HomeMy WebLinkAboutORD 1976-008 ORDINANCE � 76-08 AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS MAKING IT UNLAWFUL TO POSSESS OR CONSUME ALCOHOLIC BEVERAGES IN THE PUBLIC PARKS OF THE CITY; PROVIDING DEFINITIONS; PROVIDING EXCEPT- IONS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALN AND DECLARING AN EMERGENCY. "'�' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: SECTION l. Definitions: A) Alcoholic Beverages shall mean alcohol and any beverage containing more than one-half of one per cent (1/2 of 1%) of alcohol by volume which is capable of use for beverage purposes, either alone or when d iluted. B) Public Parks of the City shall include all parks, playgrounds, recreational areas owned, leased, operated or under the control of the City of Grapevine. This definition includes all athletic fields, swimming pools, gymnasiums, tennis courts, golf cources and other similar facilities owned, leased or operated by the City. C) Camping and picnicking area shall be the area specifically posted and deliniated in Oak Gr�ove Park. �� � SECTION 2. It shall be unlawful for any person to possess or consume any al cohol i c beverage i n a publ i c park of the Ci ty of Grapevi ne. SECTION 3. The City Manager is authorized to designate and specifically mark a camping and picnicking area in Oak Grove Park, provided said camping and picnicking area shall not include any of the area or areas used for athletic fields or the parking areas used in conjunction with said fields. This ordinance shall not be applicable to the specifically marked camping and picnicking areas. SECTION 4. It is hereby declared to be the intention of the City Council of the City of Grapevine, Texas, that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and any phrase, clause, sentence,paragraph or section hereof should be declared unconstitutional, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional invalid phrase, clause, sentence, paragraph or section. SECTION 5. Any person violating or failing to comply with any provisions of this ordinance shall be fined uponconvi'ction,not less than ONE DOLLAR ($1.00) nor more than TWO HUNDRED DOLLARS ($200.00) and each day any violation of �' non-compliance continues shall constitute a separate offense. � SECTION 6. The fact that the present ordinances and regulations of the City of Grapevine are inadequate to protect its citizens within the corporate limits of the City of Grapevine, creates an emergency for the immediate preservation of the public, business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage as provided by the Charter of the City of Grapevine and it is accordingly so ordained.
