HomeMy WebLinkAboutORD 1977-051 ORDINANCE N0. 77-51 AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF GRAPEVINE, TEXAS BY REPEALING TITLE 1, CHAPTER 16, RELATING TO CORPORATION COURT JUDGE BY PROVIDING FOR A MUNICIPAL COURT TO CONFORM TO STATE LAW AND THE CITY CHARTER; TO PROVIDE FOR THE APPOINTMENTS +'�""" BY THE CI TY COUNCIL OF A MUNI CIPAL JUDGE AND TEMPORARY OR RELIEF JUDGES; PROVIDING THAT THE JUDGE OR JUDGES SHALL SERVE AT THE WILL OF THE �' COUNCIL; PROVIDING THE POWER AND AUTHORITY OF JUDGE OR JUDGES; PROVIDING FOR COMPENSATION; AND DECLARING AN EMERGENCY. WHEREAS, the rapid expansion of the population of the City of Grapevine and a substantial increase in the number of vehicles traveling the City streets and highways has resulted in an in- creased load on the Municipal Caurt; and WHEREAS, the Municipal Court Judge performs all of the duties of Magistrate under Texas Law; and WHEREAS, the City Council believes that an associate judge of the Municipal Court is needed to assist and the Municipal Judge particularly in the handling of his duties as a "magistrate", an d WHEREAS, the 65th Legislature has enacted S. B. 1173 � authorizing home-rule cities to provide for the appointment of one or more temporary or relief judges to sit as the regular judge of the Municipal Court; � NOW, THEREFORE, ABOVE PREMISES CONSIDERED BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That Title 1, Chapter 16 of the City Code of the City of Grapevine, relating to Corporation Court Judges , is hereby repealed and a new chapter is hereby submitted, which shall read as follows: "Chapter 16-Municipal Court" Section 1-16-1. Established; Powers, Duties, Juris- diction: There is hereby created and established a Court designated as a Municipal Court; for the trial of misdemeanor offer�ses, including violations of municipal ordinances, with a11 such powers and duties as are now, or may hereafter, be prescribed by the laws of the State of Texas relative to Municipal Court. � Section 1-16-2. ;�, A. The Municipal Court shall be presided over by a Magistrate who shall be known as the Municipal Judge. He shall be appointed and removed from office by the City Council. � B. The City Council shall have the power to appoint one or more persons to serve as temporary or relief judges to sit for the regular judge of the Municipal Court or for the presiding judge or any of the associate judges of such Court, while such judge or judges, any or all, are temporarily unable to act for any reason. Such appointee shall possess the same qualifications required of the judge for whom � he is sitting and shall have all the powers and duties of such judge while acting for such judge. � Such appointee sha11 receive the same compensation as is payable to the regular Municipal Judge while he is so acting. C. The City Council shall set the compensation for the Municipal Judge and any person or persons appointed to act as a temporary or relief judge for the regular Municipal Judge while the regular Municipal Judge is temporarily unable to act for any reason. Section 2. An Emergency. The fact that the personnel policies of the City of Grapevine are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage, as provided by the Charter of the City and it is accordingly so ordained. � PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF � GRAPEVINE, TEXAS, this the 18 day of October , 1977.
