RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS, ALLOWING EXPLORER
PIPELINE COMPANY TO LOCATE A PIPELINE UNDER
AND ACROSS CERTAIN CITY STREETS IN ACCORDANCE
WITH PLANS AND SPECIFICATIONS FILED WITH THE
CITY SECRETARY
WHEREAS, on the 17th day of March, 1971, application
was made to the City Council of the City of Grapevine by Explorer
Pipeline Company, a Delaware Corporation, to locate a pippline'
under and across certain city streets within the City of
Grapevine, in accordance with plans and specifications attached
hereto and made a part hereof for all intent and purposes, which
plans include values to be located on both sides of the City; and
WHEREAS, Explorer Pipeline Company has agreed and
represented that it shall at all times be in compliance, with
all state and federal regulations pertaining to the location,
construction, operation and maintenance of its pipeline; and
WHEREAS, the construction and haying of the said pipeline
across and under the aforesaid streets and highways shall be upon
notice to and under the direction of the city engineers of the
City of Grapevine; and
WHEREAS, the city engineers have approved the proposed
manner and method of installation of the said pipeline under
and across the aforesaid city streets; and
WHEREAS, the City Council approves of the manner and
method of installation of the said pipeline across and under
the aforesaid city streets;
NOW, THEREFORE, BE IT RESOLVED that Explorer Pipeline
Company, a Delaware corporation, its successors and assigns be,
and is hereby granted, right, permission and authority to locate,
construct, operate, maintain and finally remove if necessary
therefrom a pipeline system for use in the transportation of
petroleum products, across, along, on, in and under the roads
and highways of the City of Grapevine, provided however, that the
pipeline is to be located only within the presently existing
right -of -way of the St. Louis and Southwestern Railway Company
(commonly known as the Cotton Belt Railroad) as said railroad'
line and right -of -way line is located as of the date of the
passage of this resolution.
BE IT FURTHER RESOLVED that the Council requires that
said pipeline be buried at a depth of at least 48" below the bottom
surface of said right -of -way, public street or highway or any
other location within the City limits of the City of Grapevine,
and that such installation be conditioned on the guaranty by
the Pipeline Company that the installation will not impair the
travel on the streets, roads and highways of the City of Grapevine
and that the Explorer Pipeline Company will save harmless the
City of Grapevine for any injuries or damages to any person, persons
or property and will be responsible for the repair of any and all
damages arising from the locating, constructing, using, operating
maintaining and removing of the pipeline system. The Explorer
Pipeline Company represents that no 'special installation
procedures, casings, or tunnelling, will be required for any
City of Grapevine utility line which might cross either above
or below the products line at any time in the future.-
PASSED by unanimous vote of all members present,
none being ;absent, on this 6th day of April, 1971
