AN ORDINANCE AMENDING TITLE FOUR, CHAPTER 4,
SECTION 4-4-28 OF THE GRAPEVINE CITY CODE RELATING
TO THE OPERATION OF TAXI CABS BY REDUCING THE
STREET RENTAL FEE FROM 4Q/o TO 2%; PROVIDING A
SEVERABILITY CLAUSE: AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE,
TEXAS:
Section 1. That Title Four, Chapter 4, Section 4-4-28, of
the City Code relating to taxicabs is hereby amended to read as
follows:
4-4-28: FRANCHISE HOLDER TO PAY MONTHLY FEE FOR USE OF
STREETS:
As compensation or rental or license fee for the privilege
of operating upon and using the public streets and thoroughfares
of the City, and conducting and carrying on the business of trans-
porting passengers for compensation on and over the streets and
thoroughfares in taxicabs, each holder of a franchise granted
under the terms of this Ordinance shall pay to the City at the
Office of the City Secretary an amount equivalent to two percent
(2%) of the gross revenues derived from the operation of the taxi-
cabs operated by him. Such amount sha11 be paid monthly for each
calendar month on or before the fifteenth day of each succeeding
calendar month. Such compensation shall be in lieu of all other
�.::� fees to be paid by taxicab operators imposed by any other ordinance
now in force, but sha11 not be construed to be in lieu of any

validly assessed as valorem taxes .
Section 2. Severability. - If any section, article, paragraph,
sentence, clause, phrase or word in this ordinance, or application
thereto to any person or circumstances is held invalid or unconsti-
tutional by a Court of competent jurisdiction such holding shall
not affect the validity of the remaining portions of the ordinance;
and the City Council hereby declares it would have passed such
remaining portions of the ordinance despite such invalidity, which
remaining portions shall remain in full force and effect.
Section 3. Emergency. - The fact that no present ordinances
of the City of Grapevine amends Title Four, Chapter 4, Section 4-4-28
from 4% to 2%, creates an urgency and an emergency and in the
preservation of the public health, safety and welfare requires that
this Ordinance sha11 take effect immediately from and after its
passage and the publication of the caption as the law and charter
in such cases provides.
