey Hotel , Inc. , �'�
requesting "SP" Specific Use Permit District - alcoholic
beverages for on-premise consumption, within Terminal Nos.
2E, 2W, 3E, 4E, and the Airport Marina Hotel , as described
on their site plans.
Larry Taylor spoke on behalf of the Airport Marina Hotel.
He stated there would be a restaurant, coff ee shop , lounge, and
ball room which would be serving alcoholic beverages. He also
stated the hotel may cater special f unctions in any part of
the building, therefore, tt-ie entire �acility would need to be
properly zoned for the sale of alcoholic beverages for on-pre-
mise consumption.
No one was present to speak on behalf of the Dobb's House, Inc.
The City Attorney stated he would be in contact with the Dobb's
House, Inc . attorney to inform him to have a representative pre-
sent at the October 2 Council meeting.
With no fUrther discussion on zoning case (Z-73-30] , Ted Ware,
Chairman of the Planning � Zoning Commission, closed the public
hearing �or the Commission.
Councilman Eidson moved to cohtinue tf-�e public hearing on zoning
case [Z-73-30] by the Council at the O�tober 2, 1973, Council
meeting, at 7:30 p. m. Councilwoman Conine seconded the motion.
TI-ie motion prevailed by the following vote:

Mayor Tate called the meeting to order.

Ordinance No. 73-44, an ordinance amending Ordinance No. 70-10,
a Zoning Ordinance, granting a zoning change on a tract of land
in the Thomas Mahan Survey, Abstract No. 1050, from "R-1 " to "SP"
Specific Use Permit District - Nursing Home, was introduced for
consideration on second and �inal reading. [Z-73-11 , Aubrey Smith].
Mayor Tate stated the Planning � Zoning Commission has made the
� following recommendation concerning the future land use of the

area in question :

to be used primarily for residential development, favoring
single-f amily district, but with some multi-family. We also
anticipate some areas of commercial development as needed. This
statement is not meant to rule-out "SP" Specific Use Permit Dis-
trict or "PD" Planned Development District when compatible.

Jack Cain and CI-iarlie Cox spoke in opposition to the zoning
amendment ordinance.
Mr. Cain stated the Planning E Zoning Commission's -,re�ommendation
as to the �uture land use was not very definite. He stated the
nursing home would devalue the adjacent property.
Mr. Cox stated he f elt the nursing home was incompatible for
the area. He stated he does not anticipate requesting �or a
higher zoning on his property.
Councilman Pittard stated the applicant should be required to
screen around tl-ie nursing I-iome.
Discussion was held concerning land uses and values of the area

in question, in comparison with the Los Angeles International
Airport area.
Mayor Tate asked tl-iat the property owners around tl-ie proposed
nursing home meet and make a recommendation as to the �uture
; land use for tl-ie area.
� Councilman Dilg moved to adopt Ordinance No . 73-44 on secpnd
and final reading, subject to the applicant screening the
North side o� the property and dedication of a minimum o�
[10) feet for street right-of-way on �ove Road, excluding
the platting of the access road at the rear of the property.
Councilwoman Conine seconded the motion. The motion prevailed
by the following vote:
Ayes: Tate, Dalton, Eidson, Conine, Pittard, Dilg

AN ORDINANCE AMENDING ORDINANCE N0. 70-10, A ZONING
OR�INANCE OF THE CITY OF GRAPEV�NE, TEXAS, GRANTING
A ZONING CHANGE ON A TRACT OF LAND IN THE THOMAS
MAHAN SURVEY , ABSTRACT N0. 1050, IN THE CITY OF
GRAPEVINE , TEXAS , AND MORE FULLY DESCRIBED HEREIN;
ANO ORDERING A CHANGE IN THE USE OF SAID PRDPERTY
FROM "R-1 " TO "SP" SPECIFIC USE PERMIT DISTRICT -
NURSING HOME; CORFiECTING THE OFFICIAL ZONING MAP ;
PRESERVING ALL OTHER PORTIONS OF THE ZONING ORDI-
NANCE; PROVIDING A SEVERABILITY CLAUSE; DETERMINING
THAT THE PUBLIC INTEREST, MORALS AND GENERAL WEL-
FARE DEMAND A ZONING CHANGE ANO AMENOMENT HEREIN
MADE; AND PROVIDING A PENALTY.
The City Manager stated he had received a letter f'rom the
School District requesting a meeting with the City Council
to discuss mutual problems relating to the Tax Departments.
Mayor Tate requested that the "Airport Zoning Ordinance"
be placed on the October 2 Council meeting agenda.
There being no further business , Mayor Tate adjourned the
meeting.
