AN ORDINANCE AMEND�SIVG THE GRAPEVINE CITY CODE,
TITLE 4, CHAPTER 15, SECTION 4-15-11 DEALING
WITH THE SALE OR STORAGE OF ALCOHOLIC BEVERAGES
WITHIN A SPECIFIED DISTANCE FROM A CHURCH,
PUBLIC SCHOOL, PUBLIC HOSPITAL BY CHANGING THE
DISTANCE FROM 300 F'EET TO 500 REET; PROVIDING
� A PENALTY, PROVIDING A SEVERABILITY CLAUSE,
AND DECLARING AN EMERGENCY.

NOW, THEREF'ORE, BE IT ORDAINED BY THE CITY CAUNCIL OF
THE CITY OR GRAPEVINE, TEXAS:
Section 1. That the Grapevine City Code, Title 4,
Chapter 15, Section 4-15-11 is hereby amended to read as
follows:
"4-15-11: Premises near church, public school or hospital:
(A) No party or entity shall sell or engage in the busi-
ness of storing, selling, possessing or serving any
alcoholic beverage where the place of business of such
person is situated or is located within five hundred
feet (500) of any church, public school or public
hospital, the measurements to be along the property
lines of the street fronts and from front door to front
door in a direct line across street intersections where
they occur provided however that all parties or entities
legally selling or engaging in the business of storing,
selling, possessing or serving of any alcoholic beverage
at the time this Ordinance becomes effective shall
continue to be governed by the 300 foot rule previously
established.

Section 2. Penalty-Any person violating any of the pro-
�,, visions of this Ordinance shall be deemed guilty of a mis-
dem�anor and upon conviction thereof shall be fined in a
sum not to exceed two hundred dollars ($200.00) and a separate
offense shall be deemed committed upon each day during or on
which a violation occurs or continues after the notice period
provided herein has expired. The Court shall order removal
and abatement of the nuisance.
Section 3. Severability Clause-If any section, article,
paragraph, sentence, clause, phrase or word in tha s ordinance,
or application thereto to any person or circumstances is held.
invalid or unconstitutional by a Court of competent jurisdic-
tion such hold�ng shall not affect the validity of the remain-
ing portions of the ordinance; and the City Council hereby
declares it vwould have passed such remaining portions of the
ordinance despite such invalidity, which remaining portions
shall remain in full force and effect.
Section 4. Emergency-The fact that no present ordinances
of the City of Grapevine regulating the sale or storage of
alcoholic beverages within a specified distance f rom a church,
etc. from 300 feet to 500 feet, creates an urgency and a►n
"'""" emergency and in the preservation of the public health, safety
and welfare requires that �Y�is ordinance shall take effect
immediately from and after its passage and the publication of
�r the caption as the law and charter in such cases provides.
DULY PASSED by the City Council of the City of Grapevine, Texas,
