Home My WebLink AboutORD 1978-043 ORDINANCE NO. 78-43 AN ORDINANCE CLOSING, ABANDONING AND VACATING A PORTION OF TERRELL STREET IN THE CITY OF GRAPE- VINE, TEXAS, AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY. �.>,;• WHEREAS, the owners of property abutting a portion of � -� Terrell Street in the City of Grapevine, Texas, have requested the right-of-way of a portion of Terrell Street, as herein- after described, be closed, abandoned and vacated; and = WHEREAS, the right-of-way of said street as hereinafter r��. ;�;. described is not now needed for public street and will not ��: be needed in the future for a public street; and � :: F�:': WHEREAS, the closing, abandoning and vacating the right- - of-way of said street will relieve the City of Grapevine, Texas , from the cost and expense of maintaining said property; ,-s' NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL ,z�>. " OF THE CITY OF GRAPEVINE, TEXAS : SECTION l. That the portion of right-of-way of �:� Terrell Street, more particularly described as follows : :�._ Being that portion of Block 15, Original Town of Grapevine, Tarrant County, Texas in the City of Grapevine, Tarrant County, Texas, and being more particularly des- cribed as follows : �-.�y� Beginning at a 3/4" iron rod at the southeast corner of lot 21 and the west line of Terrell Street. Thence north along the east line of said lot 21 for the west line of Terrell Street at 125 feet past a 3/4" iron rod for the northeast corner of said lot 21 and continue in all 131-4/10 feet to the middle of former alley closed by City of Grapevine Ordinance 68-6. Thence 89 degrees - 36 minutes east 50 feet to the east line of Terrell Street. Thence south along said east line of Terrell Street, 131-4/10 feet to the north line of Hudgins Street. Thence north 89 degrees - 36 minutes west along the said north line of Hudgins Street 50 feet to the � � place of Beginning and containing 6568 square feet, �� and the same is hereby closed, abandoned and vacated for public use, and the same is hereby closed, aban- doned and vacated insofar as all public right, title and interest in and to said described portion of said right-of-way is concerned, subject to and contingent upon the owner of abutting property removing and re- locating any existing City of Grapevine utilities into . a city easement to the satisfaction and approval of the City Manager of the City of Grapevine. �-.,.,� Section 2 . That the Mayor, be, and is hereby authorized to execute a Quit-Claim Deed to convey the heretofore described property to the owners of the property abutting �,,. :� said right-of-way, who have officially declared by af- fidavit that they each are the rightful fee owners of the right-of-way vacated and abandoned by this ordinance and that they know of no other parties who own property abutting said right-of-way. �:_: Section 3 . That the terms and provisions of this or- dinance shall be deemed to be severable and that if the '�r validity of any section, subsection, word, sentence or .;. ;;,� phrase shall be held to be invalid, it shall not affect '�:��' the remaining part of this ordinance . �. �a-� Section 4. The fact that the said portion of right-of- � way of Terrell Street is no longer needed by the public ��a for public usage or traveling and would create a hard- - ship or burden upon the City of Grapevine to keep open �a and maintain such street creates an urgency and an emergency for the immediate preservation of the public health, safety and general welfare which requires that - this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained. ,�,.. ..
