AN ORDINANCE AMENDING ORDINANCE N0 . 70-10, THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF '
GRAPEVINE, TEXAS, SAME BEING ALSO KNOWN AS
TITLE 10 OF THE CITY CODE OF GRAPEVINE, TEXAS,
GRANTING A ZONING CHANGE ON A TRACT OF LAND
DESCRIBED AS : BEING A PORTION OF LOTS 5 , 6,
� 7, BLOCK 8 , W. C. LUCAS AODITION IN THE CITY
OF GRAPEVINE, TARRANT COUNTY, TEXAS, MORE FULLY
AND COMPLETELY DESCRIBED IN THE BODY OF THIS
ORDINANCE; ORDERING A CHANGE IN THE USE OF
SAID PROPERTY TO "SP" SPECIFIC USE PERMIT DIS=i3
TRICT FOR COMMEFiCIAL AND BUSINESS USES/FOR THE
FiETAIL SALE OF ALCOHOLIC BEVERAGES FOR OFF-
PREMISE CONSUMPTION ONLY AND THE STOfiAGE OF
ALCOHOLIC BEVERAGES INCIDENTAL TO SAID RE-
TAIL SALE, ALL ACCORDING TO THE SITE PLAN
ATTACHED HERETO AND MADE A PART HEREOF ; COR-
RECTING THE OFFICIAL ZONING MAP ; PRESERVING
ALL OTHER PClRTIONS OF THE ZONING OFiDINANCE;
PfiOVIOING A SEVERABILITY CLAUSE: DETEFiMINING
THAT THE PUBLIC INTEREST, MORALS AND GENERAL
WELFARE DEMAND A ZONING CHANGE AND AMENDMENT
HEREIN MADE ; PROVIDING A PENALTY ; AND DECLAR-
ING AN EMERGENCY .
WHEREAS, the City Council of the City o�
Grapevine, Texas, does find that the change in zoning
lessens the congestion in the streets , helps secure
safety from fire , panic and other dangers ; promotes
health and the general wel�are; provides adeqUate light
and air; prevents the over-crowding of land; avoids
undue concentration of population ; facilitates the
adequate provisions o� tnansportation , water, sewerage,
schools , parks and other public requirements ; and,
WH�REAS, the City Council o� the City of
�"'" Gr-apevine , Texas , has determined that there is a necessity
" and need for this change in zoning and has also found
� and determined that there has been a change in the
conditions of the property surrounding and in close
proximity to the property requested for a change since
this property was originally classified and therefore
�eels that a change in zoning classi�ication for the
particular piece o� property is needed, is called �or ,
and is in the best interest of the public at large, the
citizens o� the City o� Grapevine, Texas , and helps
promote the general health , safety and wel�are of this
community ;
NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS :
SECTION 1 . That the City of Grapevine Ordinance No .
70-10, bein� the Comprehensive Zoning Ordinance o� the
City o� Grapevine, Texas , same being also known as Title
10 of the City Code of Grapevine, Texas, be, and the same
is hereby amended and changed in that the use of the fol-
lowing described property , to-wit:
BEGINNING at a point on the northeasterly corner o�
the intersection o� Highway 114 Business and Dove
� Road and proceeding in a northwesterly direction
paralled to Dove Road, 123� , 74' from the corner
� �ormed by the intersection of the easterly side
o� Dove Road and the northerly side of Highway 114
Business ; running thence northe�sterly at a 90� ,
53. 5' ;
THENCE running easterly at a 144� for 46. 5' ;
THENCE running at a 90� angle northerly 58' ;
THENCE easterly at e 90� , 100' ;
THENCE southerly at a 80� , 150' ;
THENCE westerly at a 90° , 149. 5' to tl-ie point or
PLACE OF BEGINNING.
is changed to "SP" Specific Use Permit District �or com-
mercial and business uses/For the retail sale o� alcoholic
beverages for o��-premise consumption only and the storage
o� alcohol�ic beverages incidental to said retail sale.
Said zoning covers only the area delineated in
red on Exhibit "A" , end restricts the sale of alcoholic
beverages to the retail sales room as shown on Exhibit
�tAft�
SECTION 2. The City Manager is hereby directed to

correct the of�icial zoning map of the City o� Grapevine,
Texas , to re�lect the herein change in zoning.
�rrrr SECTION 3. Tf-iat in all otl-ier respects tl-�e use of tl-ie
tract or tracts of land f-ierein above described sl-iall be
subject to all the applicable regulations contained in said
City o� Grapevine zoning ordinance and all other applicable
and pertinent ordinances of the City of Grapevine, Texas.
SECTION 4. That the zoning regulations and districts
as herein established f-�ave been made in accordance with
the comprehensive plant for the purpose o� promoting
health, safety , morals and the general welf are o� the com-
munity. They have been designed, with respect to both
present conditions and the conditions reasonably antici-
pated to exist in tl-ie �oreseeable future , to lesseri con-
gestion in the streets ; to secure safety �rom fire , panic ,
�lood and other dangers ; provide adequate light and air ;
to prevent over-crowding o� land, to avoid undue concen-
tration o� population; �acilitate tf-�e adequate provisions
o� transportation, weter, sewerage, drainage and surf ace
water , parks and other public requirements , and to make
adequate provisions �or ti-ie normal business, commercial
needs and development o� the community. They have been
mede with reasonable consideration, among other things of
� the character o� the district, and its peculair suitability
�or the perticular uses and with a view of conserving
the value o� buildings and encouraging the most appropriate
�` use of land throughout the community .
SECTION 5. This ordinance shall be cumulative of all
other ordinances of' the City o� Grapevine, Texas, a�fecting
zoning and shall not repeal any o� the provisions o� said
ordinances except in those instances where provisions of
those ordinances which are in direct conflict with the
provisions of this ordinance.
SECTION 6. That the terms and provisions of this
ordinance shall be deemed to be severable and that i�
the validity of the zoning a��ecting any portion of the
tract or tracts o� land described herein shall be declared
to be invalid, the same shall not aff ect the validity o�
the zoning o� the balance o� the tract or tracts of land
described herein.
SECTION 7. That a�y person, firm or corporation
violating any o� the terms and provisiohs o� this ordinance
�.,,,,, shall be sub ject to the same penalties provided �or in
Ordinance No . 70-� 0, Zoning Ordinence o� tl-ie City o�
� Grepevine, Texas.
SECTION 8. The �'act that the present zoning ordinance
and regulations o� the City of Grepevine, Texas, are
inadequate to properly safeguard the health, safety,
morals , peace and general welfare of the inhabitants
o� the City of Grapevine , Texas , creates an emergency
for the immediate preservetion of the public bUsiness,
property , health, sa�ety end general wel�are o� the
pUblic which requires that this ordinance shall become
e�fective from and after the date of its final passage,
as provided by the Charter o� the City o� Grapevine, Texas,
and it accordingly so ordained.
