The City Council of the City of Grapevine, Texas, convened in
regular meeting at 8 :41 p . m. , on this the 2nd day of Dctober,
1973, with the following members present, to-wit:
William D. Tate Mayor

constituting a quorum, with Phil Parker absent, and

Mayor Tate called the meeting to order.
The Invocation was given by Councilwoman Conine.
Councilman Eidson moved to approve tl-ie minutes of the September
� 4, 1973, and September 18, 1973, meetings as presented by tHe
City Secretary. Councilman Oilg seconded the motion. The motion
prevailed by the following vote:
Ayes: Tate, Daltori, Eidson, Conine, Pittard, Dilg
Noes : None
Absent: Parker
Chris Davidson, representative of the Tarrant County Planning
Department, gave a presentation concerning a soil survey for
� Tarrant County. He stated the Planning Oepartment was requesting
� an accelerated soil survey, in order to shorten the time of its
� completion from eight years to two and one hal� years. He stated
i the accelerated program would require local �inancial assistance.
j He explained that a soil survey would assist local govet^nments
� and private enterprises in making their location and construction
decisions. He stated various types o� soils are more suitable
for certain uses than others and they also react dif�erent when
�� combined with various elements, such as some soils hold water
more so than oti-iers , tl-ius causing �t-�e�uent f.looding.
He stated a soil survey can help developers in locating problems
centers n industrial

associated in housing ite , hoppi g ,
parks, based on the safety and trUSt involved with the sites
particular soils and their f avorability for foundations. He
`, stated recreational areas can be located where soils are best
� suited for landscaping, easy drainage, and permeability. He
stated before laying utility pipe, it is important to know the
corrsive characteristics , the consistency of tl-ie area°s soils
and the depth to rocks.
He stated the cost of the accelerated program for the entire
county has decreased from ($110, 000. ] to [$100, 059. ] , due to
the City of Arlington is presently obtaining their own soil
survey.

Mr. Davidson stated the City of Grapevine's cost [based on the
original cost Pigure) is approximately [$2,700. ] and can be paid
over a two-year period. He stated various utility companies are
willing to participate in the program, thus reducing the cost to
cities.
He stated the National Soil Conservation Service would conduct
the soil survey.
Mr. Davidson asked the Council to write a letter to the County
Judge, County Commissioner Prect.#3, and the CoUnty Planning ,
Department, stating the City of Grapevine is interested in I
the accelerated soil survey program.
Councilman Dalton moved to instruct the City Manager to write
such a letter stating the city is interested in the accelerated
soil survey program. Councilman Dilg seconded the motion. The
motion prevailed by the following vote:

The City Attorney introduced �or consideration a resolution
authorizing him [as City Attorney] to sign an agreed judgment
in the City o� Southlake vs. City of Grapevine, city boundaries
suit. He stated the boundary line of the agreed judgment is
the same as the one both cities agreed to - at their conf erence
meetings. He stated both cities would be bound to the agree-
ment due to its being a "por warranto" suit, with the State of
Texas a party to it.
He stated the following area woUld be the exclusive extra-
territorial jurisdiction of the City of Grapevine, with the
City of Southlake relinquishing any claims or ordinances the
City of Southlake might have passed concerning that area:
"That area of land in Tarrant County, Texas, West
of the field notes contained in Exhibit "A" attacl-ied
hereto and made a part hereof and also being South of
the North right-of-way line of State Highway 121 and
such area South and West of' said point extending in a
Southwesterly direction from the said beginning point
described in Exhibit "A" above along the North right-
o�-way line of State Highwat 1�1 to a point one mile
i Southwest in the North right-of-way line of State
Highway 121 , which point is one mile Soutl-iwest beyond
the centerline of the intersection of Big Bear Creek
and the North right-of-way of State Highway 121 ; and
All the area of land East of the boundary line described
by metes and bounds in the field notes attached I-iereto
as Exhibi t "A". "
He stated the �ollowing area would be the exclusive extra-

The City Attorney stated the agreed judgment does not cons- �
titute any annexations, but means the City of Grapevine will
heve the authority and ability to annex that described area.
He stated the City of Southlake is also considering a similiar
resolution tonight.
Discussion was held concerning the proposed boundary line at
Highway 114 and Highway 114 Business. It was stated the police
should have access to the property East of Highway 114 for patrol
purposes , without traveling through the City of Southlake.
. I Mayor Tate asked the City Attorney to contact Southlake's City
Attorney and request the City of Southlake to make the boundary
line the centerline of Highway 114, or the North bound access
road.

The Council considered the mobile home permit application o�
Albert McKool , on Dove Loop Road. The Planning 6 Zoning Com-
mission recommended to approve the application.
No one was present to speak on bel-ialf o� the applicant.
The City Manager brief ed the Council on its location, and
stated a club-house [mobile home] was presently located on the
tract in question. The Assistant City Manager stated the Corps
of Engineers only allow non-permanent structures on specified
tracts of land, due to its elevation. It was not known it Mr.
McKool had received a permit from tl-ie Corps of Engineers for �
the mobile home and sewage system.
Councilman Eidson moved to table consideration of the Albert
McKool mobile home permit application, until he has received
Corps o� Engineers approval. Councilman Pittard seconded the �
motion. The motion prevailed by the following vote: �:

Councilman Dalton stated he did not know if tl-ie Corps of Engineers �
requirements should enter into the Council 's decision.
Mayor Tate stated he tended to agree, bUt with his recollection E'
of the area, he would be opposed to the application due to
their are mobile home parks in the area. He stated it i,s
an area that needed to be up-graded and is exposed to many �:
visitors.
The City Attorney stated he had contacted Southlake's City
' Attorney regarding the boundary line agreement. Southlake's
City Attorney stated tf-ie only problem to the amendment at
� Highway 114 and Highway 114 Business , was that the area might
�
be a part of the City o� Southlake's original incorporation,
and in that case, they would tend not to agree to the amerid-
ment.

The City 8ecretary introduced an ordinance, amending Ordinance
No. 70-10, a Zoning Ordinance, granting a zoning change on a
tract o� land in the Elizabeth Eox Survey to "SP" Specific Use
Permit District - alcoholic beverages �or off-premise consump- ,
tion, for consideration on an emergency basis by reading the
caption. [Z-73-22, Nu-Way Grocery, 5028 S. Hwy. 157] .
� The City Secretary stated f-�e had certified the petition received
; at the public hearin� opposing the zoning application, and that �'
j the owners of at least (20%] of tl-ie land area within [200] feet
� of the zoning application had signed it, therefore, requiring
a [3/4) majority vote by tl-ie Council to adopt the ordinance
granting the zoning amendment.

Mayor Tate stated the Planning � Zoning Commission recommended
to approve the zoning application.
In answer to a question from Councilman Pittard, Chief o� Police
J�mes Lilly stated i-iis of�icers patrol the area frequently, and
he does not anticipate any problems.
Councilman Dilg moved to accept the Planning E Zoning Commission 's
recommendation to approve the zoning application and adopt the
ordinance on an emergency basis. Councilman Dalton seconded the
motion. The motion prevailed by the following vote:

CITY CODE OF GRAPEVINE, TEXAS , GRANTING A ZONING CHANGE
ON A TRACT OF LAND IN THE ELIZABETH COX SURVEY, IN THE
CITY OF GRAPEVINE , TARRANT COUNTY , TEXAS ; MORE FULLY
AND COMPLETELY DESCRIBED IN THE BODY OF THIS ORDINANCE;

The City Secretary introduced an ordinance, amending Ordinance

Mayor Tate stated the Planning 6 Zoning Commission recommended
to approve the zoning application.
TI-ie City Manager stated this zoning application would be effected
by Ordinance No. 73-24, requiring the dedication of right-of-way
for any thoroughf are adjacent to the property.
Councilman Eidson moved to accept the Planning E Zoning Commission's
recommendation to approve the zoning application and adop t the
ordinance on First reading. Councilman Pittard seconded the motion.

The City Secretary introduced an ordinance, amending Ordinance
No. 70-10, a Zoning Ordinance, granting a zoning change on a
tract of land in the William Oriskell SUrvey to "SP" Specific
Use Permit District - alcoholic beverages �or off-premise con-
sumption, �or consideration on an emergency basis by reading
the caption. [Z-73-25, Dixie Grocery, 4401 S. Hwy. 157) .
The City Secretary stated he had certiPied the petition received
at the public hearing opposing the zoning application, and that
the owners of at least [20%] of the land area within [200) feet
of the zoning application had signed it, there�ore, requiring

In answer to a question from Councilman Pittard, Roy Leal , owner
of the property in question, stated the new Highway 121 Freeway
would require a portion of the tract for right-o�-way. He stated
he would have to relocate his building on the tract, in order �
to meet set-back and parking requirements. �

� Councilman Dalton moved to accept the Planning � Zoning Commission's

The City Secretary stated no written opposition had been received
pertaining to this zoning application.

speci�ic site plan o� the marina building in which alcoholic
. beverages are requested to be sold.
Councilman Pittard stated he would like to include the walk-way
,from the shore to the marina building [as shown on applicant's
site pl.an] as part o� the premises , whereas alcoholic beverages
could not be consumed at that location.
Councilman Pittard moved to accept the Planning � Zoning Commission's
recommendation to approve the zoning application and adopt the
ordinance on an emergency basis , including the walk-way from the
� shore to the marina buildir�g as a part of the premises. Council-
� man Dilg seconded the motion. The motion prevailed by the fol-

The City Secretary introduced an ordinance, amending Ordinance
No . 70-� 0, a Zoning Ordinance, granting a zoning change on a
tract of land in the Original Town of Grapevine Addition to
"SP" Speci�ic Use Permit District - alcoholic beverages �or
o�Ff-premise consumption, for consideration on an emergency
basis by reading the caption. [Z-73-27, Buddies Mkt. , 613 Main].
The City Secretary stated no written opposition had been
received pertaining to this zoning application.
Mayor Tate stated the Planning E Zoning Commission recommended
to approve the zoning application.
The City Secretary stated tF�e applicant had submitted a site
plan as requested by the Council et the public hearing, showing
both the present building and the f uture building.
Councilman Eidson moved to accept the Planning � Zoning Commission's
recommendation to approve the zoning applicetion and adopt the
ordinance on an emergency basis. Councilman Pittard seconded
the motion. The motion prevailed by the Pollowing vote:

Councilman Pittard stated when Mr. Blanks [zoning applicant)
made his presentation at the public hearing, he admitted his
business was primarily that of selling gasoline and his lesser
use of the business was selling groceries.
Councilman Pittard stated his personal opinion now and of any
f uture zoning applications requesting the sale o� alcoholic
beverages �or of�-premise consumption, is that he will not
vote for business' where their income is primarily derived ',
from the sale o� service station products.
Councilman Eidson moved not to accept the Planning 6 Zoning
Commission's recommendation to approve the zoning application
and disallow the ordinance. Councilman Pittard seconded the ,
motion. The motion prevailed by the following vote: i

Mayor Tate recessed the meeting at 9: 06 p. m.
The meeting reconvened at 9: 19 p. m. , with the �ollowing members

Discussion was held concerning the Grapevine-Southlake boundary
line agreement.
Councilman Dalton moved to adopt a resolution authorizing the
City Attorney to sign for the City of Grapevine an agreed judg-
ment in the City of SoUthlake vs. City of Grapevine suit con-
cerning the cities boundary lines, with the City Attorney nego-
tiating the amendment to the agreed boundary line at Highway 114
and Highway 114 Business . Councilman Dilg seconded the motion.

�� James Lilly, Chief of Police, recommended the Council accept �
the bid of Larry Lange's Plymouth. He stated that Plymouth
was a superior police vehicle as compared to Ford and Chevrolet.
Councilman Pittard moved to award the contract to provide four
vehicles to Larry Lange's Plymouth at a total cost d� [$14,384. ].
Councilwoman Conine seconded the motion. The motion prevailed �

Street. The Assistant City Manager brief ed the Council on c
