RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS, AUTHORIZING
ITS CHIEF OF POLICE TO MAKE PROVISION
FOR ITS REGULARLY EMPLOYED LAW ENFORCE-
MENT OFFICERS TO ASSIST ANY OTHER COUNTY
OR MUNICIPALITY, WHEN A STATE OF CIVIL
' EMERGENCY IS DECLARED TO EXIST IN SAID
COUNTY OR MUNICIPALITY, OR IF THERE EXISTS
A NEED FOR ADDITIONAL LAW ENFORCEMENT
OFFICERS TO PROTECT THE HEALTH, LIFE AND
PROPERTY OF SAID COUNTY OR MUNICIPALITY
BY REASON OF RIOT, UNLAWFUL ASSEMBLY OR
NATURAL OR MAN-MADE CALAMITY.
WHEREAS, the 61st Legislature passed Article 999b
V.A.C.S. , providing for interlocal assistance of law enforcement
officers among counties and municipalities; and
WHEREAS, there is an ever growing experience of civil
disobedience throughout the country whereby various municipalities
have required the need of assistance of additional law enforcement
officers; and
WHEREAS, it is possible that the City of Grapevine
might be called on to provide additional police assistance to
neighboring municipalities or counties; or might need such
assistance from other municipalities or counties itself;
NOW, THERFORE, BE IT RESOLVED that the Chief of Police
of the City of Grapevine, Texas, be authorized to make provision
for the city' s regularly employed law enforcement officers to
assist any other county or municipality, when in the opinion of
the Mayor, or other officer authorized to declare a state of
civil emergency in such other county or municipality, there exists
in such other county or municipality a need for the services of
additional law enforcement officers to protect the health, life,
and property of such other county or municipality, its inhabitants ,
and the visitors thereto, by reason of riot, unlawful assembly
characterized by the use of force and violence, or threat thereof
by three or more persons acting together or without lawful
authority, or during a time of natural disaster or man-made calamity.
BE IT FURTHER RE50LVED, that while any said officer of
this City is in the service of another county or municipality
pursuant to Article 999b V.A.C.S. and this Resolution, he shall
be a peace officer of such other county or municipality and be
under the command of the law enforcement officer therein who is
in charge in that county or municipality, with all power and as
though he was regularly employed by said other county or
municipality.
BE IT FURTHER RESOLVED, that while any said officer of
this city is in the service of another county or municipality,
pursuant to this Resolution, shall be paid by the City of Grapevine,
the same wage, salary, pension, and all other compensation and all
other rights for such service, including injury or death benefits,
the same as if said service had been rendered within the city
limits of the City of Grapevine, Texas.
BE IT FURTHER RESOLVED, that nothing herein precludes
the City of Grapevine from requesting reimbursement from said
other county or municipality benefiting from said service, the
cost to the City of Grapevine, Texas, in providing said additional
police assistance, including all wages, disability payments ,
pension payments, damage to equipment and clothing, medical
expense, and expenses of travel, food and lodging; and authorizing
the City of Grapevine to reimburse any other municipality or
county providing similar services to the City of Grapevine, not
withstanding any provision in the City Charter to the contrary as
provided in Article 999b V.A.C.S.
Passed by unanimous vote of all members present, none
being absent, on this 7th day of December, 1971.
