AN ORDINANCE AMENDING TITLE 9, CHAPTER 3 OF THE
CITY CODE OF GRAPEVINE, TEXAS, BY REGULATING THE
SPEED OF VEHICLES �N CONTROL 353-07
LOOP 382 TARRANT COUNTY ;
"'� PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCE
��� PROVISIONS AND FOR THE REPEAL OF CONFLICTING
PROVISIONS OF THE CITY CODE OF GRAPEVINE, TEXAS;
PROVIDING FOR SIGNS; PROVIDING FOR A PENALTY;
PROVIDING FOR A SAVINGS CLAUSE; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF ']�-I E CITY OF
GRAPEVINE, TEXAS:
SECTION 1. That Title 9, Chapter 3 of the City Code of Grapevine,
Texas, be, and the same is hereby amended by adding the following paragraph:

Upon the basis of an engineering and traffic investigation submitted to
the City Council, the City Council hereby finds and determines that a maximum
prima facie speed limit heretofore set for a public street, roadway or highway
set forth below in the City of Grapevine, Texas, is not reasonable or prudent
under the conditions found to exist in the City of Grapevine, Texas, at said
location, therefore, the City Council hereby finds, determines and declares that
' � when no special hazard exists that requires a lower speed for compliance with the
provisions of this ordinance and�or the laws of the State of Texas, no person

shall operate or drive any vehicle on the public streets, roadways or highways

set forth below in the City of Grapevine, Texas, at a greater speed than
F if ty-�i ve ( s5 ) miles per hour, unless otherwise provided by this
ordinance or subsequent ordinance, and any speed in excess of fifty-fi�e
( 55 ) miles per hour, unless otherwise provided by this ordinance or subsequent
ordinance, shall be prima facie evidence that the speed is not reasonable or
prudent and is unlawful,

SECTION 2. This ordinance repeals those provisions, and only those
pro��isions, of aIl ordina n�es and sections of the CitS- Code of Grapevine, Texas,
in conflict with the provisions hereof, but shall in no way repeal any provisions
of any ordinance or section of the City Code of Grapevine, Texas, establishing
a "School Zone" in an area covered by this ordinance.

SECTION 3. The Cit�- Mana,� r is hF reby directed to cause appropriate

signs to be posted at reasonable inter.�als to apprise the public of the speed
limit and give them notice thereof.
SECTION 4, Any person violatina or failing to comply with any provisions
of this ordinance shall be fined upon conviction not less than One Dollar
($1. 00) nor more than Two Hundred Dollars (�200. 00).
SECTION 5, It is hereby declared to be the intention of the City Council
of the City of Grapevine, Texas, that the sections, para�raphs, sen�ences,
� -� clauses and phrases of this ordinance are severable an� if any phrase, clause,
,�.,A, sentence, paragraph or section hereo� should bP cjPclared unc�nstit��tic,nal, such
unconstitutionality or invalidity shall not affect any of the remaining phrases,
clauses, sentences, paragraphs or sections of this ordinance, since the same
would have been enacted by the Gity Council without the incorporation in this
ordinance of any such unconstitutional or invalid phrase, clause, ser.tence,
paragraph or section.
SECTION 6. The fact that:.that the City Code of Grapevine, Texas,
and other ordinances and regulations of the City of Grapevine, Texas, are
inadequate to control the speed of vehicles within the corporate limits of the
City of Grapevine, Texas, creat�s an emergency for the immediate prese•rvation

of the public business, property, health, safety, and general welfare of the
public which requires that this ordinance shall become effective from and aft�r
the date of its passage as provided by the Charter of the City of Grapevine,
Texas, and it is accordingly so ordained,
