AN ORDINANCE AMENDING ORDINANCE NO. 70-10, A
ZONING ORDINANCE OF THE CITY OF GRAPEVINE,
TEXAS , GRANTING A BLOCK ZONING ON A TRACT OF

LAND IN THE J. R. DOSS SURVEY, ABSTRACT NO.
�`,,,�,, 440, AND THE G. W. MINTERS SURVEY, ABSTRRCT
1083, IN THE CITY OF GRAPEVINE, TEXAS , AND
MORE FULLY DESCRIBED HEREIN; ORDERING A
CHANGE IN THE USE OF SAID PROPERTY TO "C-2"
COMMiJNITY BUSINESS DISTRICT, "I-1" LIGHT
INDUSTRIAL DISTRICT, "I-2" HEAVY INDUSTRIAL
DISTRICT; CORRECTING THE OFFICIAL ZONING MAP;
PRESERVING ALL OTHER PORTIONS OF THE ZONING
ORDINANCE; PROVIDING A SEVERABILITY CLAUSE;
DETERMINING THAT THE PUBLIC INTEREST, MORALS,
AND GENERAL WELFARE DEMAND A ZONING CH!-1NGE AND
R � AMENDMENT HEREIN MADE; PROVIDING A PENALTY;
� AND DECLARING RN EMERGENCY.

WHEREAS, applications were made to amend the
Official Zoning Map, City of Grapevine, Texas, by making
applications for same with the Planning and Zoning
Commission of the City of Grapevine, Texas, as required
by state statutes and the zoning ordinances of the City
of Grapevine, Texas, and all the legal requirements,
conditions and pre-requisites having been complied with,
the case having come before the City Council of the City
of Grapevine, Texas, after all legal notices, require-
ments, conditions and pre-requisites having been complied
!�"`� with; and,
��� WHEREAS, the City Council of the City of
Grapevine, Texas, at a public hearing called by the
City Council did consider the following factors in
making a determination as to whether these requested
changes should be granted or denied; safety of the
motoring public and the pedestrians using the facilities
in the area immediately surrounding the site; safety
from fire hazards and measures for fire control, protection
of adjacent property from flood or water damages, noise
producing elements and glare of the vehicular and
stationary lights and effect of such lights on established
character of the neighborhood, location, lighting and .
types of signs and relation of signs to traffic control
and adjacent property, street size and adequacy of width
for traffic reasonably expected to be generated by the
proposed use around the site and in the immediate
� neighborhood, adequacy of parking as determined by
requirements of this ordinance for off-street parking
facilities, location of ingress and egress points for
i �` = parking and off-street loading spaces, and protection
, of public health by surfacing on all parking areas to
control dust, effect on the promotion of health and the
� =t general welfare, effect on light and air, the effect on
the over-crowding of the land, the effect on the concen-
tration of population, the effect on the transportation,
water, sewerage, schools, parks and other public facilities;
and,
WHEREAS, the City Council of the City of
Grapevine, Texas, at a public hearing called by the
City Council of the City of Grapevine, Texas, did consider
the following factors in making a determination as to
whether this requested change should be granted or denied;
effect on the congestion of the streets, the fire hazards,
panics and other dangers possibly present in the securing '
of safety from same, the effect on the promotion of health
� and the general welfare, effect on adequate light and air,
the effect on the over-crowding of the land, the effect
on the concentration on population, the effect on the
transportation; water, sewerage, schools, parks and other
� public facilities ; and,
WHEREAS, the City Council further considered
� among other things the character of the district and its
peculiar suitability for particular uses and with the
view to conserve the value of buildings, encourage the
most appropriate use of land throughout this city; and,
WHEREAS, the Ci�y Cauncil af the City of
Grapevine, Texas, doe� find that there i� a public
necessity for the zoning change, tha� the public demands
it, that the public interest clearly requir�s the amend-
ment, �hat the zaning changes do not unreasanably invade
the rights of those who �ought or improved property with
re�ere�ce �a �he classification which existed a� the time
their original investment was made; and, �
-1 WHEREAS, the City Council af �he City of
�' � Grapevine, Texas, does find �hat the change in zaning
le�sens the cange�tion in the street�, helps secure
� � sa�ety fram fire, panic a�d ather danger�; pramotes
health and the gen�ral welfare; provides adequa�e light
and air; prevents the over-crowding af Iand; avoids
undue concentratian of papulation; facilitates �he
adequate provisions a� transportatian, water, sewerage,
school�, parks and other public requirements; and,
WHEREAS, the C�ty Council af �he City of
Grapevine, Texas, has determined tha� there is a necessity
and need �ar �his change in zoning and has also found
and de�ermined that there has been a change in the
conditions of the property su'rrounding and in close
praximity ta the property reques�ed �or a change since
this property was originally cla�sified and therefore
feels tha� a change �n zaning classifica�ian for the
particular piece of property is needed, is called for,
and is in the best interest of the public a� large, the
ci�izens of the City of Grap�vine, Texas, and helps
promote the general health, safety and welfare of this

SECTION l. That t}�e City of Grapevine Ordinance
No_ 70-10, heing the Comprehensive Zoning Ordinance of the
. City of Grapevine, Texas , same being also known as Title
10 of the City Code of Grapevine, Texas, be, and the same
is hereby amended and changed in that the use of the
following described property, tc-wit:

� -� Tract or parcel of land situated in Grapevine , Tarrant County,
Texas., and being a tract out of the J. R. Doss Survey, Abstract
No. 440 and being more particularly described as follows:
� CONIMENCING at the Northwest corner of the said Doss Survey;
THENCE East along the North line of said Doss Survey to its
intersection w ith the East R.O.W. line of future State High- -
way 121A and being the place of beginning of this tract ;
� THENCE East along said North line of Doss Survey 700 feet to
a point for corner;
THENCE South to the South line of said Doss Survey for a point
for a corner;
THENCE West along the South line of said Doss Survey 700 feet;
THENCE North to the place of beginning; which is presently
zoned "R-1" under Ordinance 70-10 is changed to "C-2" .

feet East of the East R.O.W. line of future State Highway 121A;
THENCE East along said South line to a point for a corner, said
point being in the Southwest corner of the Southeast one fourth
of the East one half of the said Doss Survey;
THENCE, North along the West line of said Southeast one fourth
of the East one half of said Doss Survey and continuing North to
a point in the North line of said Survey, same point being the
Northwest corner of a tract of land as recorded in Volume 5020,

the of�icial zoning map o� the City af Grapevine, Texas,
to reflect the herein change in zaning.
SECTION 3. That in al3 other respec�s the u�e of the tract
or tracts of land herein above descra.bed shall be subject
to all the appZicable regulations contained in said City of
Grapevine zoning ordi�ance and all other applicable and
pertznent ordinances af the City of Grapevine, Texas.
� ' SECTION 4. That �he zoning regulations and distric�s as
herein establi�hed have been made in accordance with the
''*�' comprehenszve plant far the purpose af proma�ing health,
sa�ety, morals and the general welfare o� the community.
They have been designed, with respect ta both present
conditions and the conditioris reasonably an�icipated to
exist in the foreseeable �uture, ta lessen cangestian in
the stree�s; to secure sa�ety fram fire, panic, flood and
other dang�rs; pravide adequate ligh� and air; ta prevent
over-crowding of land, to avoid undue concentration of
population; facilitate the adequate pravisians af trans-
portation, water, sew�rage, drainage and surface water,
� parks and other publ3c requirements, and to make adequa�e
provisions for the normal business, commercial needs and
developmen� of the community. They have been made with
reasonable con�ideration, among other things of the
character af the district, and its peculiar �uitability
for the particular uses and with a view of conserving
the value af buildings and encouraging the most appropriate
use of land throughou� the community.

� SEGTION 5. Th.is ordinance shall be cumulative af al1
� other ordinances af the City of Grapevine, Texas, affec�ing
zoning and shall not repeal any of the provisions of said
`" ' ordinances except in those instances where provisions of
thase ardinanc�s which are in direct con�lict with the
provisions of this ordinance.
SECTION 6. That �he terms and provisions of this
ardinance shall be deemed ta be �everable and that if
the validi�y af the zoning affec�.ing any por�ion of the
tract ar -tracts of larid described herein sha11 be declared
to be inval.id, the same shall no� af�ect the validi�.y of
the zaning af the balance of the tract or tracts of land
de�cribed herein.
SECTION 7. That any persan, firm or corporation violating
any' of the terms and provisions of this ordinance shall be
subject ta the same p�nalties provided far a.n Ordinance
No. 70-14, Zor�ing Ordinance of the City of Grapevine, Texas.
SECTION 8. The fact �hat the present zoning ordinance and
""�'"� rec�ulations of the City of Grapevine, Texas, are inadequate
to properly safeguard the health, sa�ety, moral�, peace and
geraeral welfaare of the inhabitan�.s of the City af Grapevine,
'� Texas, creates an emergericy for �.he immediate preservation of
the public bu�iness, property, heal�.h, safe�.y and general
welfare of the public whi.ch reguires that thzs ardinance shall
become effective �rom and af�.er the date of its final passage,
and i� accordingly sa ardained.
